OTHERS PRESENT: B.MURPHY, VILLAGE ADMINISTRATOR; J.HARVEY, ATTORNEY; MGIBAS, VILLAGE CLERK; S.AMANN, ENGINEER; D.KISSEL, WASTEWATER SUPERINTENDENT; MGARRIGAN, PLANNING SUPERVISOR; D.MARQUEZ, BUILDING SUPERVISOR; TYLECKHAM, MANAGEMENT SERVICES DIRECTOR; AND B.DOSTER, CHIEF OF POLICE. CALL TO ORDER, ROLL CALL, PLEDGE Mayor Collins called the meeting to order at 7:00 p.m. Roll call was taken, all Trustees were present. Mayor Collins led the pledge to the flag. There were approximately 25 persons in the audience. PRESIDENTIAL COMMENTS Mayor Collins: • Mayor Collins presented a plaque to Illinois State Trooper Willis for making a traffic stop that ultimately led to the recovery of stolen merchandise from several Will County Municipalities including Plainfield. • Proclaimed October 2010 as Domestic Violence Awareness Month. • Proclaimed October 16 -23, 2010 as Plainfield Clean -up Week. • Thanked everyone who participated in the Plainfield Homecoming Parade and pointed out that there were approximately 13,000 people in attendance. • Thanked Mr. Mark Guzzo for donating masonry work on the Gazebo. • Thanked MainStreet Plainfield, Inc. for their generous donation towards the Gazebo. TRUSTEES COMMENTS Trustee Bonuchi thanked the Homecoming Committee as well as PEMA and the Police and Fire Departments. Trustee Fay expressed some concern regarding the gas tanks on Route 30. Mayor Collins pointed out that they have to pass required inspections. PUBLIC COMMENTS on items not on the Agenda (3 -5 minutes per topic) Mr. Jeff Maliski, Vintage Harvest resident, expressed concern regarding the noise from Live 59. BUSINESS MEETING 1) APPROVAL OF AGENDA Trustee Fay moved to approve the Agenda. Seconded by Trustee Peck. Vote by roll call. Fay, yes; Kachel, yes; Lamb, yes; Peck, yes; Racich, yes; Bonuchi, yes. 6 yes, 0 no. Motion carried. C) Ordinance No.2955, increasing the Class "C" Liquor Licenses to six (6) for Palomar Liquors. Seconded by Trustee Lamb. Vote by roll call. Fay, yes; Kachel, yes; Lamb, yes; Peck, yes; Racich, yes; Bonuchi, yes. 6 yes, 0 no. Motion carried. 3) TEXT AMENDMENTS TO CHAPTER 2.5 OF THE MUNICIPAL CODE Trustee Fay moved to open the continued Public Hearing to consider a text amendment to modify Chapter 2.5 of the Municipal Code and continue it to October 18, 2010. Seconded by Trustee Bonuchi. Voice Vote. All in favor, 0 opposed. Motion carried. 4) GREEN - LUTTER LANDMARK Trustee Fay moved to adopt Ordinance No.2956, designating the Green - Lutter House located at 23839 W. Main Street as a Historic Landmark. Seconded by Trustee Lamb. Vote by roll call. Fay, yes; Kachel, yes; Lamb, yes; Peck, yes; Racich, yes; Bonuchi, yes. 6 yes, 0 no. Motion carried. 5) ROUTE 59 GRILL SPECIAL USE (PC CASE #1521- 072810.SU) Trustee Fay moved to adopt Ordinance No. 2957, granting approval of a special use to permit a drive - through operation for a restaurant located at 15521 S. Rt. 59, subject to the stipulations noted in the staff report. Seconded by Trustee Peck. Vote by roll call. Fay, yes; Kachel, yes; Lamb, yes; Peck, yes; Racich, yes; Bonuchi, yes. 6 yes, 0 no. Motion carried. 6) SHELL STATION Trustee Fay moved to adopt Ordinance No. 2958, approving a Special Use for a Shell Service Station on Route 30. Seconded by Trustee Peck. Vote by roll call. Fay, yes; Kachel, yes; Lamb, yes; Peck, yes; Racich, yes; Bonuchi, yes. 6 yes, 0 no. Motion carried. ADMINISTRATOR'S REPORT No Report. MANAGEMENT SERVICES REPORT No Report. ENGINEER'S REPORT Trustee Bonuchi moved to authorize the Village President to execute a contract with "D" Construction, Inc., contingent upon funding re- approval from the IEPA, for the installation of the Naperville Road Water Transmission Main at a total bid amount of $2,880,000.00. Seconded by Trustee Racich. Vote by roll call. Fay, no; Kachel, yes; Lamb, yes; Peck, no; Racich, yes; Bonuchi, yes. 4 yes, 2 no. Motion carried. BUILDING DEPARTMENT REPORT No Report. PUBLIC WORKS REPORT Mr. Doug Kissel gave a presentation on the North Wastewater Treatment Plant and invited everyone to attend the Open House on October 9, 2010 from 10:00 a.m. to 2:00 p.m. POLICE CHIEF'S REPORT Trustee Fay moved to adopt Ordinance No. 2959, enacting Chapter 5, Article III, Section 5 -74 of the Village of Plainfield Code. Seconded by Trustee Racich. Vote by roll call. Fay, yes; Kachel, yes; Lamb, yes; Peck, yes; Racich, yes; Bonuchi, yes. 6 yes, 0 no. Motion carried. Trustee Peck moved to adopt an Ordinance amending Chapter 4, Article IX, relating to Business Registration adding #9 to Section 4 -431 to include language regarding the direct hiring of illegal immigrants. Seconded by Trustee Fay. There was some general discussion regarding the proposed amendment to the ordinance. Trustee Lamb suggested bringing this item back for further discussion and he would like to see the proposed language in writing. Trustee Peck withdrew his motion and Trustee Fay withdrew the second. Trustee Peck moved to table the item. Seconded by Trustee Fay. Vote by roll call. Fay, yes; Kachel, yes; Lamb, yes; Peck, yes; Racich, yes; Bonuchi, yes. 6 yes, 0 no. Motion carried. Seeking a motion to authorize the purchase of the Care Track Emergency Response Package at a total cost of $9,339.98. This item was removed from the Agenda. There was some discussion regarding limiting the parking on Ottawa Street. Trustee Fay moved to restrict the parking on Ottawa Street to 3 hours Monday- Friday until 6:00 p.m. and to mirror the parking signs on Commercial Street. Seconded by Trustee _. Vote by roll call. Fay, yes; Kachel, yes; Lamb, yes; Peck, yes; Racich, yes; Bonuchi, yes. 6 yes, 0 no. Motion carried. Chief Doster presented a staff memo regarding No Left Turn Northbound Eastern to Westbound Route 126. There was no discussion on this item.
