HomeMy Public PortalAboutMIN-CC-2009-03-24MOAB CITY COUNCIL REGULAR MEETING March 24, 2009 The Moab City Council held its Regular Meeting on the above date in the Council Chambers of Moab City Offices, located at 217 East Center Street, Moab, Utah. A Pre -Council Workshop was not held due to a lack of quorum. Mayor Sakrison called the Regular City Council Meeting to order at 7:06 PM and Citizen B.D. Howard led in the Pledge of Allegiance. Also in attendance were Councilmembers Gregg Stucki, Kyle Bailey, Rob Sweeten and Sarah Bauman; City Manager Donna Metzler, City Recorder/Assistant City Manager Rachel Ellison, Planning Director Jeff Reinhart, City Treasurer Jennie Ross, Community Development Director David Olsen, City Engineer Dan Stenta and Deputy Recorder I Dan Tally. Seven (7) members of the audience and media were present. There were no minutes to approve. There were no Citizens to be Heard. Under Community Development Department Update, Community Development Director Olsen stated that he was planning a grand opening of Dixie Park on Arbor Day, April 24, 2009. Community Development Director Olsen continued that there were funds available in the amount of $100,000 to use towards bridges on 500 West as well as 300 West. Community Development Director Olsen also stated that the Trail Mix Committee was working to extend the Millcreek Pathway towards Lion's Back and that some City support might be needed. Under Engineering Department Update, City Engineer Stenta stated that there would be complete construction plans for the 500 West project later in the week. City Engineer Stenta also stated that the intersection at 500 West and 400 North was being proposed as a two or four way stop. City Engineer Stenta continued that the Riversands Waterline project would be out to bid in the next two weeks and that he had attended a webinar regarding the federal stimulus programs. City Engineer Stenta stated that he would work on scheduling the public involvement phase of the 500 West project. City Engineer Stenta finished that he had received the Lion's Back Watershed Protection Plan and was in the process of reviewing it. Under Planning Department Update, Planning Director Reinhart reviewed the upcoming Planning Commission agenda. A Police Department Update was not given. A Public Works Department Update was not given. Mayor Sakrison proclaimed April 24, 2009 as Arbor Day in the City of Moab. Mayor Sakrison proclaimed March 24, 2009 as Grand County High School Debate Team Day in the City of Moab. Mayor Sakrison proclaimed April 2009 as Child Abuse Prevention Month in the City of Moab. A presentation was made by Mike Dean, Head Ranger of the Moab Office of the United States Forest Service Regarding the Brumley Grazing Allotment Revision. HIGH SCHOOL DEBATE TEAM DAY PROCLAMATION OF CHILD ABUSE PREVENTION MONTH PRESENTATION BY U.S. FOREST SERVICE March 24, 2009 Page 1 of 3 Councilmember Bailey moved to approve Proposed Ordinance #2009-04 — An Ordinance Annexing Property to the City of Moab with the following conditions: 1) The annexed property be zoned R-4; 2) The additional access parcel adjacent to and extending north of the Apple Lane right-of-way, and adjacent property along 400 North be included as recommended by the Moab City Planning Commission; 3) The surrounding adjacent zoning be applied to these areas. Councilmember Stucki seconded the motion. The motion carried 4-0 aye. Councilmember Stucki moved to award the Golf Course Water Line Project to C&B Earthworks in the amount of $39,211. Councilmember Sweeten seconded the motion. The motion carried 4-0 aye by a roll -call -vote. Councilmember Sweeten moved to approve the Golf Course Water Line Project Contract with the condition of removing the performance and payment bond requirements from the contract. Councilmember Bauman seconded the motion. The motion carried 4-0 aye. Councilmember Stucki moved to approve a Real Property Purchase Agreement Between the City of Moab and John R. Fogg. Councilmember Bauman seconded the motion. The motion carried 4-0 by a roll -call -vote. Councilmember Sweeten moved to approve a Moved -on Structure Permit for Creative Solutions Group, d.b.a. Creative Solutions Group to Conduct Exhibits and Displays for Moab Jeep Safari, Located at 290 South Main Street from April 6, to April 10, 2009. Councilmember Stucki seconded the motion. The motion carried 4-0 aye. Councilmember Bailey moved to approve a Request by the Youth Garden Project for Use of Swanny City Park Every Saturday, May 9 to October 24, 2009 to Conduct a Farmers' Market. Councilmember Bauman seconded the motion. The motion carried 4-0 aye. Councilmember Sweeten moved to approve a Special Business Event License Application for the Youth Garden Project to Conduct a Farmers' Market Every Saturday May 9 to October 24, 2009. Councilmember Bauman seconded the motion. The motion carried 4-0 aye. Councilmember Bailey moved to approve a Request by Jim Mattingly for Use of Swanny City Park April 24 to April 25, 2009 to Conduct the April Action Car Show. Councilmember Sweeten seconded the motion. The motion carried 4-0 aye. Councilmember Sweeten moved to approve Proposed Ordinance #2009-03 — An Ordinance Amending the City of Moab Municipal Code, Chapter 15.40, Flood Damage Reduction, With the Replacement of Said Chapter With New Language As Required By the Federal Emergency Management Administration. Councilmember Bauman seconded the motion. The motion carried 4-0 aye. City Engineer Stenta made a presentation regarding the Brumley Grazing Allotment Revision. Discussion followed. Under Reading of Correspondence, Councilmembers Bauman and PROPOSED ORDINANCE #2009-04, APPROVED GOLF COURSE WATER LINE PROJECT AWARDED GOLF COURSE WATER LINE PROJECT CONTRACT APPROVED REAL PROPERTY PURCHASE AGREEMENT WITH JOHN R. FOGG, APPROVED MOVED -ON STRUCTURE PERMIT FOR CREATIVE SOLUTIONS, APPROVED YOUTH GARDEN PROJECT USE OF SWANNY CITY PARK, APPROVED SPECIAL BUSINESS EVENT LICENSE FOR YOUTH GARDEN PROJECT, APPROVED JIM MATTINGLY USE OF SWANNY CITY PARK, APPROVED PROPOSED ORDINANCE #2009-03, APPROVED PRESENTATION REGARDING BRUMLEY GRAZING ALLOTMENT REVISION READING OF March 24, 2009 Page 2 of 3 Sweeten stated that they had been contacted by Loren Johnson regarding the dam maintenance issue. Under Administrative Report, City Manager Metzler reviewed the proposed budget schedule for the next month. City Manager Metzler stated that staff was seeking creative means to balance the proposed budget. City Manager Metzler stated that the selection committee had been working on the selection process of the firm for the Aquatic Center Architectural Services Contract. City Manager Metzler stated that three architects had been selected from the original seventeen and that the selection committee would be participating in an aquatic center site visit that next Friday. City Manager Metzler stated that the Housing Committee was proceeding with their Affordable Housing Plan drafting process. Under Report on City/County Cooperation, Mayor Sakrison stated that he had spoken to Grand County Council Chair Bob Greenberg and told him to choose a date for the next Joint Meeting. Under Mayor and Council Reports, Councilmember Bailey stated that he had attended a meeting in Moab with the Hospital, community and the Housing and Urban Development office in Moab. Councilmember Bailey stated that a proposal should be submitted by April 15, 2009. Councilmember Bailey moved to pay the bills against the City of Moab in the amount of $74,335.58. Councilmember Sweeten seconded the motion. The motion carried 4-0 aye by a roll -call -vote. Mayor Sakrison adjourned the meeting at 8:24 PM. APPROVED: ATTEST: David L.
