City staff members present were Anette Spickard, City Manager; Bill Nichols, City Attorney; BessieJo Wagner, City Clerk; Erin Greaves, Communications Manager; Linda Stokes, City Treasurer; Michelle Groenevelt, Community Development Director; Delta James, Economic Development Planner; Brian Parker, City Planner; Eric McCormick, Golf Course Superintendent; Meg Lojek, Library Director; Chris Curtin, Information Systems Manager; Justin Williams, Police Chief; Vlatko Jovanov, Network Administrator; Tara Woods, Recreation Supervisor Also, in attendance were Regan Berkley, Idaho Fish & Game and Dave Holland, Heartland Hunger and Resource Center Mayor Giles led the audience in the Pledge of Allegiance. APPROVE THE AGENDA Council Member Nielsen moved to approve the agenda as submitted. Council Member Maciaszek seconded the motion. In a voice vote all members voted aye, and the motion carried. MCCALL CITY COUNCIL Page 1 of 9 June 24, 2021 Regular Meeting CONSENT AGENDA Staff recommended approval of the following ACTION ITEMS. All matters which are listed within the consent section of the agenda have been distributed to each member of the McCall City Council for reading and study. Items listed are considered routine by the Council and were enacted with one motion. 1. Payroll Report for period ending June 11, 2021 2. Warrant Register – GL 3. Warrant Register – Vendor 4. AB 21-166 City Licenses Report to Council Per McCall City Code: Per McCall City Code Title 4 Chapter 9, the City Council has determined the City Clerk shall be delegated the authority to process and grant or deny all alcoholic beverage license applications, other than certain circumstances involving catering permits, which the City Clerk shall review the application for catering permit for completeness and forward said application to the Police Chief. The Police Chief upon receipt of the application shall make a recommendation to the City Clerk to approve or deny the application. Whenever the City Clerk shall determine that an application for alcoholic beverage license transfer or renewal is complete, the City Clerk shall approve or deny such application. All decisions of the City Clerk shall be reported to the City Council at the next regularly scheduled City Council meeting after such decision. The City Clerk is also responsible for all processing of business, taxi, snow removal, pawnbroker, child daycare licenses, vendor permits, and public event applications. Action: Council to review the License report. 5. AB 21-167 Treasurer’s Report as Required by IC 50-208: Treasurer’s report of accounts and activity of office during the month of May 2021 regarding care, management or disposition of moneys, property, or business of the City. Action: The Council shall examine the report and determine whether additional information from the Treasurer is required. 6. AB 21-165 McCall Youth Football Club and Parks & Recreation MOU: McCall Youth Football Club (MYFC) is a youth sports organization that has replaced the Optimist Football Program and offers full-contact football coaching and games for local youth. The club has non- profit status and needs program registration assistance. The MYFC approached the City of McCall Parks and Recreation Department, about partnering with the club to help advertise, collect program registrations and monies. The program was a success for the past two years, and they would like to partner again for the 2021 fall season. The Parks and Recreation Department utilizes Team Sideline for their program registration, advertising, and participant database software. The MYFC has set the program registration fee and will be responsible for purchasing and maintaining safe equipment for the football program and provide their own liability insurance. The Parks and Recreation Department will advertise for the program, collect registration fees, and disperse funds to the MYFC. The department will collect 10% of the total registration fees to cover our expenses. McCall Recreation Youth Scholarships will not be used for the football program. Those needing financial assistance for the program can contact the football club directly to request support. Action: Approve the MOU with the McCall Youth Football Club and approve the mayor to sign all necessary documentation. 7. AB 21-170 Request to Approve a New Lease for Hangar 523 with Richard A. Bush and Pamela S. Bush and Terminate the existing 523 Lease with SEICO, LLC: Richard A. Bush and Pamela S. Bush are purchasing Hangar 523 from SEICO, LLC and are requesting a new MCCALL CITY COUNCIL Page 2 of 9 June 24, 2021 Regular Meeting lease for Hangar 523 and to terminate the existing lease with Bruce A. & Sylvia J. Hafenfeld. The existing lease consists of 1,530 square feet of property. The current annual Hangar Lease payment of $586.93 is paid up through September 30, 2021. The new rate will be $0.3127 per sq ft, or $478.43 a decrease of $108.50 - and increases the lease term from the original 15 years remaining to 40 years. The purchaser has been provided with a copy of the current lease, current Airport Rules and Regulations, and Airport Minimum Standards. The City Clerk will record the document and keep a copy for the City’s records. Staff has requested a $200 transaction fee. The contract has been reviewed by the City Attorney. Action: Approve a New Lease for Hangar 523 with Richard A. Bush and Pamela S. Bush, terminate the existing Hangar 523 Lease with Bruce A. & Sylvia J. Hafenfeld, and authorize the mayor to sign all necessary documents. Council Member Callan moved to approve the Consent Agenda