HomeMy Public PortalAbout2006-01 Calling an Election concerning the Term of Office of Council MembersRESOLUTION NO. 2006-1 A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, CALLING AN ELECTION TO PRESENT TO THE ELECTORS OF THE VILLAGE, THE PROPOSED CHARTER AMENDMENTS CONCERNING THE TERM OF OFFICE OF COUNCIL MEMBERS AND THE ELIMINATION OF PRIMARY ELECTIONS FOR COUNCIL MEMBERS, AS AUTHORIZED BY CHARTER AMENDMENT ENABLING ORDINANCES NO. 2005-04 AND NO. 2005-11 OF THE VILLAGE; PROVIDING FOR SPECIAL ELECTION ON THE CHARTER ikMENDMENTS TO BE HELD ON TUESDAY, THE 11TH DAY OF APRIL, 2006, BY MAIL BALLOT PROCEDURE; PROVIDING FOR EFFECTIVE DATE. WHEREAS, pursuant to Ordinance No. 2005-04 and Ordinance No. 2005-11, the Village Council has authorized two (2) proposed Charter Amendments to be submitted to the electors of the Village; and WHEREAS, pursuant to Section 4(a) and 8 of each of the above -described Ordinances, the Village Council hereby determines to hold the Village Charter Amendment election as a special election on Tuesday, the I lth day of April, 2006, by mail ballot procedure as provided by law. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: Section 1. Recitals Adopted. That each of the above stated recitals are hereby adopted and confirmed. Section 2. Election Called. That a special election is hereby called for Tuesday, the 11th day of April, 2006, to present to the electors of the Village of Key Biscayne (the "Village") each of the Charter Amendment ballot measures provided in Ordinance No. 2005-04 and Ordinance No. 2005-11. The Notices of Election for each Charter Amendment shall be combined into one form of Notice of Election and shall be conformed to the mail ballot procedure by the Village Clerk and Village Attorney. Section 3. Voting Procedure. That mail ballots, as prescribed by Sections 101.6101- 101.6107, Florida Statutes, shall be used in this special election. Section 4. Implementation. That the Village Clerk is hereby authorized to take any action which is necessary to implement this Resolution and the Charter Amendment enabling Ordinances referenced above, and to utilize all necessary election administration services which are provided by the Miami -Dade County Supervisor of Elections. Further, the Miami -Dade County Supervisor of Elections is accordingly authorized and requested to take any action which is necessary to implement the purposes of this Resolution and of the Charter Amendment enabling Ordinances referenced above in carrying out the election. WHEREAS, Section 6.02(a)(i) of the Charter of the Village of Key Biscayne provides that the Council may, by Ordinance, propose amendments to the Charter, subject to approval by the electorate at the next general election or at a special election called for such purpose; and WHEREAS, the Council has determined to submit proposed Charter amendments for approval or disapproval by the electors, as provided in this Ordinance, NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:' Section 1. Recitals Adopted. That each of the above stated recitals is hereby adopted and confirmed. Section 2. Charter Amended. That Section 2.03 "Election and Term of Office" and Section 5.01 "Elections" of the Village Charter, are amended by revising those Sections to read, as follows: Section 2.03. Election and Term of Office. Each Council Member and the Mayor shall be elected at -large for a two (2) year term by the electors of the Village in the manner provided in Article V of this Charter. However, beginning with the 2006 elections, a transition shall commence in the le of the t of off rovi for o it Membe be electe -lar e f r a four ear to he ele rs of th ilia e i t e manner r vided in Article V of this Charter. In order to create and maintain, staggered terms which provides continuity in the legislative branch of government there shall be a transition made from two (2) year t,erms to four (4) year terms. This transition om a two (2) year term to a four (4) year term of office shall be accomplished by providing that the three (3) Council Members receiving the most votes at the 2006 election shall receive four (4) year terms of office and the remaining three (3) Council Members who are elected at the 2006 election shall receive two (2) year terms of office. The Mayor shall continue to be elected for a two (2) year term. (b) No person shall serve as Mayor for more than two (2) consecutive elected terms, and no person may serve on the Council, or as any combination of Mayor and Council Member, for more than eight (8) consecutive years. Section 5.01. Elections. (a) Electors. Any person who is a resident of the Village, has qualified as an elector of the State and registers to vote in the manner prescribed by law shall be an elector of the Village. All elections for the offices of Councilmember and Mayor shall be conducted on a nonpartisan basis. Election date. A primary election shall be held in each even -numbered year on the first Tuesday