A rtificial Turf Discussion: The a pplicant is replacing pa rt of the St. A ugustine grass on the north side of the yard that is co ncea led fro m the street with artificial turf. This is the first application f or Artificial Turf since the Town Commission passed Ordina nce 23-02, which crea ted a new section 70-152 . Artificial Turf. which rea ds as fo llo ws: Sec. 70-152. - Artificia l Turf. Artificial Turf is permitted with the fo llo wing restrictions in certain limited locations: (1) General. a. The installatio n of artificial turf requires To wn appro val. b. A rtificial turf areas may not be included in o pen space calculatio ns. c. Artificial turf shall be co nsidered impervious and shall no t count to wards landscaped o pen space. (2) Materials. a. The grass blades of artificial turf shall be made of po lyethylene. Artificia l turf grass blades ma de of polypropylene or nylon are prohibited. b. A rtificial turf using rubber crumb as a cushioning or tha tch material is prohibited. c. A ll artificial tu rf shall be lead free and use recycled or organic pla nt -derived materials and natural infill co mpo nents, including, but no t limited to, cork, coconut, corn husk, rice husk, and sa nd. D ocumentation must be provide d that identifies all recyclable or natural compo nents of the artificial turf system. d. A sample of the artificial turf propo sed fo r use shall be provided as part of an application fo r To wn appro val and shall be an acceptable aesthetic substitute for natural grass. (3) Location s. a. A rtificial turf may be installed in limited area s of rear and side yards which are no t visible fro m any street or waterwa y, or as a driveway accent in a ny yard, example to include strips of artificial turf placed between sto ne or concrete driveway pads. b. No artificial turf shall be installed in the public right-of-way or closer than three (3) feet to any pr operty line . (4) Miscella neous. a. Artificial turf installati ons shall have a minimum permeability of 30 inches per h our per square yard and minimum tufted weight of 56 ounces per square yard. b. All artificial turf shall have a minimum eight -year manufacturer's warranty th at protects against color fading and a decrease in pile height. c. All materials must include test documentation which declares that the artificial turf yarn and backing materials are disposable under normal conditions, at any U .S. landfill stati on (Total Content Leach Protocol (TCLP) test) . d. Proper dr ainage shall be provided for all artificial turf installati ons to prevent excess runoff or p ooling of water as e videnced by a drainage pl an. e. Artificial turf shall be visually level, with the grain p ointing in a single direction. f. An appropriate barrier device (e.g., c oncrete mow strip, bender b oard, brick pavers, river rock, landsc aping) is required to separ ate artifici al turf from soil and live vegetation. g. Preca utions for installation ar ound e xisting trees shall be restricted to ensur e tree roots are no t damaged with the installati on of the base material and that the o verall health of the tree will n ot be compromised. Ordina nce 23-02 a lso adjusted Sectio n 66-141 to require "applications that seek to use or incre ase the use of artificial turf" to obtain ARPB approval as Projects requiring l evel 2 architectural/ site pla n review. Town staff reco mmends approval of the location as it meets the criteria of "limited areas of rear and side yards which are no t visible from any street or waterway" because the turf is in the side yard pa rtially concealed from the wa terway by the structure, and concealed from direct views from the water by landscape plantings located on the northwest side of the property. WHEREAS, the Town of Gulf Stream has discussed whether to allow artificial turf within the Town and reviewed ordinances permitting the use of artificial turf in other coastal municipalities in Palm Beach County; and WHEREAS, during the May 12, 2023, meeting of the Town Commission, resident Nils Friis, who holds a Ph.D in Chemical Engineering from Technical University of Denmark, presented a comprehensive analysis of artificial turf including: its history; the key components including grass blades, thatch, turf backing, and cushioning; the materials used for the grass blades which include either polyethylene, polypropylene, or nylon; how these materials look and feel, their susceptibility to UV degradation, and each material's varying need for the use of plasticizers; the dangers associated with cushioning and thatch made from recycled tires (rubber crumb) as they often contain polycyclic aromatic hydrocarbons (PAH) and heavy metals, many of which are carcinogenic or linked to neurological disorders similar to Alzhe imer's and Parkinson's disease; and WHEREAS, based on his expertise in this area, Dr. Friis recommended that the only artificial turf permitted be made from polyethylene, as polye thylene is the softest, most realistic looking artificial turf of these three materials, while minimizing turf burn and being extremely resistant to water absorption; and that artificial turf using rubber crumb as a cushioning or thatch material be prohibited due to the harmful impacts of PAH and heavy metals; and WHEREAS, the Town of Gulf Stream finds that polyethylene is the softest, most realistic lo oking artificial turf and the use of artificial turf with this material in certain, limited locations not visible from the roadway or waterway in lieu of natural grass is in keeping with the beauty and charm of the Town; and WHEREAS, the Town of Gulf Stream finds that artificial turf using rubber crumb as a cushioning or thatch material should be prohibited due to the harmful impacts of PAH and heavy metals; and WHEREAS, the Town of Gulf Stream further finds that it serves the public health, safety, and welfare to adopt specific r egulations governing the type of artificial turf that can be utilized including its materials, as well as the appropriate locations. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COMMISSI ON OF THE TOWN OF GULF STREA M, PAL M BEACH COUNTY, FLORIDA, AS FOLLOWS Section 1. The Code of Ordinances of the Town of Gulf Stream is hereby amended at Chapter 22. Nuisances; Article II . Unsightly, Unsafe, or Unsanitary Conditions; Section 22-31 . Prohibited. to read as follows: Sec. 22-31. - Prohibited. It shall be unlawful and shall constitute a nuisance for any owner of land within the town to have or permit thereon any: X22) Artificial turf that falls into disrepair as evidenced by dirt, mud, stains, weeds, debris, tears, holes. impressions. or fading. Section 2. The Code of Ordinances of the Town of Gulf Stream is hereby amended at Chapter 66. Zoning; Article V. Site Plans; Division 2. Architectural/Site Plan Review —Levels 1, 2, and 3; Section 66-141. Applicability. to read as follows: Sec. 66-141. - Applicability. For purposes of administering the requirements of this article, development projects are classified as follows: * * * (2) Projects requiring level 2 architectural/site plan review. a. Detached, habitable, minor accessory structures; b. Expansions of existing primary or accessory structures of greater than 300 square feet or ten percent of the existing total flo or area on the property, but not larger than 50 percent; c. Demolitions of existing primary or accessory structures of greater than 300 square feet or ten percent of the existing total floor area on the property but not more than 50 percent; d. Removal of more than two trees of over eight inches in caliper, or removal of any trees where replacement trees are not proposed. This provision shall not be applicable to clubs located within the town which maintain golf courses which require removal and replacement of trees as a matter of maintenance and improvement of the golf course. This exemption shall not apply, however, in the event of the removal and replacement of trees located within a perimeter of 100 feet of any boundary of the golf course. 2 Notwithstanding the foregoing, removal or alteration of more than 50 percent of vegetation on a site requires level III approval . e. New entrance gates along A1A, major landscaping additions or removal, applications that seek to use or increase the use of artificial turf and all projects within the 50 -foot North Ocean Boulevard Overlay district; f. Changes in exterior wall, roofing, window, door, mailboxes, awning, or column material, which are significantly different in color, texture, or appearance than the existing materials; g. Development proposals which otherwise would require a level 1 architectural/site plan review but which, in the opinion of the planning and building administrator, warrant a level 2 architectural/site plan review due to the development's potential impacts . Section 3. The Code of Ordinances of the Town of Gulf Stream is hereby amended at Chapter 70. Gulf Stream Design Manual; Article V. Areawid e Standards; Division 3. General Landscape Standards; Section 70-148. Principles. to read as follows: Sec. 70-148. - Principles. Because of this diversity, no particular style or technique is encouraged or discouraged overall. Landscape issues shall be addressed on a district level basis . General Landscape Standards; to add a new Section 70-152 . Artificial Turf. to read as follows: Sec. 70-152. — Artificial Turf. Artificial Turf is permitted with the followingjestrictions in certain limited locations: (1) Gen eral_ a. The installation of artificial turf re wires Town approval. b. Artificial turf areas may not be included in open space_ calculations . c. Artificial turf shall be considered impervious and shall not count towards landscaped open space. (2) Materials. a. Thegrass blades of artificial turf shall be made of polyethylene. Artificial turf grass blades made of polypropylene or nylon are prohibited. b. Artificial turf using rubber crumb as a cushioning or thatch material is prohibited. c. All artificial turf shall be lead free and use recycled or organic plant - derived materials and natural infill components. including. but not limited to corLcoconut, corn huskrice husky and_ sand_ Documentation must be provided that identifies all recyclable or natural components of the artificial turf_ystem. d. A sample of the artificial turf proposed for use shall be provided as part of an application for Town approval and shall be an acceptable aesthetic substitute for natural grass. (3) Locations. a. Artificial turf may be installed in limited areas of rear and side yards which are not visible from any street or waterway. or as a driveway accent in any yard, example to include strips of artificial turf placed between stone or concrete driveway pads. 4 b. Artificial turf shall not be installed in any front yard areas, except as a drive waaccent. c. No artificial turf shall be installed in the public right-of-way or closer than three (3) feet to any property line. (4) Miscellaneous. a. Artificial turf installations shall have a minimum permeability of 30 inches per hour per square yard and minimum tufted weight of 56 ounces per square yard. b. All artificial turf shall have a minimum eight -year manufacturer's warranty that protects against color fad_ ink and a_decrease_in pile height . c. All materials must include test documentation which declares that the artificial turf yarn and ba king materials are disposable under normal conditions, at any U .S . landfill station Total Content Leach Protocol (TCLP)_ test). d. Proper drainage shall be provided for all artificial turf installations to prevent excess runoff or pooling of water as evidenced by a drainage plan e. Artificial turf shall be visually level, with the__grain pointing in a _single direction. f. An appropriate barrier device (ems.. concrete mow strip, bender board brick pavers, river rock, landscaping) is required to separate artificial turf from soil and live vegetation. g. Precautions for installation around existing trees shall be restricted to ensure tree roots are not damaged_ with the installation of the base material and that the overall health of the tree will not be compromised. Section 5. All other provisions of Section 22-31. Prohibited; Section 66-141. Applicability; and Section 70-148. Principles. not amended in Section 1, Section 2, or Section 3 above shall remain intact. Section 6. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby declared severable. Section 7. Repeal of Ordinances in Conflict. All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 8. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Gulf Stream. 5 6R Section 9. Effectiv e Date . This Ordinance shall take effect immediately upon its passage and approval, as provided by law.