as submitted. Council Member Holmes seconded the motion. In a roll call vote Council Member Callan, Council Member Holmes, Mayor Giles, Council Member Maciaszek, and Council Member Nielsen all voted aye, and the motion carried. PUBLIC COMMENT Mayor Giles called for public comment at 5:32 p.m. City Clerk BessieJo Wagner gave a summary of the written comments: Wildlife Ordinance There were approximately 353 people who sent written comments, of those comments only 127 were from people with a McCall address – showing 18 in favor of the ordinance, 2 neutral and 107 against. Many of those against expressed they were mostly against the removal, relocation, or euthanasia of the Deer and some were in favor of prohibiting the feeding of wildlife. There were 8 from an unknown location - stating 1 for, 1 neutral, and 6 against. There were 218 comments from people that do not have a McCall address, some of which do not even live in Idaho or this country. These comments were against removal, relocation, or euthanasia of the deer. This brings the total number in favor to 19, neutral 3, and against 331. All the comments will follow the minutes as Attachment 1. Resolution 21-25 Area of Concern All 44 written comments received were in favor of the resolution being presented later in the meeting and will follow the minutes as Attachment 2. In Person Comments Lew and Colleen Ross of 915 Camas Drive, McCall shared they are in opposition of the Wildlife Feeding Ordinance and spoke to aggressive driving and actions towards the deer. They would rather see other actions taken to deal with the wildlife. Julie Conrad of 1423 Eagle Drive, McCall spoke in opposition of the Wildlife Feeding Ordinance. She would rather see education over eradication. MCCALL CITY COUNCIL Page 3 of 9 June 24, 2021 Regular Meeting Marcia Witte of 669 Woodlands Drive, McCall spoke in favor of Resolution 21-25 – Area of Concern. She shared her concerns about what the Pine Creek Ranch development will have on infrastructure and safety issues on Woodlands Drive. Sheree Sonfield 664 Woodlands Drive, McCall spoke in favor of Resolution 21-25 - Area of Concern and shared concerns about the environmental assessment and asked that the Council require that the assessment specifically considers all the potential options for vehicular traffic. She shared comparisons to another large development and how this development falls short in providing access and pathways. Thaddeus of 602 Woodlands Drive, McCall spoke in favor of adopting Resolution 21-25 - Area of Concern. He asked that an environmental assessment addressing many issues is completed prior to approval. Hearing no further comments, Mayor Giles closed the comment period at 5:56 p.m. The Council took a brief recess and reconvened at 5:58 p.m. WORK SESSION AB-168 Request for Council to Review a Draft Ordinance Regarding Prohibiting the Feeding of Wildlife Police Chief Justin Williams presented the draft ordinance regarding prohibiting the feeding of wildlife. On May 27, 2021, Council directed staff to continue with preparation of a proposed ordinance prohibiting the feeding of wildlife within the City of McCall. On June 10, 2021, in cooperation with Idaho Fish and Game, staff presented some ordinance language for review and discussion. Council gave some suggestions and some desired changes and requested that staff bring back code language in ordinance form for them to review Regan Berkley, Idaho Fish & Game (IFG), clarified information on the relocation of the deer and gave an explanation on what education pieces have been distributed. She shared that the mortality of the deer is much higher with them in place than it would be if they were relocated. Unnatural feeding of the deer has changed the natural migration patterns of this deer herd and it is the goal of IFG to reestablish the winter migration. This does not mean there will not be any deer as they will migrate back during the summer months. She agrees with education over regulation and stated IFG has spent much time and money in educating the community already. Police Chief Williams referenced the comments about speeding and the installation of signs and stated that as it is with dealing with people breaking the law by speeding that without an enforcement aspect, education by itself will not be a deterrent which is why the ordinance is being presented. Mayor Giles called for Council discussion about the ordinance. Council Member Maciaszek stated he is good with what is presented in the ordinance. Council Member Nielsen supports the ordinance except for item B7 under 5.7.400 Feeding/Attracting Wildlife Prohibition. Council Member MCCALL CITY COUNCIL Page 4 of 9 June 24, 2021 Regular Meeting Holmes feels that it should be tabled. Council Member Callan stated she is good with what is written. Mayor Giles asked for clarification on surrounding states regarding wildlife feeding as well as some Idaho cities and national parks. Police Chief Williams clarified there is prohibition in those areas and Ms. Berkley stated she did not believe the town of Riggins has a feeding ordinance. City Attorney Bill Nichols clarified that the banning of trapping is a separate issue and to not confuse feeding with trapping. He advised against mixing the two together. Council Member Nielsen asked if IFG would commence the relocation anyway if the ordinance did not pass and Ms. Berkley stated that it is too costly of an endeavor to do if there was no feeding ordinance in place to support keeping this from happening again. Council Member Nielsen asked if the ordinance did pass, is