following the first Monday of October. A regular election shall be held in November of each even -numbered year, on the same day U.S. congressional elections are held, or if none are held in any year, on the first Tuesday following the first Monday of November of that year. Notwithstanding any contrary provisions of this section, the Village Council may, by ordinance enacted pursuant to Section 1003605(2), Florida Statutes, or independent of such statutory basis by virtue of the enabling authority provided in this subsection (c), from time to time, change the dates for conducting primary, regular and special elections for the election of the Mayor and/or Village Council and provide for the orderly transition of office resulting from such date changes. (d) Primary elections. l , 2006 Primary election. T i ara h 1, shall l on v to the 2006 primary election. There shall be no primary election for Mayor if no more than two candidates qualify to run for the office of Mayor. There shall be no primary election for Council if no more than twelve candidates qualify to run for the six Council positions. In the event that a primary election is not necessary, as described above, the qualified candidates' names shall be placed on the regular election ballot, unless otherwise specified by paragraph (h) below. The ballot for the primary election shall contain the names of all qualified candidates for Mayor and for each of the six (6) Council positions, and shall instruct electors to cast one (1) vote lbr Mayor and no more than six (6) votes for Council, with a maximum of one (1) vote per candidate. 2008 and subsequent primaries. This paragraph 2, shall apply only to primary elections held in 2008 and thereafter, There shall be no piimary election for Mayor if np more than two candidates qualify to run fir the office of Mayor. There shall be no primary election for Council if no more than six candidates qualify to run for the three (3) Council positions. In the event that a primary election is not necessary, as described above, the qualified candidates' names shall be placed on the regular election ballot, unless otherwise specified by paragraph (h) below. The ballot for the primary election shall contain the names of all qualified candidates for Mayor and for each of the three (3) Council positions, and shall instruct electors to cast one (1) vote for Mayor and no more than three (3) votes.. for Council, with a maximum of one (1) vote per candidate. (e) Regular Elections. 2006 regular election. This paragraph 1. shall apply only to the 2006 regular election. The ballot for the regular election shall contain the names of the two candidates for Mayor who received the most votes in the primary election. The ballot for the regular election shall also contain the names of the twelve candidates for Council who received the most votes in the primary election. The ballot shall instruct electors to cast one vote for Mayor and to cast a number of votes for the Council not greater than the number of the six (6) contested Council positions, with a maximum of one vote per candidate. The candidate for Mayor receiving the most votes shall be the duly elected Mayor. The six (6) candidates for Council receiving the most votes shall be duly elected to the six (6) positions on the Council. 2. 2008 and subsequent regular elections. This paragraph 2. shall apply o to re lar lections hel in 2008 and t reafter. The ballot for the regular election shall also contain the names of the six (6) candidates for Council who received the most votes in the primary election. The ballot shall instruct electors to cast one vote for Mayor and to cast a number of votes for the Council not greater than the number of the three (3) contested Council positions. with a maximum of one vote per candidate. The candidate for Mayor receiving the most votes shall be the duly elected Mayor. The three (3) candidates for Council receiving the most votes shall be duly elected to the three (3) positions on the Council, ( Special elections. Special elections, when required, shall be scheduled by the Council at such times and in such manner as shall be consistent with this Charter. (g) Tie Votes. If the primary election results in two or more candidates receiving a tie vote such that the number of candidates to be placed on the ballot for the regular election would exceed the limitations in subsection (e), all candidates receiving a tie vote shall be listed on the ballot for the general election and the limitations in subsection (e) shall not apply. If a tie vote occurs in the regular election between two or more candidates for either the office of Mayor or Councilmember, the tie vote shall be decided by lot under the direction of the Village Clerk. (h) Single candidates. In the event that the number of persons who qualify as candidates for the Council Member positions to be filled at an election is equal to or less than the number of positions to be filled at such election, those