A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARSON ACCEPTING THE WORK PERFORMED BYCALIFCRNIA
LANDSCAPE, INC.,CASH CONTRACT NO. 69, LANDSCAPE
BEAUTIFICATION
WHEREAS, the City Council did on the 20th day of Febru3 ry, 1973, adopt
Resolution No. 73-036, awarding the contract for the landscaping of the median divider
located on Del Amo Boulevard between Tillman and Wilmington Avenue in the City of
Carson (Cash Contract No. 69) to California Landscape, Inc; and
WHEREAS, said work has been duly performed and completed by said
contractor; and
WHEREAS, said work has been inspected by the Fbrks and Recreation Director
and by him approved as constructed and completed in its entirety, in accordance with the
plans and specifications for such improvement project and authorized revisions therein; and
WHEREAS, said Director does now recommend and request the acceptance
of the work and the filing of a Notice of Completion thereof; and
WHEREAS, the final contract price for said work is the sum of $66,250.00,
which said sum the Director has approved as just and'fcrir; and
WHEREAS, the contract documents provide that a total of 10% ($6,625.00)
of said total contract price shall be retained until thirty-five (35) days after the recording
of the Notice of Completion of said improvement project.
NOW, THEREFORE, BE IT RESOLVED, that the City of Carson does hereby
accept the work performed by said contractor and approve the same as being completed in
accordance with the plans and specifications for said project and authorized revisions therein;
and the City Administrator is hereby authorized to file Notice of Completion of said project
in the Office of the Los Angeles County Recorder; and
BE IT FURTHER RESOLVED that the City is authorized and directed to pay
to said contractor, California Landscape, Inc.:, the sum of $66,250.00 in full payment of
said work performed by said contractor, less any sums held until the expiration of thirty-five
(35) days following the filing of said Notice of Completion, and then paid contingent upon
the absence of the filing of any stop notice against said project within thirty (30) days after
the filing of the Notice of Completion; and
BE IT FURTHER RESOLVED that upon expiration of said thirty-five (35) days
following the filing of said Notice of Completion, without any -:claim being ruledagainst
said project, that all bonds filed by the contractor in said project shall be exonerated and
discharged, excepting that the faithful performance bond shall remain in force until the
expiration of one year from the date of filing said Notice unless a substitute bond approved
by the Director of Parks and Recreation and the City Attorney shall have been filed.

I, Morris B. Vance, 40ty Clerk of the City of Carson, California, do hereby
certify that the whole number of members of the City Council of said City is five; that the
foregoing resolution, being Resolution No. 74-005, was duly and regularly adopted by the
City Council of said City at a regular meeting of said Council, duly and regularly held on
the 7th day of January, 1974, and that the same was so passed and adopted by the following
vote:
AYES: COUNCILMEN: Bridgers, Calas, Marbut, Smith & Yamamoto.
NOES: COUNCILMEN: None.
ABSENT: COUNCILMEN: None.