it possible to not relocate the deer and Ms. Berkley reiterated that it would not be humane to allow the deer to stay as they are reliant on humans feeding them during the winter months so they would starve. Council Member Nielsen asked if there is an option to not relocate. Police Chief Williams stated that the Council could ask IFG to not relocate but IFG is ultimately the one responsible for game management and will need to do what they feel is best after they study the herd further. Mayor Giles did feel he should vote for the ordinance if they do not support IFG. Council Member Maciaszek is not going to question what IFG does as they are the experts on wild animals. He supports the restriction of the feeding of wild animals. Council Member Callan stated she was in total agreement. Council Member Holmes stated she felt the Council should listen to the public and was not in support. She does not agree with IFG. The Council briefly discussed the issue further. The Council consensus was to finalize the ordinance at the next meeting. BUSINESS AGENDA AB 21-164 Request to Approve the Woodstock Agreement with Heartland Hunger & Resource Center and Proclaim the 10th day of July 2021 as Humanitarian Woodwork Day Dave Holland in conjunction with the Heartland Hunger and Resource Center, has worked with churches and other community organizations to create a humanitarian project of obtaining firewood for those in need. The three groups of individuals designated for assistance are 1) widows and single women with children; 2) the aged and infirmed, and 3) those injured and not capable of getting wood themselves. Mr. Holland is requesting that the City declare, by proclamation, the second Saturday in July of each year as the “Humanitarian Wood Work Day”. This year that day is July 10, 2021. In prior years, over 200 volunteers participated in cutting, splitting, and delivering hundreds of cords of wood. Since the first Woodwork Day over 1000 cords of firewood have been delivered to over 230 families in need. The plan is to start at 8:00 a.m. on Saturday, July 10, 2021. No one under the age of 18 will be permitted to use a chainsaw. The primary sawyers will be volunteers from the Forest Service Firefighters. The goal is to have the wood cut into rounds the week prior to reduce the need for additional sawyers. Also, volunteering is the McCall Fire District who is providing EMT services MCCALL CITY COUNCIL Page 5 of 9 June 24, 2021 Regular Meeting for the activities. Enough wood has already been purchased and is in McCall ready for this year’s event. Council Member Callan moved to approve the Woodstock Agreement with Heartland th Hunger & Resource Center and Proclaim the 10 day of July 2021 to be Humanitarian Woodwork Day in the City of McCall and authorize the Mayor to sign all necessary documents. Council Member Nielsen seconded the motion. AB 21-169 Request to Approve National Endowment for the Arts Grants for Arts Project application for McCall Library public art Economic Development Planner Delta James presented the National Endowment for the Arts Grants for Arts Project application for McCall Library public art. The National Endowment for the Arts (NEA) offers matching funding through its Grants for Arts Projects program to support projects that “celebrate America’s creativity and/or cultural heritage.” The average grant award amount is $25,000 and must be matched at least 1:1 with local funding. The McCall Public Art Advisory Committee is requesting approval to apply to this grant program to help fund a public artwork that will be integrated into the Library Expansion project and provide a critical component of the new Library construction such as front desk, interior doorway, flooring, furnishings, or fireplace mantel in a unique and beautiful way. Funds necessary to match this grant, if awarded, are pending FY22 City budget approval. An FY22 CIP request of $62,000 has been submitted for this project for a total project cost estimate of $87,000. This project was identified as a priority project within the McCall Public Art Plan adopted by City Council on March 11, 2021. Additionally, at its June 14, 2021, meeting, the McCall Library Board expressed support for this project. The Council did not have any questions. Council Member Maciaszek moved to approve submittal of a NEA grant application for McCall Library public art and authorize the Mayor to sign all necessary documents. Council Member Callan seconded the motion. In a roll call vote Council Member Maciaszek, Council Member Callan, Mayor Giles, Council Member Holmes, and Council Member Nielsen all voted aye, and the motion carried. AB 21-171 Request to approve Artist Personal Property Lease Agreement for “Going to School” public artwork by Phil Wilcomb Economic Development Planner Delta James presented the Artist Personal Property Lease Agreement for “Going to School” public artwork by Phil Wilcomb. In 2008, the City of McCall and the McCall Arts and Humanities Council worked with several artists to lease public artworks to the City for display at various locations. All but one of these leased artworks has now either been donated to the City for permanent display or removed. The metal artwork “Going to School” by Phil Wilcomb, displayed at Brown Park, is the only remaining public artwork that is still leased by the City and its lease agreement is due for renewal. MCCALL CITY COUNCIL Page 6 of 9 June 24, 2021 Regular Meeting Sadly, Phil Wilcomb, the artist, is recently deceased. His family, the inheritors of the artwork, would like to continue to lease the