I WAS DISPATCHED TO THE LOCATION IDENTIFIED AS 3501 NORTH OCEAN BOULEVARD IN REFERENCE TO DAMAGE SUSTAINED TO THE VICTIMS LANDSCAPE AND LIGHTING. THE COMPLAINTNICTIM IDENTIFIED HIMSELF AS MR KEVIN FERRO. THE INITIAL COMPLAINT WAS THAT A LANDSCAPING COMPANY PERFORMING SERVICES TO THE ADJACENT CONSTRUCTION SITE HAD CAUSED THE DAMAGE. THE CONSTRUCTION SITE IS IDENTIFIED AS 3545 NORTH OCEAN BLVD. THE PRIMARY CONTRACTOR IS IDENTIFIED AS MOUW ASSOCIATES. PROJECT MANAGER IS IDENTIFIED AS MR. ROSS BEST. THE COMPLAINANT ALLEGES THE DAMAGE WAS CAUSED BY THE LANDSCAPING COMPANY AS THEY WERE REMOVING A LARGE TREE ADJACENT BOTH PROPERTIES. THE VICTIM CONFIRMS THAT HE HAD GIVEN THE COMPANY PERMISSION TO GAIN ACCESS TO HIS PROPERTY. UPON MY ARRIVAL AND SUBSEQUENT INVESTIGATION, I OBSERVED LANDSCAPING DEBRIS THAT WAS LEFT BEHIND IN THE COURSE OF MOVING OR REMOVING THE TREE FROM THE CONSTRUCTION PROJECT. THE LANDSCAPING CREW WHO INITIALLY CONDUCTED THE REMOVAL OF THE TREE DID NOT TAKE INTO CONSIDERATION IN CLEANING THE FALLEN DEBRIS. AT THE TIME OF MY INITIAL INVESTIGATION ONLY THE VICTIM WAS PRESENT. MR BEST AND THE LANDSCAPING COMPANY COULD NOT BE LOCATED AT THE PROJECT SITE. AS PER THE TOWN OF GULF STREAM ORDINANCE RULES AND REGULATIONS AND CONSTRUCTION HANDBOOK AGREEMENT, THIS TYPE OF PRACTICE VIOLATES THE ORDINANCE AND THE HANDBOOK AGREEMENT. I MADE SEVERAL ATTEMPTS WITH CONTACTING THE REPRESENTATIVE MR. ROSS BEST BY TELEPHONE AND TEXT MESSAGES. AS OF 1600 HOURS I HAVE NOT RECEIVED A RESPONSE. I MADE TELEPHONE CONTACT WITH THE MAIN OFFICE OF MOUW ASSOCIATES. ON OCTOBER 19, 2023, AT APPROXIMATELY 1620 HRS. I MADE TELEPHONE CONTACT WITH MR. ROSS BEST FROM MOUW ASSOCIATES. MR. BEST INDICATED THAT DURING THE INCIDENT MR. KEVIN FERRO WAS EXTREMELY UPSET AND DID NOT WANT THE LANDSCAPING CREW TO COME BACK ONTO HIS PROPERTY, AND THEREFORE, THAT IS WHY THE AREA REMAINS THE WAY IT IS. MR. BEST STATED THAT HE HAS BEEN IN TOUCH WITH THE VICTIM'S PROPERTY MANAGER, MR. TONY AIGILI. BOTH PARTIES HAVE AGREED TO MAKE REPAIRS AS NECESSARY AT THE EXPENSE OF MOUW ASSOCIATES. ON OCTOBER 19, 2023, AT APPROXIMATELY 1624 HRS. I MADE TELEPHONE CONTACT WITH MR. TONY AIGILI. HE CONFIRMED THE AGREEMENT WITH MR. ROSS BEST. MR.
