HomeMy Public PortalAbout78-133D CJ RESOLUTION N0, 78-133 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON ACCEPTING THE WORK PERFORMED BY AMERICAN TREE SERVICE, CASH CONTRACT NO. 284 INVOLVING THE TRIMMING OF THE CITY PARKWAY TREES. WHEREAS, the City Council did on the 6th day of September, 1977, adopt Resolution No. 77-194, awarding the contract for the trimming of the City Parkway trees (CC No. 284) to American Tree Service; and WHEREAS, said work has been duly performed and completed by said contractor; and WHEREAS, said work has been inspected by the Parks and Recreation Director and by him approved as completed in its entirety, in accordance with the plans and specifications for such imprnnvement project and authorized revisions therein; and WHEREAS, said Director does now recommend and request the acceptance of the work and the filing of a Notice of Comple- tion thereof; and WHEREAS, the final contract price for said work is the sum of $142,000.00 which said sum the Director has approved as just and fair; and WHEREAS, the contract documents provide that a total of 100 ($14,200.00) of said total contract price shall be re- tained until thirty-five (35) days after the recording of the Notice of Completion of said improvement project. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Carson does hereby accept the work performed by said contractor and approves the same as being completed in accordance with the plans and specifications for said project and authorized revisions therein; and the Mayor is hereby authorized to file Notice of Completion of said project in the Office of the Los Angeles County Recorder; and BE IT FURTHER RESOLVED, that the City Council is authorized and directed to pay to said contractor, American Tree Service, the sum of $142,000.00 in full payment of said work performed by said contractor, less any sums held until the expiration of thirty-five (35) days following the filing of said Notice of Completion, and then paid contingent upon the absence of the filing of the Notice of Completion: and D 1 Res. No. 78-133/ Page Two of Two BE IT FURTHER RESOLVED, that upon expiration of said thirty-five (35) days following the filing of said Notice of Completion, without any claim being ruled against said project, that all bonds filed by the contractor in said project shall be exonerated and discharged, excepting that the faithful performance bond shall remain in force until the expiration of one year from the date of filing said Notice unless a substitute bond approved by the Director of Parks and Recreation and the City Attorney shall have been filed.
