The Applicant has do ne so , by narrowing it so it co uld include tra ditional shutters similar to those on the remaining windows of the ho me. That change ha s been made and is reflected in your materials. One of the defining characteristics of the Place Au Soliel district is open front lawns. Open fro nt lawns is defined as fo llows: Open front lawns sha ll mean an unobstructed view vista of the front lawn of at least 75 percent of the front prope rty line without landscape planting ex ceeding a ma ture height of three feet. The landscape architect testified that there would be four oak trees, 18' each at planting, in the fr ont yard. The Landsc ape Architect has been asked to make adjustments to the landscaping as needed to protect the vista view. The application includes a request to exceed the maximum permitted FAR by 98 sq . ft . pursuant to section 70-72(b), which reads as follows: (b) Roof projections. Up to 300 square feet of roof projections (covered, u ne nclosed floor areas) may exceed the max imu m permissible FAR subject to the followi ng: (1) Maximum floor area. The maximum floor area in e xcess of FAR is 300 square feet . One or more roof projections may be approved under this special exception provided the t otal fl oor area of all projections do es n ot ex ceed the max imum permitted FAR, by more tha n 300 sq uare feet . (2) Specific standards for review. a. The roof projection (s) shall be compatible and compleme ntary to the architect ure of the stru ctu re an d shall add appropriate architect ural detail and relief to a facade. b. The roof projection(s) shall not make the structure look more massi ve . c. The total floor area of the roof projection s shall not e xceed the maximum permissible FAR by more than 300 square feet. d. For each on e squ are foot of roof projection ov er the maximum permissible F AR, two square feet of roof projection must be provided that are within the maximum permissible F AR, and all sha ll rema in forever un en closed. e. Prior to the issuan ce of a certificate of occu pancy or certificate of completio n, the owner of the property shall prepare and record a deed restriction which, at a minimum, shall provide that all roof projection areas required to remain u nenclosed as per approv al of this special exceptio n shall remain so for as long as the structu re is in existence or exceeds the maximum permissible FA R. ARPB member Teri Power asked why the special exception was being requested, to which the application noted that the request was for additional covered, unenclosed area for the rear patio, as shown on page A-5. I believe this will violate the district standard for open front lawns, but I also realize that the property is wider at the front than the rear.