positions shall not be listed on the primary or regular election ballot. No election for Mayor shall be required in any election if there is only one duly qualified candidate for Mayor. The duly qualified candidates shall be deemed elected. (1) Absentee votes. Absentee voting will be permitted as provided by the laws of the State and under such conditions as may be prescribed by ordinance from time to time; provided, however, that no ordinance shall limit the right to vote by absentee ballot available under State law. Commencement of terms. The term of office of any elected official will commence seven (7) days following the day of the regular election or special election at which sThe is elected. Section 3. Form of aiiot. The form of ballot for the Charter amendment provided for in Section 2 of this Ordinance shall be, as follows: "Term of Office of Council Meml.ers. The Village Charter provides for Council Members to be elected for terms of two years. A Charter amendment is proposed which provides for Council Members to be elected for terms of four years, with the transition of term length being made at the 2006 and 2008 elections, so that the expiration of Council terms is staggered. The Mayor shall continue being elected for terms of two years. Shall the above -described Charter amendment be adopted? YES[ I NO 7f Section 4. Election Called. 13allot; Notice, etc. a. The Village Council shall by Resolution timely call an election to present to the electors of the Village the Charter amendment ballot question provided in Section 3 above. h. The balloting shall be conducted between the hours of 7:00 a.m. and 7:00 p.m. at the regular polling places for Village elections or as otherwise provided by law. All qualified electors residing within the Village who are timely registered shall be entitled to vote. c. Notice of said election shall be published in accordance with Section 100.342, Florida Statutes, in a newspaper of general circulation within the Village at least thirty (30) days prior to said election, the first publication to be in the fifth week prior to the election, and the second publication to be in the third week prior to the election, and shall be in substantially the folio form. Notices of Election for any other Charter amendments may be combined with this Notice of Election by the Village Clerk. d. The registration books shall remain open at the Office of the Miami -Dade County Supervisor of Elections until the date at which the registration books shall close in accordance with the provisions of the general election laws. The Village Clerk, with necessary assistance from the Miami -Dade County Supervisor of Elections, is hereby authorized to take all appropriate actions necessary to carry into effect and accomplish the electoral provisions of this Ordinance. The Village Clerk is authorized to arrange for early voting as authorized by law, f. This election shall be canvassed by the Village Clerk in accordance with the provisions of Section 2-102 of the Village Code and any applicable provisions of the general election laws or by the County Canvassing Board at the request of the Village Clerk. Copies of this Ordinance are available for public inspection during regular business hours at the Office of the Village Clerk. Section 5, Effectiveness of Charter Amendment The Village Charter Amendment described in Section 2 above, shall only be effective if a majority of the qualified electors of the Village voting at the Charter amendment election held for such purpose, pursuant to Sections 3 and 4 hereof, vote for its adoption, and shall be considered adopted and effective upon certification of the election results as provided herein. Section (. SeverabV ty. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, 7 clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 7. Inclusion in the Charter. It is the intention of the Village Council, and it is hereby ordained that the provisions of Section 2 of this Ordinance shall become and be made a part of the Charter of the Village of Key Biscayne, Florida, as to any Charter amendment measure approved by a majority of voters voting on such measure in such election; that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; that the word "Ordinance" shall be changed to "Section" or other appropriate word. Section 8. Effective date. Following adoption of this Ordinance on second reading, this Ordinance shall be effective immediately upon the adoption of a Resolution which sets the date of the Charter amendment election. Any Charter amendment measure provided herein shall be effective only upon approval of a majority of electors voting on the measure, effective upon certification of the election results, and shall be applicable to elections conducted commencing in 2006 as provided herein. That Section 5.01 "Elections" of the Village Charter, is amended by revising that Section to read, as follows: Section 5.01. Elections. (a) Electors. Any person who