KOCH, JR. COMMISSION CHAMBERS OF THE TOWN HALL, 100 SEA ROAD, GULF STREAM, FLORIDA. I. CALL TO ORDER Chairman Murphy called the meeting to order at 8:30 A.M. II. Minutes A. Regular Meeting of July 27, 2023 Alternate Board Member Power made a motion to approve the minutes of the July 27, 2023, regular meeting. Chairman Murphy called attention to the upcoming meeting dates. Town Clerk Basel reminded the Board that the November meeting was a week earlier due to the Thanksgiving holiday. VI. Public Hearing A. Administer Oaths Town Clerk Basel swore in Carol Perez, Cary Glickstein, Mitch Kunik, Luis Rivera, Akiko Iwata, Jay Colestock, and Steve Streit. Minutes of ARPB Regular Meeting & Public Hearing Held 9-28-2023 @ 8:30 A.M. C. Application for Development Approval 1. An application submitted by Carol Perez, AGT Land, P.A., as Agent for The Little Club, owner of the property located at 100 Little Club Road, Gulf Stream, Florida, legally described as GULFSTREAM CO PL SHOWING PROPERTY OF PT OF PL IN 34-45-43 (LESS NLY 249.41 FT OF ELY 148.83 FT, N 680 FT OF S 1085.43 FT OF E 140 FT, N 190 FT OF S 405.43 FT OF E 220.95 FT, HILLSIDE HOUSE OF GULF STREAM CONDO & LAS CASITAS INC) & 34-45-43, S 215.43 FT OF W 281.15 FT OF E 502.10 FT. a. Level II Architectural/Site Plan Review to permit landscape renovation of parking lot. Carol Perez, Landscape Architect, gave a minimal presentation of the landscape beautification project for The Little Club parking lot. She stated they were removing 17 Sable Palms and ten trees that were in poor condition. She noted there were islands in the parking lot where there were no trees at all. Ms. Perez stated they were proposing replacing the trees on the west side with Pitch Apple Clusia and then putting 11 Sylvester Date Palms in the islands. She added they would be underplanting those with Coco Palms and Ficus Green Island. On the east side she stated there would be a row of Green Buttonwoods. Ms. Perez stated they had met all the mitigation requirements. Board Member Canfield made a motion to approve a Level II Architectural/Site Plan to permit the removal of certain existing landscaping and install new landscaping. Alternate Board Member seconded the motion with all voting AYE at roll call. Chairman Murphy made a statement that the next four applications would be a first for the Board to have four Level III houses located next to one another. He noted that the challenge would be that they were compatible with the surrounding houses and yet were differentiated per the Town Code. He brought attention to the letter that was sent on September 21, 2023, by the Town Manager to Mr. Paul Courchene addressing certain points from the staff to which Mr. Cary Glickstein stated that he had not seen the letter. Town Clerk Basel then provided him with a copy. 2. An application submitted by Paul Courchene, Courchene Development Corporation, owner of the property located at 2915 Bluewater Cove (Lot 3), Gulf Stream, Florida, legally described as PLACE AU SOLEIL ADDITION NO 2 LT 3. a. Level III Architectural/Site Plan Review to permit construction of a new one-story 4,233 sq. ft. Gulf Stream Bermuda single family home, including new landscape and hardscape, a two -car garage and swimming pool. 2 Minutes of ARPB Regular Meeting & Public Hearing Held 9-28-2023 @ 8:30 A.M. Mr. Cary Glickstein, managing member of Bluewater Cove, stated he was present to introduce the people who were going to be presenting each application. He added that differentiation had been discussed from the very beginning of this project and the limitations of that within the Gulf Stream Code and he felt they had done a really good job of differentiating the homes. Mr. Glickstein stated that it had also been discussed that these homes would not be 14 one-off custom homes, but there would be three to four models that would differ from one another, and he believed that had been acceptable to the ARPB and Commission. Mitch Kunick and Louis Rivera, Architects from Affinity Architects, gave a detailed PowerPoint presentation. The vaulted ceilings were discussed, and Assistant Town Attorney Nazzaro stated that the Town Code clearly says that ceilings over 15, count twice. He added that it was unclear on the plans so it would need to be clarified. Discussion regarding shutters on sides and rear was had and Mr. Kunik stated they were trying to stay consistent with the front of the house. Assistant Town Attorney Nazzaro stated on the Gulf Stream Bermuda it was required to have shutters, that they be functional and contrast in color. Mr. Kunik stated it would be easy enough to put shutters on the sides and rear, but if it was required of the front, they would have to revisit. Town Clerk Basel noted that the staff had made it very clear during the pre -application meeting that shutters were required. Chairman Murphy asked about the height on the privacy wall to which Mr. Kunik answered that it was six feet. Chairman Murphy noted that in the letter sent to Mr. Courchene it needed to be four feet. Mr. Kunik stated that the existing homes had six-foot privacy walls. Mr. Glickstein asked if the six-foot height on the wall was a building code requirement or a zoning code requirement to which Town Manager Dunham answered that it was a zoning code requirement that if it can be seen from the street, it has to be four feet. Mr. Glickstein asked if it was on the