artwork to the City for continued display in Brown Park. Display of the artwork has been considered and accommodated within the Brown Park improvement project currently underway. At its March 29, 2021, meeting, the McCall Public Art Advisory Committee considered the continued lease of Wilcomb’s “Going to School” artwork and recommended to City Council that the lease agreement be renewed for a period of five years. The Artist Personal Property Lease Agreement has been reviewed by the City Attorney. The proposed term for the lease is July 1, 2021, to June 30, 2026. The Council expressed support and did not ask any questions. Council Member Maciaszek moved to approve Artist Personal Property Lease Agreement for “Going to School” public artwork and authorize the Mayor to sign all necessary documents. Council Member Nielsen seconded the motion. In a roll call vote Council Member Maciaszek, Council Member Nielsen, Mayor Giles, Council Member Callan, and Council Member Holmes all voted aye, and the motion carried. AB 21-172 Request Approval of Resolution 21-24 Adopting a revised guidelines for setting recreation program fees and coaches’ discounts, account credit update and overall staff responsibilities Recreation Supervisor Tara Woods presented Resolution 21-24 adopting a revised guidelines for setting recreation program fees and coaches’ discounts, account credit update and overall staff responsibilities. Staff is requesting that Council consider a revision to the Recreation Fee Schedule. Currently volunteer coaches receive 50% off their registration fee; however, Parks and Recreation staff feel volunteers should receive a 100% fee waiver for their child’s participation in the program they are coaching. Parks and Recreation Advisory Committee unanimously agreed to waive volunteer fees as a good gesture and could help ease recruiting efforts. Staff is also recommending that the refund policy addressing refund payments due to class cancellation will be refunded. The Council did not ask any questions and was supportive. Council Member Callan moved to approve Resolution 21-24 adopting definition of terms used when setting recreation fees; ratifying the calculations to set fees charged for the services of the recreation department; establishing a refund policy; establishing a scholarship and discount policy and authorize the Mayor to sign all necessary documents. Council Member Maciaszek seconded the motion. In a roll call vote Council Member Callan, Council Member Maciaszek, Mayor Giles, Council Member Holmes, and Council Member Nielsen all voted aye, and the motion carried. The Council took a short recess and reconvened 6:49 p.m. AB 21-173 Request to Adopt Resolution 21-25 Designating Certain Properties as an “Area of Critical Concern” MCCALL CITY COUNCIL Page 7 of 9 June 24, 2021 Regular Meeting Diane Kushlan, consultant from Kushlan Associates, presented the Resolution 21-25 Designating Certain Properties as an “Area of Critical Concern”. Resolution 21-25 would designate properties east of the City boundaries within the area of city impact and owned by Pine Creek Ranch, LLC as an area of Critical Concern requiring the preparation of an environmental assessment. She gave a brief history regarding the project and explained that the need behind the request for the resolution is to give staff more time to address concerns. The Council asked questions about addressing vehicle access, contacting the neighborhood, and local housing. Council Member Maciaszek moved to adopt Resolution 21-25 Designating Certain Properties owned by Pine Creek Ranch, LLC as an “Area Of Critical Concern” and authorize the Mayor to sign all necessary documents. Council Member Callan seconded the motion. In a roll call vote Council Member Maciaszek, Council Member Callan, Mayor Giles, Council Member Holmes, and Council Member Nielsen all voted aye, and the motion carried. Covid-19 Update and Review of Mask Metrics Status Police Chief Justin Williams gave the Covid-19 update. He reported 3 out of 4 of the matrix requirements is currently being met, and shared the vaccination rates, bi-weekly infection rates, and positivity rates are also within the matrix guidelines. AB 21-175 Request Approval of Agreement to the U.S. Department of The Treasury Coronavirus Local Fiscal Recovery Fund Award Terms and Conditions City Treasurer Linda Stokes presented the agreement to the U.S. Department of The Treasury Coronavirus Local Fiscal Recovery Fund Award Terms and Conditions. The State of Idaho has received the first half of funding from the American Relief Plan Act of 2021 (ARPA) and the State Controller's Office is on track to deliver an easy-to-use portal for all Non-Entitlement Units of Local Government (NEU) to receive Local Fiscal Recovery Funds. A Non-Entitlement Unit of Local Government is any city in the State of Idaho with a population less than 50,000 that is not otherwise receiving direct funding from U.S. Treasury. Recipient understands and agrees that the funds disbursed under this award may only be used in compliance with section 603(c) of the Social Security Act (the Act), Treasury’s regulations implementing that section, and guidance issued by Treasury regarding the foregoing. The recipient will determine, prior to engaging in any project using this assistance, that it has the institutional, managerial, and financial capability to ensure proper planning, management, and completion of such project. City Manager Anette Spickard stated these funds are different from the CARES Act funding and the City will have until 2026 to spend the