is a resident of the Village, has qualified as an elector of the State and registers to vote in the manner prescribed by law shall be an elector of the Village. (b) Nonpartisan elections. All elections for the offices of Councilmember and Mayor shall be conducted on a nonpartisan basis. (c) Election date. A primary election for the office of Mayor shall be held in each even -numbered year on the first Tuesday following the first Monday of October. A regular election for Mayor and Council positions shall be held in November of each even -numbered year, on the same day U.S. congressional elections are held, or if none are held in any year, on the first Tuesday following the first Monday of November of that year. Notwithstanding any contrary provisions of this section, the Village Council may, by ordinance enacted pursuant to Section 100.3605(2), Florida Statutes, or independent of such statutory basis by virtue of the enabling authority provided in this subsection (c), from time to time, change the dates for conducting mayoral primary and all regular and special elections for the election of the Mayor and/or Village Council and provide for the orderly transition of office resulting from such date changes. (d) Primary elections. There shall be no primary election for Mayor if no more than two (2) candidates qualify to run for the office of Mayor. . In the event that a primary election is not necessary, as described above, the qualified candidates' names for the office of Mayor shall be placed on the regular election ballot, unless otherwise specified by paragraph (h) below. The ballot for the primary election shall contain the names of all qualified candidates for Mayor and-ibr and shall instruct electors to cast one (1) vote for Mayor;. 2 (e) (0 (g) (h) ( Regular Election. The ballot for the regular election shall contain the names of the two (2) candidates f©r May©r who received the most votes in the primary election. The ballot for the regular election shall also contain the names of the qualified twlve (12) candidates for Council. The ballot shall instruct electors to cast one (1) vote for Mayor and to cast a number of votes for the Council not greater than the number of the six (6) contested Council positions, with a maximum of one vote per candidate. The candidate for Mayor receiving the most votes shall be the duly elected Mayor. The six-- candidates for Council receiving the most votes shall be duly elected to the six -(6) positions on the Council which are up for election. Special elections. Special elections, when required, shall be scheduled by the Council at such times and in such manner as shall be consistent with this Charter. Tie Votes. If the mayoral primary election results in two or more candidates receiving a tie vote such that the number of candidates to be placed on the mayoral ballot for the regular election would exceed the limitations in subsection (e), all candidates receiving a tie vote shall be listed on the mayoral ballot for the general election and the limitations in subsection (e) shall not apply. If a tie vote occurs in the regular election between two (2) or more candidates for either the office of Mayor or Councilmember, the tie vote shall be decided by lot under the direction of the Village Clerk. Single candidates. In the event that the number of persons who qualify as candidates for the Council Member positions to be filled at an election is equal to or less than the number of positions to be filled at such election, those positions shall not be listed on the primary ox regular election ballot. No election for Mayor shall be required in any election if there is only one duly qualified candidate for Mayor, The duly qualified candidates shall be deemed elected. Absentee votes. Absentee voting will be permitted as provided by the laws of the State and under such conditions as may be prescribed by ordinance from time to time; provided, however, that no ordinance shall limit the right to vote by absentee ballot available under State law. 0) Commencement of terms. The term of office of any elected official will commence seven (7) days following the day of the regular election or special election at which s/he is elected. Section 3. Form of Ballot. The form of ballot for the Charter amendment provided for in Section 2 of this Ordinance shall be, as follows: "Elimination of Primary Elections for Councilmembers. The Village Charter provides for the Mayor and Councilmembers to be elected by an election system which includes primary and regular elections. A Charter amendment is proposed which provides for Councilmembers to be elected at a single regular election at which the candidates receiving the most votes for the available Council positions are elected. Primary elections are to be retained for the office of Mayor. Shall the above -described Charter amendment be adopted? YES [ NO [ I `1 " Section 4. Election Called; Ballot; Notice, etc. a. The Village Council shall by Resolution