HomeMy Public PortalAbout78-110RESOLUTION NO. 78-110 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON REQUESTING THE PUBLIC UTILITIES COMMISSION TO REQUIRE A WAIVER OF THE FACILITIES CHARGE FOR STREET LIGHTS TURNED OFF DUE TO LACK OF FUNDS CREATED BY PASSAGE OF PROPOSITION 13. ' WHEREAS, County lighting districts administer approximately 86,000 street lights which are funded from ad valorem taxes; and WHEREAS, approximately 78,000 of the district lights are owned and operated by the Southern California Edison Company under con- tract to the districts; and WHEREAS, it is estimated that revenue provided under Prop- osition 13 will only support the operation of about 30% of these lights; and WHEREAS, the majority of these street lights were installed at the request of the benefiting property owners via the petition proce- dure which indicated the cost and which required the written approval of at least 60% of the ownership; and WHEREAS, the County is investigating methods to provide alter- nate funding for the cost of operating these lights; and WHEREAS, the alternate methods may involve the passage of legislation and/or the vote of the affected electorate; and WHEREAS, it may be necessary to turn off many of the lights in the interim while alternate methods of financing are being developed and ' implemented; and WHEREAS, in 1974, in connection with energy crisis measures, the Public Utilities Commission approved a facilities charge that Edison may assess for lights that are turned off but left in place for future use; and WHEREAS, the facilities charge exceeds three dollars per light per month; and WHEREAS, in most cases the facilities charge would exceed the amount of tax revenue anticipated to be received under Proposition 13 for each light making it impractical to leave the lights in place while alter- nate funding was being pursued; and WHEREAS, charges for removal and reinstallation of the lights, ranging up to several hundred dollars per light depending on the type, could be subsequently assessed against the districts if this course if followed; NOW, THEREFORE, BE IT RESOLVED, that the Public Utilities commission be requested to take action to required a waiver of the facil- ities charges until such time as alternate funding methods are adopted or, in the alternate, a decision is reached to leave the lights dark. BE IT FURTHER RESOLVED, that the City Clerk of the City of Car- son be instructed to notify the Public Utilities Commission and the South- ern California Edison Company of this action.