money. She explained the process for determining how to spend the money will come later as staff learns how to utilize the funds. Staff answered questions. AB 21-174 City Council Vacancy Discussion and Direction to Staff City Clerk BessieJo Wagner presented the City Council Vacancy discussion. Idaho Code § 50-805 states that the governing body of any city governed by the Council/Manager form of government shall consist of five (5) or seven (7) Council Members. As stated in Idaho Code § 50-702, each Council Member elected at a general city election, shall be installed at the first meeting in January following the election. The incumbents shall meet and conduct such business as may be necessary to conclude the fiscal matters of the preceding year; the newly elected shall then subscribe to the oath of office,be presented certificates of election, assume the duties of their position, and conduct such business as may be necessary. Due to the resignation of Council Member Melanie Holmes, effective August 12, 2021, a new Council Member will need to be selected through the process outlined in the Governance Manual to fill the position until January 13, 2022, whereas the position will be filled through the regular election process occurring in November 2021. The Council chose August 51h for interviewing interested candidates and then make their selection on August 12. Upcoming Meetings Schedule Discussion Council discussed upcoming meetings. Box 1368, McCall, ID 83638 "We respectfully, request the McCall City Council to adopt Resolution 21-25 at the June 24, 2021 City Council Meeting. As home owners in the Woodlands immediately adjacent to the proposed development, we have several concerns about the development including: traffic, ingress and egress, emergency egress, effects on water pressure for current homeowners, construction traffic and noise, loss of wildlife habitat which includes nesting Piliated Woodpeckers, and wetlands, children walking to and from school, narrowed streets during winter months and no current plans for open space or buffer between existing homes and new homes in the proposed development." 2 6/19/21 17:03:32 Bob Wilkinson 678 Koski Drive, McCall, ID 83638 "I would like to weigh in on the proposed development in the Woodlands. There are a number of issues surrounding this development that I would like to address. The primary access to and from this new development will be, as proposed, on Woodlands drive. As there is no sidewalk and as there are many children living on the Woodlands Drive this is a major safety concern. Adding a few hundred cars a day to the Woodlands Drive will have a major impact on both safety and the environment. An environmental impact study would show the relative harm the added traffic would have on the community. In addition, the wildlife would be affected both in the new and the existing areas. When does development and open space collide? Are we to put houses on every plot of land without trying to preserve the natural state of nature that we came here to enjoy. When is enough enough? Thanks, Bob Wilkinson" 3 6/21/21 8:10:00 Kristen McCoy 676 Koski Dr McCall, ID "I am writing to support the City staff recommendation to designate the proposed 158-acre Pine Creek Ranch development as an area of critical concern. I would also like to express my concern with the proposed Pine Creek Rach development as currently planned. Woodlands Drive would be the primary route to the development, though it's not developed for such a drastic increase in traffic. Since there are no sidewalks or pathways, the street is used frequently by children and families to get to/from school. I fully support the City's proposed requirement to conduct an environmental assessment as part of the development application review process. This process would allow the developer to understand the existing environmental resources, and revise the plans to reduce adverse impacts. By doing this research and minimizing impacts to the environment, everyone benefits including those within the future development, adjacent neighborhoods, and entire community of McCall. This is a step that the City should absolutely require before approving any development plans for this area. ATTACHMENT 2 Area of Concern Comments Page 1 of 15 06/23/21 Comments related to Resolution 21-25 – Area of Concern Our primary concern is the safety of children and elderly residents on Woodlands Drive. There are no sidewalks on Woodlands Drive. Children and parents walk to and from school, bike, and recreate using the street itself year around. As elderly residents, we use the road for walking, exercise, and access to the Spring Mountain Bike and Pedestrian path. The Pine Creek Ranch development will increase pedestrian traffic as well as vehicle traffic on Woodlands Drive. Woodlands Drive is now at maximum capacity for safety. There is no curbside parking. The street is frequently partially blocked by service and delivery vehicles. The current speed limit of 20 mph is consistently ignored. In winter, the high snow walls limit visibility and force pedestrians and traffic together. The increased residential traffic from the Pine Creek Ranch subdivision, as well as the transportation and infrastructure vehicles used for the development and maintenance of the subdivision, will pose a physical threat to the residents of both The Woodlands and the Pine Creek Ranch. Please vote to designate Pine Creek Subdivision as an Area of Critical Concern. Currently there is only one entrance and exit to the Woodlands subdivision, which is Woodlands Drive. This