timely call an election to present to the electors of the Village the Charter amendment ballot question provided in Section 3 above. b. The balloting shall be conducted between the hours of 7:00 a.m. and 7:00 p.m. at the regular polling places for Village elections or as otherwise provided by law. All qualified electors residing within the Village who are timely registered shall be entitled to vote. c. Notice of said election shall be published in accordance with Section 140.342, Florida Statutes, in a newspaper of general circulation within the Village at least thirty (30) days prior to said election, the first publication to be in the fifth week prior to the election, and the second publication to be in the third week prior to the election, and shall be in substantially the following 4 form: "NOTICE OF ELECTION. PUBLIC NOTICE IS HEREBY GIVEN THAT PURSUANT TO AN ENABLING ORDINANCE AND RESOLUTION DULY ADOPTED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, (THE "VILLAGE"), AN ELECTION HAS BEEN CALLED AND ORDERED TO BE HELD WITHIN THE VILLAGE ON , THE DAYOF 200 BETWEEN THE HOURS OF 7:00 A.M. The Village Clerk, with necessary assistance from the Miami -Dade County Supervisor of Elections, is hereby authorized to take all appropriate actions necessary to carry into effect and accomplish the electoral provisions of this Ordinance, The Village Clerk is authorized to arrange for early voting as authorized by law. f. This election shall be canvassed by the Village Clerk in accordance with the provisions of Section 2-102 of the Village Code and any applicable provisions of the general election laws or by the County Canvassing Board at the request of the Village Clerk. g. Copies of this Ordinance are available for public inspection during regular business hours at the Office of the Village Clerk. Section 5. Effectiveness of Charter Amendment. The Village Charter Amendment described in Section 2 above, shall only be effective if a majority of the qualified electors of the Village voting at the Charter amendment election held for such purpose, pursuant to Sections 3 and 4 hereof, vote for its adoption, and shall be considered adopted and effective upon certification of the election results as provided herein. If conflicting Charter amendments are adopted at the same election, the one receiving the greatest number of affirmative votes shall prevail to the extent of such conflict. Further, in the event of such conflict, the Village Attorney is authorized to revise the Charter to the extent necessary to assure that any amendments adopted conform to one another and are properly included in the publication of the revised Charter. 6 Section 6. Severibiiity. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 7. Inclusion in the Charter. It is the intention of the Village Council, and it is hereby ordained that the provisions of Section 2 of this Ordinance shall become and be made a part of the Charter of the Village of Key Biscayne, Florida, as to any Charter amendment measure approved by a majority of voters voting on such measure in such election; that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; that the word "Ordinance" shall be changed to "Section" or other appropriate word. Section 8. Effective date. Following adoption of this Ordinance on second reading, this Ordinance shall be effective immediately upon the adoption of a Resolution which sets the date of the Charter amendment election. Any Charter amendment measure provided herein shall be effective only upon approval of a majority of electors voting on the measure, effective upon certification of the election results, and shall be applicable to elections conducted commencing in 2006. Esta transicion de plazos de dos (2) anos a plazos de cuatro (4) anos para los cargos se lograra mediante la disposicion de quo los tres (3) Miembros del Consejo que reciban el mayor numero de votos en la eleccidn del 2006 recibiran cargos con plazos de cuatro (4) anos y que los tres (3) restantes Miembros del Consejo que sean elegidos en la eleccion del 2006 recibiran cargos con plazas de dos (2) arias. Nadie prestara servicios en calidad de Alcalde por mas de dos (2) plazos electivos consecutivos, y nadie prestara servicios en el Consejo, ni en combinacion en calidad de Alcalde y Miembro del Consejo, por mas de ocho (8) anos consecutivos. Seccicn 5,01. Elecciones. (a) Los electores. Se considera elector del Municiplo a toda persona que sea residente del Municipio, este cualificada como elector del Estado y se inscriba para votar del modo prescrito por la ley. (b) Las elecciones no partidistas. Todas las elecciones para los cargos del Consejo y para el del Alcalde se celebraran de manera no partidista. (c) La focha de la eleccion. Una eleccion primaria se celebrara en todo arm par el primer martes despues del primer lanes del mes de octubre. Se celebrara una eleccion ordinaria en el mes de noviembre de todo ano par, el mismo dia en que se celebren las elecciones