Discussion:
The pro posed Sport Co urt is lo ca ted on the north side of the property next to existing single-
family residential homes. Recent co nstruction activities have expanded the po tential play area
north of the existing soccer field, and the Schoo l sees this as an o ppo rtunity to relo cate existing
basketball hoo ps from the parking lo t and pro vide students with additional o utdoo r space to
pla y. The School was unable to find a suitable alternative location.
The Sport Court is a minor accesso ry structu re per To wn Co de. The "side interio r" setback for
mino r accesso ry structures in the Gulf Stream Ocean West district is 15 feet per Sectio n 70-74.
Ho wever, in the Outdo or Recreatio nal D istrict the setback for "side yards" is 25 feet per Sectio n
66-260.The Schoo l is zoned single fa mily residential and is covered by a developer's a greement
that a llows it to o perate as a scho ol. The Scho ol was asked to locate the basketball co urt a
minimum of 25 feet fro m the side property line because the use of the school is more comparable
to the Town's clubs, which are lo cated in the Outdoo r Recreational District, tha n a single family
home. As yo u may note from the survey, a volleyball co urt was at o ne time lo cated in the area
propo sed fo r the Spo rt C ourt.
An existing playground located west of the proposed Spo rt Co urt generates a significant amount
of no ise during weekdays while schoo l is in sessio n, consistent with the o peratio n of a schoo l. The
Scho ol opens at 7:30 am, with drop-off between 7:50 and 8:05 am and classes beginning at 8:10
am. The school day ends at 4:15 pm. In additio n to the notice required by the To wn Co de, the
Schoo l has been asked to reach out to its neighbors so that they a re aware of the applica tion a nd
a llow them to provide input.

This entire Part is optional for all applicants. Applicants are encouraged, but not required, to provide any
additional relevant information regarding the project that was not covered elsewhere on this form or on any of
the other materials submitted with the application.
Gulf Stream School believes that providing a multi -use outdoor sport court will
allow students more freedom to play and engage in team activities and provide a
safer space to enjoy outdoor ball play. The new sport court will provide
shock absorption and lateral forgiv eness that the parking lot does not which will
lessen impact and risk of injuries and provides a location away from the parking l ot
where cars are often coming and going which is not safe for the students. Overall
this is a safer option and a more conducive location for students to play. This court
will only be used during school hours - maybe 2 hours per day and should not
impact existing neighbors in any way.
