RoII Call: 2. Approval of Agenda: Minutes of March 28, 2012 Commissioner Soles moved, and Commissioner Hodsdon seconded the motion to approve the Agenda. Motion carried: 7 -0. 3. Open Forum: 4. Public Hearing and Action a. Development Permit Commercial Development on Market Street The Village at Grand Park According to the Final Plat Phasing Plan, The Village at Grand Park Filing 2 Reception 2011005609 Commissioner Soles moved, and Commissioner Sumrall seconded the motion to open the public hearing on the Development Permit Commercial Development on Market Street The Village at Grand Park According to the Final Plat Phasing Plan, The Village at Grand Park Filing 2 Reception 2011005609. Motion carried: 7 -0. Commissioner Hodsdon recused himself from this discussion due to his relationship with Munn architecture and Grand Park Development. The Development Permit is Lot 10, 11A and 11B Development Permit, The Village at Grand Park. The plats for these 3 lots have been approved with conditions by the Town Board, but not yet executed and recorded. The proposed new commercial development is classified per the regulations as a Major Proposal {see Section 16 -4 -40 (4) (a) (d) Page 2 of 3 The applicant is Grand Park Development LLC, represented by Munn Architecture. The Development Permit submittal is for mixed use buildings located within the Grand Park Planned Development District (PDD) south of the existing general store and north of the new cinema bowling alley. The application indicates that the buildings will be used for retail, professional offices and potentially residential units. "The architectural drawings and renderings are schematic and may slightly adjust before building permits are submitted. It is the intent of the developer to permit each of the proposed buildings separately and as interest in the units continue to increase This project in located within the Grand Park PDD. Section 16 -5 of the Fraser Municipal Code details the Planned Development District zoning regulations. A Final Planned Development Plan (FPDP) is a requirement. The applicant processed a FPDP for this Planning Area in 2008. All the town utilities have been constructed and accepted by the Town of Fraser (including water, wastewater and storm sewer). The Town Engineer has reviewed the Development Permit and his concerns have all been addressed. The height of the structures and the provided parking complies with the FPDP. The exterior lighting meets our new Dark Sky Compliant standards. The applicant has already provided off -site snow storage via a separate easement (Relocatable Snow Storage Easement at Reception 2011005625). Scott Munn representing Grand Park Development briefed the Commission on the Market Street Commercial proposal. Commissioner Sumrall moved, and Commissioner Soles seconded the motion to close the public hearing on the Development Permit Commercial Development on Market Street the Village at Grand Park According to the Final Plat Phasing Plan, The Village at Grand Park Filing 2 Reception 2011005609. Motion carried: 7 -0. Commissioner Sumrall moved, and Commissioner Shapiro seconded the motion to approve the Development Permit Commercial Development on Market Street the Village at Grand Park According to the Final Plat Phasing Plan, The Village at Grand Park Filing 2 Reception 2011005609 with the following conditions: 1. All conditions listed in Resolution No.'s 2012- 02 -04, Resolution 2012- 02 -05, and Resolution 2012 -02 -06 shall be met prior to issuance of a building permit. 2. The maximum bulb wattage for the Niland Aspen LED series shall not exceed 250. 3. Add reception numbers of all existing easements to all pertinent sheets. 4. To allow for a phased development, a separate Construction Guarantee Agreement (CGA) and surety shall be required for the improvements for each lot prior to the issuance of a building permit. The CGA and required surety will be provided for lot 11 b at the time the developer pulls a building permit for lot 10 or lot 11a. 5. Amend Exhibit B to correspond with language on the approved plats. Also, specify the on -site vs. of -site snow storage quantities consistently in the legend. 6. Landscape plan to be reviewed by Town Gardener. 7. If a snowmelt system is to be utilized, applicant will provide additional snow melt discharge information prior to issuance of a building permit. 8. If the final building plans change significantly, as determined by staff, from the renderings as presented at the April 25, 2012 Planning Commission public hearing the design must be resubmitted to the Planning Commission for approval. Motion carried: 7 -0. 5. Discussion and Possible Action Regarding: a. Appointment of Chairperson and Vice Chairperson Commissioners discussed the appointments. Commissioner Shapiro moved, and Commissioner Powell seconded the motion to approve the Appointment of Jean Wolter as Chairperson and Steve Sumrall as Vice Chairperson. Motion carried: 5 -0. Jean Wolter and Steve Sumrall abstained from the vote. 6. Adjourn Commissioner Shapiro moved, and Commissioner Soles seconded the motion to adjourn. Motion carried: 7 -0.