road is already very busy with cars, delivery trucks, people walking, people biking and children playing. In the wintertime with snow the road turns into a single lane road and still there are delivery trucks parking on the road and adults and children walking. I am not sure if you are aware but this is how the children go to and from school. There have already been several accidents on Woodlands Dr. in the winter; adding more people and cars to this road is dangerous. I am also worried about the fire danger of more homes to our east and south. If there is a wildfire how can so many people and cars escape in time? More importantly, how would fire crews get to the fire while residents are trying to escape? Another issue is water. Every evening around dinnertime our water pressure drops. It can be very hard to wash the dishes during that time. With more homes it would seem that the water pressure would be even worse. What if there is a wildfire during the early evening? It is obvious that road access to this parcel will have a significant negative impact on the Woodlands and Fox Ridge neighborhoods if cost of development is the only criteria. There are alternatives that would mitigate the impacts but these alternatives need careful evaluation to identify the best long term approach. In addition to the loss of woodland habitat on the 158- acre parcel, increased traffic in the Woodlands is a major worry. Woodlands Drive, where my family and I live, is currently the only access road into the Woodlands itself. There are no walking paths or sidewalks along Woodlands Drive, and the road itself does not appear to have been designed with high- volume traffic or large trucks in mind. If nothing is done, the coming and going of heavy equipment and construction vehicles into Pine Creek Ranch, and later, increased residential traffic, would pose a safety risk for children who walk to school, as well as to the many pedestrians and cyclists in our neighborhood. With only one main thoroughfare into the area, dangerous bottlenecks could occur during an emergency or natural disaster. Added traffic would also add to the wear and tear of the road itself. We walk our kids to and from school every day. After school, we walk and ride bikes for exercise. Our children regularly walk down the road to visit friends who live on the street, and we walk most summer days to the neighborhood pool. Because there are no sidewalks, all this walking and riding takes place in the street. And in the winter months especially, much of the walking occurs on icy roads in the dark. We feel that Woodlands Drive is already dangerous for children. For a narrow road with no sidewalks, there is a lot of traffic, and too many cars exceed the speed limit. With the dramatically increased traffic that will result from the Pine Creek Ranch development, we do not expect to be able to walk anywhere any longer. We will most likely have to drive even to reach the end of our street. This would be burdensome and inconvenient, and it would defeat the primary reason we moved to this development—the walking distance to the school and the nearby activities for children. We noticed the Allwest office in Meridian doesn't open until 8:00 AM but they had no issue about driving a backhoe behind our house at 6:00 AM. We understand the developer's need for testing but 6:00 AM is out of line. Woodlands Drive would undoubtedly become the default access to this new development, which would dramatically increase safety hazards for children, pedestrians, and bicyclists. As in much of McCall, separating vehicular traffic from pedestrian traffic is challenging. Woodlands Drive already experiences a great deal of traffic, with all too much of it exceeding the posted speed limit. In addition, the increased volume of traffic would have a detrimental impact on the quality of life that we presently enjoy as residents in this neighborhood. If the Pine Creek Development were to proceed, it should be allowed to do so only if a great deal of sensitivity be shown to the affected neighborhood and the existing natural environmental conditions. This landlocked parcel with R4 zoning will add over 600 single family lots, presenting issues for routine and emergency access, as well as construction access. I’d like you to note these points: 1) The 158 acres is landlocked– it is surrounded by the Nokes Property, The Woodlands, Fox Ridge, and West Place. 2) Unless a major new access point and road network is established, existing roadways will be overwhelmed thus creating safety hazards. There are many young children who use Woodlands roads to walk to the nearby schools. 3) The Woodlands (118 single family lots) plus Fox Ridge (32 single family lots) have 2 exits onto Spring Mountain Rd. More than 750 single family lots would use 2 access points to Spring Mountain Ranch Road. 4) Compare this to current development along Spring Mountain from Lick Creek to Bitteroot Dr: 9 access points to Spring Mountain Rd; 528 single family lots (East of SMR) 5) Woodlands Drive is only 23 feet wide (at its widest point), with no shoulder or separate path. This does not meet the cross-section of a “local street’ in the Transportation Master Plan, much less a busier street. In winter, the road is even more narrow and the snowbanks are so high that sight lines are obscured for safe exit of driveways along Woodlands Drive. The McCall Comprehensive Plan includes transportation goals and policies that all speak to the importance of safe streets. The assessment needs to recognize the acreage is landlocked and that