congresuales de los Estados Unidos y, si no se celebrara ninguna en algun ano, el primer martes despues del primer lunes del mes de noviembre de dicho ano. A pesar de las disposiciones contrarias de esta seccion que pueda haber, el Consejo Municipal, por ordenanza, con arreglo a la Seccion 100.3605(2) de los Estatutos de la Florida o independientemente de la susodicha base, estatutaria en virtud de la autoridad autorizante dispuesta en este incise (c), ocasionalmente, puede autorizar cambios en las fechas para la celebracion de elecciones primarias, elecciones ordinarias y elecciones extraordinarias para elegir al Alcalde ybo al Consejo Municipal y disponer la transicion ordenada de los cargos resultantes de dichos cambios de fechas. En case de que no sea necesaria una eleccion primaria, conforme a lo descrito anteriormente, el nombre de los candidatos cualificados se colocara en la boleta de la eleccion ordinaria, a no ser que se especifique de manera diferente en el parrafo (h) a continuacion. La boleta de la eleccian primaria contendra los nombres de todos los candidatos cualificados para Alcalde y para cada uno de los seis (6) escanos del Consejo, e instruira a los electores que emitan un (1) voto para el Alcalde, y no mss de seis (6) votos para el Consejo, con un maximo de un (1) voto por candidate. 2. Las primarias del 2008 y las posteriores. Este parrafo 2 se aplicara unicamente a las elecciones primarias que se celebren en el 2008 y en anos posteriores. No habra ninguna eleccign primaria para Alcalde si no mss de dos candidatos cualifican para postularse para el cargo de Alcalde. No habra eleccian primaria para el Consejo si no mss de seis candidatos cualifican para los tres (3) escanos del Consejo. En el caso de que no fuera necesaria una eleccian primaria, conforme a lo descrito anteriormente, el nombre de los candidatos cualificados se colocara en la boleta de la eleccian ordinaria a no ser que el parrafo (h) a continuacian indique to contrario. La boleta para la eleccian ordinaria tambien contendra el nombre de los dace candidatos para el Consejo que hayan recibido el mayor numero de votos en la eleccian primaria. La boleta instruira a los electores para que emitan un voto par el Alcalde y un numero de votos por el Consejo que no sea mayor que el numero de los seis (6) escanos en contienda del Consejo, con un maxima de un voto por candidate. El candidate para Alcalde que reciba el mayor numero de votos sera elegido Alcalde debidamente. Los seis (6) candidatos para el Consejo que reciban el mayor numero de votos seran elegidos debidamente para los seis escanos del Consejo. La elecciones ordinarias del 2008 y las posteriores. Este parrafo 2 se aplicara unicamente a las elecciones ordinarias del 2008 y a las posteriores. La boleta para la eleccian prdinaria contendra el nombre de los dos candidatos para Alcalde que hayan recibido el mayor numero de votos en la eleccidn primaria. La boleta para la eleccidn ordinaria tambien contendra el nombre de los seis (6) candidatos para el Consejo que hayan recibido el mayor nCimero de votos en la eleccidn primaria. La boleta instruira a los electores para que emitan un voto por el Alcalde y un numero de votos por el Consejo que no sea mayor que el numero de los tres (3) escanos en contienda del Consejo, con un maximo de un voto par candidato. El candidato para Alcalde que reciba el mayor numero de votos sera elegido Alcalde debidamente. Los tres (3) candidatos para el Consejo cue reciban el mayor numero de votos seran elegidos debidamente para los tres (3) escatios del Consejo. (t) Las elecciones extraordinarias. Las elecciones extraordinarias, cuando sean necesarias, las programara el Consejo en las fechas, los horarios y la manera que sean congruences con esta Carta Constitucional. (g) Las votaciones empatadas. Si la eleccidn primaria resulta en que dos candidatos o mas reciben una votacidn empatada de modo tal que el nCimero de nombres de los candidatos que debe colocarse en la boleta para la eleccidn ordinaria excederia las limitaciones del inciso (e), todos los candidatos que reciban una votacidn empatada serail enumerados en la boleta de la eleccidn general y no se aplicaran las limitaciones del inciso (a). Si ocurre una votacidn empatada en la eleccidn ordinaria entre dos candidatos o mas para el cargo de Alcalde o para el de Miembro del Consejo, se decidira la votacidn empatada echando suertes bajo la direccidn de la Secretaria Municipal. (h) Los candidatos individuates. En caso de que el numero de personas que cualifiquen como candidatos para los escanos de Miembros del Consejo para Ilenarse en una eleccidn es igual o menor que el numero de escanos que han de llenarse en dicha eleccidn, no se enumeraran dichos escanos en la boleta de la eleccidn ordinaria o primaria. No sera necesaria ninguna eleccidn para Alcalde en una eleccidn si hay solamente un candidato debidamente cualificado para Alcalde. Se consideraran elegidos a los candidatos