A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON
ACCEPTING THE WORK PERFORMED BY HACKETT SYSTEMS, CASH
CONTRACT #269 INVOLVING THE EMERGENCY OPERATIONS CENTER
IN THE CITY HALL BASEMENT.
' WHEREAS, the City Council did on the 1st day of August, 1977, adopt
Resolution No. 77-155 awarding the contract for the construction of the
Emergency Operation Center (Cash Contract No. 269) to Hackett Systems; and
WHEREAS, said work has been dully performed and completed by said
contractor; and
WHEREAS, said work has been inspected by the Emergency Preparedness
Coordinator and by her approved as constructed and completed in its entirety,
in accordance with the plans and specifications for such improvement project
and authorized revisions therein; and
WHEREAS, said Coordinator does now recommend and request the acceptance
of the work and the filing of a Notice of Completion thereof; and
WHEREAS, the final contract price for said work is the sum of $57,721.00,
which said sum the Coordinator has approved as just and fair; and
WHEREAS, the contract documents provide that a total of 10% of said
total contract price shall be retained until forty-five (45) days after the
recording of the Notice of Completion of said improvement project.
NOW THEREFORE, BE IT RESOLVED, that the Council of the City of Carson
does hereby accept the work performed by said contractor and approves the same
as being completed in accordance with the plans and specifications for said
project and authorized revisions therein; and the City Administrator is hereby
authorized to file Notice of Completion of said project in the Office of the
Los Angeles County Recorder; and
BE IT FURTHER RESOLVED, that the City is authorized and directed to
pay to said contractor, Hackett Systems, the sum of $57,721.00 in full payment
of said work performed by said contractor, less any sums held until the expira-
tion of forty-five (45) days following the filing of said Notice of Completion,
and then paid contingent upon the absence of the filing of any stop notice
against said project within forty (40) days after the filing of the Notice of
Completion; and
BE IT FURTHER RESOLVED, that upon expiration .of said forty-five (45)
days following the filing of said Notice of Completion, without any claim being
ruled against said project, that all bonds filed by the contractor in said
project shall be exonerated and discharged, excepting that the faithful perfor-
mance bond shall remain in force until the expiration of one year from the date
of filing said Notice unless a substitute bond approved by the Emergency Prepared-
ness Coordinator and the City Attorney shall have been filed.
