HomeMy Public PortalAbout73-176RESOLUTION NO. 73-176 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON PROVIDING REVENUE SHARING CREDIT FOR COUNTY FIRE DISTRICT TAXES PAID BY CITY PROPERTY OWNERS BY ELIMINATING EXISTING DISTRICT TAXES AND ESTABLISHING A TAX IN PLACE THEREOF WHEREAS, the State and Local Assistance Act of 1972 provides, Federal "Revenue Sharing" funds to cities based on a formula that utilizes the total amount of eligible taxes collected by a local government as one of the primary bases for allocation; and WHEREAS, under said formula, cities whose residents pay taxes to certain special service districts do not receive "revenue sharing" credit for such taxes, and WHEREAS, the State Legislature has adopted Assembly Bill 2008 (adding Government Code Section 43073) which creates a mechanism through which cities can now get revenue sharing credit for the property taxes paid to the Los Angeles County Consolidated Fire Protection District; and the Los Angeles County Dominguez Fire Protection District; and WHEREAS, by availing itself of the benefits authorized by Assembly Bill 2008, the City will substantially increase its revenue sharing receipts and thereby increase the level of municipal services available without the necessity of any additional taxation. NOW, THEREFORE, the City Council of the City of Carson does resolve as follows: Section I. Pursuant to Government Code Section 43073, the City Council of the City of Carson, a city encompassed entirely within the territory of the hereinafter specified districts, hereby elects to pay to the Los Angeles County Consolidated Fire Pro- tection District and the Los Angeles County Dominguez Fire Protection District, an amount of money equal to the amount each such District would derive from the imposition of its tax on all property within the district which is contained within the incorporated limits of the city. Such payment shall be in lieu of the imposition of the Districts' taxes within the boundaries of the city. Section 2. Pursuant to Government Code, Section 43073, the City Council of the City o Carson, in order to generate the funds necessary to make the payments referred to in Section I of this Resolution, hereby establishes a city tax rate for fiscal year 1973-74 in an amount, equaI to the amount of the rate set by the Board of Supervisors of the County of Los Angeles for the Los Angeles County Consolidated Fire Protection District for the 1973-74 fiscal year, for that portion of the City within the aforesaid district and a tax rate equal to the amount of the rate set by the Board of Supervisors of the County of Los Angeles for the Los Angeles County Dominguez Fire Protection District for the 1973-74 fiscal year, for that portion of the City within the aforesaid district. The revenue from such tax shall be utilized solely for the payments described in Section 1 hereof. Section 3. The City Council of the City of Carson hereby requests that the County tax co e� ctor sfiall list the aforesaid Consolidated Fire Protection District and the Dominguez Fire Protection District on the property tax bill or on an accompanying statement, clearly indicating that the city has elected to include the cost of the special district servicer in a city tax rate rather than have the Districts impose the tax. This Resolution shall serve as direction and authorization to the County Auditor to transfer the monies collected pursuant to Section 2 of this Resolution to the appropriate District as set forth in Section I hereof. BE IT FURTHER RESOLVED that the adoption of this Resolution in no way imposes or implies the levy of a city property tax for general municipal purposes, and is in fact a step which is consistent with long-standing City Council policy of seeking to maximize the services provided by the city without the imposition of a city property tax as a method of paying for such services.