debidamente cualificados. (0 La votacidn con boletas para electores ausentes. La votacidn con boleta para elector ausente se permitira conform a to dispuesto en las leyes del Estado y segun los terrninos prescritos por ordenanza ocasionalmente; sin embargo, ninguna ordenanza Iimitara el derecho de votar con boleta para elector ausente disponible segCn las !eyes del Estado. (j) E"l comienzo de los plazas. El plazo del cargo de todo funcionario electo comenzara siete (7) dias despues del dia de la eleccion ordinaria o la eleccion extraordinaria en la que resulte electo. Seccian 3, Forma de la boleta. La forma de la boleta para la Enmienda a la Carta Constitucional dispuesta en la Seccion 2 de esta Ordenanza sera la siguiente: "El plaza del cargo de los Miembros del Conselo. La Carta Constitucional del Municipio dispone que los Miembros del Consejo se elijan para plazos de dos aros. Ha sido propuesta una enmienda quo dispone que a los Miembros del Consejo se les elija para plazos de cuatro ands, haciendose la transicion de la duracion del plazo en las elecciones del 2006 y en las del 2008, de modo quo se alterne el vencimiento de los plazos del Consejo. Al Alcalde se le seguira eligiendo para plazos de dos arms, tDebera aprobarse la enmienda a la Carta Constitucional descrita anteriormente? Si [ ] NO [ 1" Seccion 4. La convocacian de elecciones; la boleta; el aviso, etc. a, El Consejo Municipal por resolucibn oportuna convocara a una eleccion para presentar a los electores del Municipio la propuesta en la boleta sabre la enmienda a la Carta Constitucional dispuesta en la Seccion 3 anterior. b. La votacion con boleta se celebrara durante el horario de siete a.m. a siete p.m. en los centros ordinarios de votacion para las elecciones del Municipio a conforme a to dispuesto de otro modo por las !eyes. Todos los electores cualificados que residan en el Municipio que esten inscritos oportunamente tendran derecho a votar. c. Se publicara un aviso de dicha eleccion conforme a la Seccion 100.342 de los Estatutos de la Florida, en un periodico de tirada general en el Municipio al menos treinta (30) dias antes de dicha eleccion, con la primera publicacion en la quinta semana anterior a la elecciOn y la segunda publicacibn en la tercera semana anterior a la eleccidn; dicho aviso substancialmente tendra la forma siguiente: "AVISO DE ELECCI6N POR EL PRESENTE, SE AVISA PCJBLICAMENTE QUE, CON ARREGLO A UNA ORDENANZA AUTORIZANTE DEBIDAMENTE APROBADA POR EL CONSEJO MUNICIPAL DEL MUNICIPIO DE KEY BISCAYNE, FLORIDA, (EL "MUNICIPIO"), SE HA CONVOCADO A UNA ELECCI6N Y ORDENADO QUE SE CELEBRE EN EL MUNICIPIO EL DNA DE DEL 200_ ENTRE LAS 7 A.M. Y LAS 7 P.M., PARA QUE LA SIGUIENTE PROPUESTA DE ENMIENDA A LA CARTA CONSTITUCIONAL SE SOMETA AL ELECTORADO CUALIFICADO DEL MUNICIPIO. "El plazo del cargo de los Miembros del Consejo. La Carta Constitucional del Municipio dispone que los Miembros del Consejo se elijan para plazos de dos ands. SECRETARIA DEL MUNICIPIO" Par Resolucian, el Consejo podra modificar la propuesta de la Boleta y el correspondiente Aviso de ElecciOn que han sido establecidos arriba. La Secretaria Municipal podra combinar los avisos de la eleccidn para cualquier otra enmienda a la Carta Constitucional con este Aviso de Eleccidn. d. Los libros de inscripcion se mantendran abiertos en la Oficina del Supervisor de Elecciones del Condado de Miami -Dade hasta la fecha en la cual se cerraran los libros en conformidad con las disposiciones de las elecciones generates, e. La Secretaria Municipal, con la asistencia necesaria por parte del Supervisor de Elecciones del Condado de Miami -Dade, queda autorizada por este medio para tomar todas las medidas apropiadas y necesarios para llevar a cabo y hacer cumplir las disposiciones electorates de esta Ordenanza. Hay copias de esta Ordenanza disponibles para su inspeccidn publica durante el horario habil de la Oficina de la Secretaria Municipal. Seccion 5. Entrada en vigor de la Enmienda a la Carta Constitucional. La enmienda a la Carta Constitucional Municipal descrita en la Seccidn 2 anterior, entrara en vigor unicamente si la mayoria de los electores cualificados del Municipio que voten en la eleccidn sobre la enmienda a la Carta Constitucional cetebrada para dicha finalidad y conforme a las Secciones 3 y 4 de esta, vota a favor de su aprobacion, por to que se considerara aprobada y entrara en vigor tras la certification de los resultados electorates conforme a to dispuesto aqui, Section 6. Divisibilidad. Las disposiciones de esta Ordenanza se declaran divisibles si alguna section, oracidn, clausula o frase de esta Ordenanza se considera invalida o inconstitucional, aunque dicha decision no afectara la validez de las restantes secciones, oraciones, clausutas y frases de esta Ordenanza las que se mantendran en vigor, ya que la intention tegislativa es que esta Ordenanza tenga vigencia a pesar de la invalidez de alguna de sus panes, Section 7 Inclusion en la Carta Constitucional. Es