insufficient access has been proposed in the preliminary plan concepts. The assessment needs to look at creating additional and practical access to the landlocked acreage. Unless a major new access point and road network is established, existing roadways will be overwhelmed thus creating safety hazards. Our community was recently made aware of a planned development of these two parcels. This planned development appears to comprise four phases which, if all four phases are completed, would add about 353 single family zone R4 lots plus additional medium density zone R8 housing. In addition, if the 90 acre parcel is annexed by the city, the completed development would add a sub-division comprising about 3% of McCall’s current land area. Why let some developer make a large amount of money and make our street dangerous. Again we don't have sidewalks or a walking path to keep our kids, dogs and others safe. We understand that there will be another road into these houses but our route would be the shortest which means that would be the one that most would take to get home. Please, please, please think about those of us that are already living here, instead of all the money you'll be making for this developer. These homes aren't for the working class in McCall, and business are already cutting hours or not able to open because they can't get workers. As a resident of the Woodlands, I am greatly concerned about the effect of the proposed developments in the land bordering the Woodlands. My family and I have been residents of the Woodlands for almost nine years. As one of the few neighborhoods in McCall that does not allow short term rentals, we have enjoyed a quiet and calm neighborhood throughout the years. Our daughter and many of the neighborhood children enjoy Area of Concern Comments Page 9 of 15 Page 7 of 7 bicycling, walking and rollerblading around the neighborhood. Even now, I sometimes worry about their safety as they play together or walk to school because there are no sidewalks in the Woodlands. Pedestrians and cars must share the narrow roads that wind through our neighborhood. I am concerned that additional homes will increase the traffic and make our streets more dangerous. Summer pedestrians are an important issue, another consideration is winter when the snowplows can barely keep our streets clear. There are times throughout the winter when on streets are just over one lane wide. Here again, I am concerned about traffic from the proposed new development. Perhaps one of the greatest issues regarding these developments is the absence of a practical alternate entrance in and out of the Woodlands. I have heard of proposals for the far end of the neighborhood, however who will use these on a day-to-day basis if the convenient existing entrance is available? Any propositions I have seen for an alternate entrance would mean the residents would have to go out of their way to get to and from the town from their homes. I predict that most people will continue to use Woodlands Drive which clearly has not been designed to sustain any more traffic that it currently handles. All of my concerns about traffic have been during normal days, I am concerned about the additional traffic that could be brought on by emergencies in the depths of the new proposed neighborhoods. One last concern I would like you to consider is the impact and loss of the woodland habitat. The forests that surround the Woodlands are home to deer, elk, and countless other woodland creatures and birds. Residents and visitors to the Woodlands enjoy the sounds and sights of these beautiful animals in our community and would be saddened to see their homes replaced by dwellings for humans. Please consider the safety of the existing residents, and also those unsuspecting, new homeowners should the development proceed. How will we safely navigate the existing streets together, especially in winter when the streets are narrowed or in an emergency? So many people in McCall enjoy strolling and riding their bikes through the Woodlands, it is a very beautiful place that I have enjoyed calling home. The developer of this area has shared a conceptual plan of the Pine Creek Ranch development with the Woodlands neighborhood, where I live, as well as with other stakeholders. I would like to address a specific area of concern that I hope this environmental assessment will include – an evaluation of the traffic safety issues that a subdivision of this size would create on existing neighborhoods and roads. As you know the two parcels in question are directly east of the Woodlands neighborhood, the elementary and middle schools, and the Fox Ridge neighborhood. The Pine Creek Ranch parcels comprise 158 acres which is more than three times the acreage of the Woodlands neighborhood. If developed under R4 zoning, the number of home sites in the Pine Creek Ranch subdivision could exceed the number of home sites in the Woodlands by a factor of more than 5 (approximately 600 vs approximately 115). As another reference point, under R4 zoning the number of home sites in Pine Creek Ranch would be more than double those in Spring Mountain Ranch. This large proposed development currently has no direct road access to a minor or major collector. Under current conditions, there are only 2 practical access points to the Pine Creek Ranch parcels – one through the Woodlands neighborhood and one through Fox Ridge. Both of these access points are local streets that were not designed or built to serve as major (or even minor) collectors from a large subdivision. More specifically, Woodlands