property line if it could then be six feet to which Assistant Town Attorney Nazzaro stated it could be six feet if it was on side and rear property lines and locations not visible from the street. Mr. Nazzaro added that if the other homes had been given approval on the six feet, then Town Clerk Taylor must have missed it in her review. Akiko Iwata, Landscape Architect, gave a detailed presentation and stated that each house had a variety of different selections in the landscape design and exceeded the requirements. Chairman Murphy stated that what was presented would not be able to be approved by the Board and asked if they wanted to defer or withdraw the application. Mr. Glickstein stated he preferred to have it approved subject to changes rather than come back before the Board. Chairman Murphy stated that the Commission had made it clear that it was to be a complete package before sending it from the ARPB to the Commission and he didn't feel he could do that at this stage in the application process. Chairman Murphy stated that the hardscape was the same on every front lawn regarding the sidewalk leading up to the front door and walkways to the garage. Board Member Canfield stated that when you look at the homes individually, they were fantastic, but when you see them on 3 Minutes of ARPB Regular Meeting & Public Hearing Held 9-28-2023 @ 8:30 A.M. the streetscape, there is no variation at all. He added that the shutters needed to have color as well as there was no color variation between the houses at all. Chairman Murphy stated that if you drove through Place au Soleil you would see how they have used landscaping to break up the front lawns and sidewalk entrances to the homes that gives it a bit more character. Mr. Glickstein stated that was a great suggestion and pragmatic solution. Alternate Board Member Power made a motion to defer the application to the October 26, 2023, ARPB meeting. Board Member Canfield seconded the motion with all voting AYE at roll call. 3. An application submitted by Paul Courchene, Courchene Development Corporation, owner of the property located at 2917 Bluewater Cove (Lot 4), Gulf Stream, Florida, legally described as PLACE AU SOLEIL ADDITION NO 2 LT 4. a. Level III Architectural/Site Plan Review to permit construction of a new one-story 4,177 sq. ft. Anglo Caribbean single-family home, including new landscape and hardscape, a two -car garage and swimming pool. Mr. Mitch Kunik, Architect, gave a detailed PowerPoint presentation. Alternate Board Member Power stated that the colors needed to be looked at comprehensively to give variation. Mr. Kunik stated they were trying to be more muted with the color palette but understood that the Board was telling them to be more aggressive to which Chairman Murphy stated that aggressive was a bit harsh and to try creatively inspired. Assistant Town Attorney Nazzaro stated that there was excessive similarity relative to Lot 14 and they had put it far enough away that it may not be an issue. Chairman Murphy agreed that they were far enough from each other and if they took the suggestion of the color palette it should differentiate them enough. Mr. Glickstein asked where this was in the Code to which Mr. Nazzaro stated it was Section 66.144(f) Excessive Similarity. The Board agreed that using different colors and variation on landscaping would help differentiate it. Mr. Glickstein stated that they shouldn't be held to a higher standard than someone coming into the Town of Gulf Stream with a single lot is asked to do. Mr. Nazzaro answered that their team had made a design choice to put all the garage doors on the side instead of some of them being on the front elevation and that they were boxing themselves in with all the lots being the same size and designing to what they wanted to sell, which was all very similar, but not conducive to the Town Code. Alternate Board Member Power made a motion to defer the application to the October 26, 2023, ARPB meeting. Board Member Canfield seconded the motion with all voting AYE at roll call. 4. An application submitted by Paul Courchene, Courchene Development Corporation, owner of the property located at 2914 Bluewater Cove (Lot 13), Gulf Stream, Florida, legally described as PLACE AU SOLEIL ADDITION NO 2 LT 13. a. Level III Architectural/Site Plan Review to permit construction of a new one-story 4,138 sq. ft. Georgian style single family home, including new 0 Minutes of ARPB Regular Meeting & Public Hearing Held 9-28-2023 @ 8:30 A.M. landscape and hardscape, a two -car garage and swimming pool. Mr. Kunik, Architect, gave a detailed PowerPoint presentation, and noted this was the new style they were introducing as a fourth model for Bluewater Cove. Board Member Canfield noted once again that the colors were too similar to all the other homes on the street and added that changing the shutter colors would be the opportunity to make it different. The Board noted that there were no shutters on the side, making it bland. Town Clerk Basel noted once again that the staff had made it very clear during the pre -application meeting that shutters were required. Assistant Town Attorney Nazzaro brought up the percentage of glass vs. wood on the front door and wanted to make sure it was acceptable. The Board agreed it was acceptable. Alternate Board Member Power made a motion to defer the application to the October 26, 