la intencion del Consejo Municipal y se ordena por este medio que las disposiciones de la SecciOn 2 de esta Ordenanza se conviertan y formen parte de la Carta Constitucional del Municipio de Key Biscayne, Florida, en to reference a toda enmienda a la Carta Constitucional aprobada por la mayoria de los electores que voten acerca de dicha medida en una elecciOn susodicha; que las secciones de esta Ordenanza puedan volverse a enumerar o que se les puede volver a asignar tetras para hacer cumplir dichas intenciones; y que la palabra "Ordenanza" se cambiara a "SecciOn" u otra palabra apropiada. SecciOn 8. Fecha de la vigencia. Que la Secci©n 5.01 ("Elecciones") de la Carta Constitucional del Municipio, se enmienda mediante la modificacian de esa Sec ion de modo quo rece de la manera siguiente: Seccian 5.01. Elecciones. (a) Los electores. Se considera elector del Municipio a toda persona que sea residente del Municipio, este cualificada como elector del Estado y se inscriba para votar del mode prescrito por la ley. Las elecciones no partidistas. Todas las elecciones para los cargos del Consejo y para el de Alcalde se celebraran de manera no partidista. La fecha de la eleccion. Una La eleccion primaria para el cargo de Alcalde se celebrara en todo ano par el primer martes despues del primer lines del mes de octubre. Se celebrara una elecci©n ordinaria para el cargo de Alcalde y para el de los Miembros del Consejo en el mes de noviembre de todo ail() par, el mismo dia en que se celebren las elecciones congresuales de los Estados Unidos y, si no se celebrara ninguna en algun ano, el primer martes despues del primer lunes del mes de noviembre de dicho alio. A pesar de las disposiciones contrarian de esta seccion quo pueda haber, el Consejo Municipal, por ordenanza, con arreglo a la Seccian 100.3605(2) de los Estatutos de la Florida, o independientemente de la susodicha base estatutaria, en virtud de la legislacion autorizante dispuesta en este inciso (c), ocasionalmente, puede autorizar cambios en las fechas para la celebration de elecciones primarias para el cargo de alcalde y para todas las elecciones ordinarias y extraordinarias para elegir al Alcalde ybo al Consejo Municipal y disponer la transici©n ordenada de los cargos resultante de dichos cambios de fechas. La enmienda a la Carta Constitucional Municipal descrita en la Seccion 2 anterior, entrara en vigor unicamente si la mayoria de los electores cualificados del Municipio que voten en la electron sobre la enmienda a la Carta Constitucional celebrada para dicha finalidad y conforme a las Secciones 3 y 4 de esta, vota a favor de su aprobacion, por to que se considerara aprobada y entrara en vigor tras la certification de los resultados electorales conforme a lo dispuesto aqui. Si se aprueban enmiendas a la Carta Constitucional en conflicto en una misma election, aquella que reciba el mayor numero de votos afirmativos prevalecera en cuanto a dicho conflicto. Asinismo, en caso de ocurrir un confiicta tal, el Procurador Municipal esta autorizado para modificar la Carta Constitucional hasta donde sea necesario para garantizar que todas las enmiendas semejantes que sean aprobadas esters de confouuiiidad las unas con las otras y que se les incluya debidamente en la publicaci©n de la Carta Constitucional modificada. Seccion 6. Divisibilidad. Las disposiciones de esta Ordenanza se declaran divisibles si alguna seccion, oration, clausula a frase de esta Ordenanza se considera invalida a inconstitucional, aunque dicha decision no afectara la validez de las restantes secciones, oraciones, clausulas y frases de esta Ordenanza las que se mantendran en vigor, ya que la intention legislativa es que esta Ordenanza tenga vigencia a pesar de la invalidez de alguna de sus partes. Seccion 7. Inclusion en la Carta Constitucional. Es la intenci©n del Consejo Municipal y se ordena por este media que las disposiciones de la Seccion 2 de esta Ordenanza se conviertan y formen parte de la Carta Constitucional del Municipio de Key Biscayne, Florida, en lo referente a toda enmienda a la Carta Constitucional aprobada par la mayoria de los electores que voten acerca de dicha medida en una eleccion susodicha; que las secciones de esta Ordenanza puedan volverse a enumerar o que se les puede volver a asignar tetras para hacer cumplir dichas intenciones; y que la palabra "Ordenanza" se carnbiara a "Seccion" u otra palabra apropiada. Tras la aprobacicn de esta Ordenanza despues de su segunda lectura, esta Ordenanza entrath en vigor solamente tras la aprobacic n de una Resolucian que establezca la fecha para la eleccicn sobre la enmienda a la Carta Constitucional. Toda medida de enmienda a la Carta Constitucional dispuesta aqui entrara en vigor solo tras la aprobacidn de la mayoria de los electores que voten en relaci©n con la medida, y entrara en vigor tras la certif cacidn de los resultados de la eleccien; y osta sera pertinente en cuanto a las elecciones que se celebren a partir del 2006.