Drive is a narrow street with no shoulders, sidewalks, or pathways, and visibility is poor especially on the lower portion of the road. Even with existing traffic conditions, there have been accidents and near misses on Woodlands Drive. Visibility is even worse during the winter due to high snowbanks that make it difficult for neighbors to exit their driveways. Many residents have to back into their driveways so that when they want to exit they can inch their way out slowly into the roadway and hope that they are not struck by oncoming traffic. Furthermore, the location of the Woodlands neighborhood adjacent to the elementary and middle schools must be considered when evaluating traffic impacts. Woodlands Drive provides the only access on public rights-of-way for children to walk or bike to school. Safety on Woodlands Drive must be preserved so that we don’t become a community that buses or drives kids a quarter- or half-mile to school because the roads are too dangerous to walk or bike. Woodlands Drive also provides the only access from the Woodlands neighborhood to the City’s interconnected pathway network. Safe streets, multi-modal transit opportunities and access to the City’s pathway network are fundamental tenets of the McCall Transportation Master plan. Area of Concern Comments Page 11 of 15 A subdivision like Pine Creek Ranch that is of such an enormous magnitude will have wide, significant, long-term impacts on McCall’s population (potentially adding several thousand additional residents), the environment, the infrastructure, and the need for services (such as emergency services, police, schools, healthcare, etc) that must also be considered to determine if existing conditions can absorb such an impact and if this scale of development is desirable for our community. I certainly hope that the city staff, Planning and Zoning Commission, and City Council will look at these issues as the development planning process evolves. However, at this time, my strong request is that any environmental assessment include a close evaluation of the impact of traffic on street safety through existing neighborhoods. I would hope the assessment would also suggest strategies to mitigate that impact, such as by creating an alternative primary access to the Pine Creek Ranch development via an eastward extension of Deinhard Lane or by restricting the number of home sites that would have traffic access through existing neighborhoods. We must remain committed to McCall’s vision of a family-friendly community and to the many City of McCall planning documents that place the highest priority on safety and walkability of our streets. Diane, We certainly will not object to the proposed resolution since we planned on submitting an environmental assessment, economic assessment, soils analysis, etc. with our application. I can meet you on June 25th if that will work for you. I would like to coordinate with the City and it staff to make sure our team of consultants are acceptable and that all points of view are covered. I want to assure you that we have stopped any type of specific land planning until we have completed the environmental assessment, except for coordinating a discussion between stakeholders regarding the intersection of Deinhard and Spring Mountain Ranch Road which includes the possibility of extending Deinhard east. I am very excited about the opportunities surrounding the property and certainly hope the city shares the same excitement. We will do this right! As you may recall she indicated to you some time ago the city’s position that the development proposal for this property should follow a comprehensive land analysis of the natural and built environmental conditions on and surrounding the site. Such an analysis would provide for a holistic view of the opportunities and constraints for development of the site. Since forwarding to you a broad scope of what that would look like, there has been scattered contacts from you and your representatives between city staff, including the city manager, neighborhoods and other public agencies which is exactly what this comprehensive approach is trying to avoid. Completing an inclusive land analysis report that lays out all the issues would provide a resource of common basis of information that everyone can use and would set the stage for a more efficient review of the development application. The subdivision code allows for certain areas to be designated as an “Area of Critical Concern” based on certain criteria which the Pine Creek Ranch qualifies as because of its location outside the city but within the area of city impact. With this designation, an Area of Concern Comments Page 14 of 15 environmental assessment is required prior to action on any subdivision development review. The assessment is to be completed by an interdisciplinary team of professionals. At the City Council meeting on Thursday, we are asking the Council to designate the Pine Creek Ranch properties as an Area of Critical Concern, requiring the preparation of an environmental assessment prior to review of a development application. Attached is a copy of the City Council agenda, the staff report and draft resolution associated with this action. It looks like it is the last action item on the agenda. I am sure there will be an opportunity for public comment and the council will receive written comment in advance. If the City Council adopts this resolution, I suggest that we have a meeting with your representatives who will be completing the environmental assessment for a scoping session. d. Diane T.