2023, ARPB meeting. Board Member Canfield seconded the motion with all voting AYE at roll call. 5. An application submitted by Paul Courchene, Courchene Development Corporation, owner of the property located at 2916 Bluewater Cove (Lot 12), Gulf Stream, Florida, legally described as PLACE AU SOLEIL ADDITION NO 2 LT 12. a. Level III Architectural/Site Plan Review to permit construction of a new one-story 4,229 sq. ft. West Indies style single family home, including new landscape and hardscape, a two -car garage and swimming pool. Mr. Kunik, Architect, gave a detailed PowerPoint presentation. Chairman Murphy stated that the shutters being only on the front door seemed strange to him. Alternate Board Member Power asked about the siding to which Assistant Town Attorney Nazzaro stated the half elevation treatment was prohibited and referred to the letter that was sent to Paul Courchene. Mr. Kunik stated that they had been very intentional on different heights within the two heights that are allowed. He stated that he could take the shutters off the front door and put brackets like were on the front windows. Alternate Board Member Power made a motion to defer the application to the October 26, 2023, ARPB meeting. Board Member Canfield seconded the motion with all voting AYE at roll call. Chairman Murphy recessed the meeting at 9:51 A.M. and called the meeting back to order at 10:00 A.M. 6. An application submitted by Richard Gould, Estate Development Corporation, as agent for Brian Santoro, owner of the property located at 930 Emerald Row, Gulf Stream, Florida, legally described as PLACE AU SOLEIL LT 57. a. Level III Architectural/Site Plan Review to permit construction of a new two-story 3,937 sq. ft. Gulf Stream Bermuda style single family home with a three - car garage and swimming pool. 5 Minutes of ARPB Regular Meeting & Public Hearing Held 9-28-2023 @ 8:30 A.M. b. Special Exception per Section 70-72(b) to exceed the maximum permitted FAR by 98 sq. ft. C. Demolition Permit to demolish the existing structure. d. Land Clearing Permit to clear some of the existing vegetation from the building site. Mr. Jay Colestock, Architect, gave a detailed PowerPoint presentation. He asked about one of the previous homes presented that did not have muntin's on their rear sliding glass doors and wanted to know if that was an option. Staff stated they would investigate it and make sure the architect knew the answer. Chairman Murphy asked about the Bermuda shutter on the second -floor window and stated it wouldn't cover the window. He added that the Gulf Stream Bermuda style had specific guidelines that needed to be followed. Mr. Colestock stated he could narrow the window and put on normal shutters. Chairman Murphy stated that a window on the left side elevation did not have shutters to which Mr. Colestock answered that he couldn't put a shutter there because it would hit the roof. Alternate Board Member Power asked what the special exception was for to which Mr. Colestock stated it was for the small patio in the rear of the house. Board Member Canfield made a motion to recommend approval Level III Architectural/Site Plan based on a finding that the construction of a 5,432 sq. ft. Gulf Stream Bermuda, two-story, single-family dwelling with a three -car garage and swimming pool meets the minimum intent of the Design Manual and applicable review standards with the following conditions: 1. Any minor modifications to the approved landscaping shall be submitted to the Town Manager for review and approval and any major modification shall be brought back to the ARPB for review and approval, prior to commencement of landscaping. 2. The stair tower window will be revised. Alternate Board Member Power seconded the motion with all voting AYE at roll call. Board Member Canfield made a motion to recommend approval of a Special Exception per Section 70-72(b) to exceed the maximum permitted FAR by 98 sq. ft. Level II Architectural/Site Plan Review to permit revision to landscape plan to replace St. Augustine grass with artificial turf on the north side of the yard. Assistant Town Attorney Nazzaro stated that Mr. Streit would like to put in artificial turf on the north side of his backyard and there was landscaping between the water and the placement of the artificial turf and could not be seen from the water. A sample was passed around to the Board. Chairman Murphy wanted to make sure that it was three feet from the property line per the Ordinance. Mr. Streit was not sure but felt confident that it was and stated he would make sure that it was. Alternate Board Member Power made a motion to approve a Level II Architectural/Site Plan to permit the replacement of St. Augustine grass with artificial turf on the north side of the year. Board Member Canfield seconded the motion with all voting AYE at roll call. VII. Items by Staff Chairman Murphy stated that the staff was going to begin making the Board aware of any minor modifications that may come back before the staff so that everyone is on the same page. Assistant Town Attorney Nazzaro stated there had been some minor adjustments come before the staff regarding Lemon Hill that they felt comfortable in approving but wanted to make the Board aware. He added that there was also a split - rail fence on Bluewater Cove that Mr. Glickstein had asked to have removed and the town staff approved the removal. VIII.
