HomeMy Public PortalAbout73-136RESOLUTION NO. 73-136 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON ACCEPTING THE WORK PERFORMED BY SULLY -MILLER, OLD QUAKER PARKING LOT PAVING, CASH CONTRACT NO. 135 WHEREAS, the City Council did on the 21st day of May, 1973, adopt Resolution No. 73-101 awarding the contract for the paving of Old Quaker Parking Lot in the City of Carson (Cash Contract No. 135) to Sully -Miller, Inc.; and WHEREAS, said work has been duly performed and completed by said contractor; M. WHEREAS, said work has been inspected by the Public Works Director and by him approved as constructed and completed in its entirety, in accordance with the plans and specifications for such improvement project and authorized revisions therein; and WHEREAS, said Director does ncw recommend and request the acceptance of the work and the filing of a Notice of Completion thereof; and WHEREAS, the final contract price for said work is the sum of $5,279.37, which said sum the Director has approved as just and fair; and WHEREAS, the contract documents rpvide that a total of 10% ($527.94) of said total contract price shall be retained until thirty-five (35) days after the recording of the Notice of Completion of said improvement project. NOW, THEREFORE, BE IT RESOLVED that the City of Carson does hereby accept the work performed by said contractor and approve the some as being completed in accordance with the plans and specifications for said project and authorized revisions therein; and theCity Administrator is hereby authorized to file Notice of Completion of said project in the Office of the Los Angeles County Recorder; and BE IT FURTHER RESOLVED that the City Treasurer is authorized and directed to pay to said contractor, Sully -Miller, the sum of $5,279.37 in full payment of said work performed by said contractor, less any sums held until the expiration of thirty-five (35) days following the filing of said Notice of Completion, and then paid contingent upon the absence of the filing of any stop notice against said project within thirty (30) days after the filing of the Notice of Completion; and BE IT FURTHER RESOLVED that upon the expiration of said thirty-five (35) days following the filing of said Notice of Completion, without any claim being ruled against said project, that all bonds filed by the contractor in said project shall be exonerated and discharged, excepting that the faithful performance bond shall remain in force until the expiration of one year from the date of filing said Notice unless a substitute bond approved by the Director of Public Works and the City Attorney shall have been filed. Cortina, City Clerk of the City of Carson, do hereby certify that the whole number of members of the City Council of the City of Larson is five; that the foregoing resolution, being Resolution No. 73-136, was duly and regularly adopted by the City Council at a regular meeting of said Council, duly and regularly held on the 16th day of July, 1973, and that the same was so passed and adopted by the following vote: AYES: COUNCILMEN: Bridgers, Calas, Smith and Yamamoto.
