HomeMy Public PortalAbout78-165CITY OF CARSON CITY COUNCIL RESOLUTION NO. 78-165 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON GRANTING CONDITIONAL USE PERMIT NO. 176-78 THE CITY COUNCIL OF THE CITY OF CARSON HEREBY FINDS, RESOLVES AND ORDERS AS FOLLOWS: Section 1. An application was duly filed by Rebel Mini -Storages respect to real property described in Exhibit "A" attached hereto, requesting a Conditional Use Permit to expand an existing mini -storage operation on an organic refuse landfill site. On August 18, 1978, the Planning Commission held a properly noticed public hearing on said application. Evidence, both written and oral, was duly presented to and considered by the Planning Commission during the public hearing. The Planning Commission, by Resolution No. 78-437, recommended to the City Council that Conditional Use Permit No. 176-78 be granted. Section 2. The City Council duly held a property noticed pu is hearing on whether to grant Conditional Use Permit No. 176-78 on September 5, 1978 in the Council Chambers, City Hall, 701 E. Carson Street, Carson, Cali- fornia. Evidence, both written and oral, was duly presented and considered by the Council at said hearing. Section 3. The City Council has reviewed and considered t e environmental documents prepared for the proposed project prior to deciding whether to grant a con- ditional use permit for the proposed project. The initial study prepared for the proposed project identifies methane gas hazards and sail instability as the only potentially significant environmental effects. The following mitiga- tion measures have been required in or incorporated into the project so as to avoid these two identified potentially significant env-.,onmental effects: 1. A permanent gas protection system for the structures and property will be installed and the methane gas monitored and controlled so that it is not injurious to the public health and safety nor allowed to migrate to surrounding properties. Said protection: system, monitoring and control will be done to the satisfaction of the City Engineer and City Council. 2. The applicant will be required to comply with all of the recommendations, including those recommendations relating to methane gas hazards and soil instability, contained in the report of the City's independent consulting engineering firm. Based on the aforementioned findings and the findings contained in Planning Commission Resolu- tion No. 78-437 (which are incorporated herein by reference), the City Council grants Conditional Use Permit No. 176-78 ' with respect to the property described subject to the conditions set forth in in Section Exhibit "B" 1 hereof attached hereto. That a revised plot plan, substantially in conformance with the Exhibit labeled "C-1," "D-1," and "D-2" be submitted for approval, subject to the following: 2. That the applicant shall submit and comply with a schedule of development ' from start to completion of the project, subject to the approval of the Community Development Department, Planning Division. 3. That a permanent gas protection system for the structures and property be installed. 4. That methane gas shall be monitored and controlled so that it is not injurious to public health and safety or migrate to surrounding properties, to the satisfaction of the City Engineer and the City Council. 5. That adequate measures be taken to eliminate odors to the satisfaction of the City Engineer. 6. That the City contract with and retain a qualified, licensed, private consulting engineering firm to perform the following: a. The consulting firms selected by the City and by the applicant shall in no way be associated with each other. b. Monitor and approve all developer matters pertaining to methane gas, including but not limited to: gas migrations, gas control, gas production, building and utilities design and construction, paving, subsidence, odors, and all other environmental hazards. C. Verify that all required agencies have received and approved all plans and recommendations related to this project as defined in Item b. d. Submit final reports and recommendations to the City Council for approval. The developer must assume all costs related to the performance of the consult- ing firms. 7. Applicant shall, at its own expense, carry public liability insurance during the existence of this conditional use permit, with a company to be approved by the City Attorney, and with City also named as an additional assured there- under, covering liability for injuries or deaths arising out of or in con- nection with the operation of the mini -warehouse business pursuant to this permit, in an amount not less than $5,000,000.00. 8. That if methane gas, odors,. ground settling, traffic, gas migration, or any other environmental hazards cannot be controlled and mitigated to the satisfaction of the appropriate City, County, State or Federal agencies, that this permit shall be declared null and void. 9. All proposed exterior lights shall be placed and ser so as not to shine onto residential or commercial areas or any public right of way in such a manner deemed to be a nuisance or hazard. 10. That all buildings, grounds, parking area, and landscaping shall be main- tained in a neat and orderly manner. All building shall be painted and maintained with aesthetically compatible colors to the satisfaction of the Community Development Department, Planning Divisive_,. 11. That all utilities for new construction sill be placed underground. The applicant shall use sanitary sewers as the method of sewage disposal. Fire Department requirements are as follows. a. The Fire Flow shall equal 2,000 gallons per minute for two hours. The water mains in the street fronting this property must be capable of delivering this flow at 20 pounds per square inch residual pressure. A minimum 6 inch pipe is required for new chain installations or extensions. b. The applicant shall install one (1) fire hydrant, 6" x 4" x Z'z' brass or bronze, confroming to AWWA Standard 0503-75 or approved equal. All installations must meet Fire Department specifications which may be obtained from the City Planning Office. The hydrant shall be located on the south side of Del Amo Boulevard, 4010 feet west of Main Street. c. Access shall be provided by private driveways,and said driveways shall be indicated as "fie lanes" on the plot plan. That the applicant shall complete all requirements of t'-iis Special Use Permit within a three (3) year period (August 8, 1981). That this permit shall be declared null and'Wgid unless the applicant has commenced development within 180 days of thle1date of approval of City Council Resolution No. 78-165. I 22. It is further made a condition of this approval that if any condition hereof is violated or if any law, statute, or ordinance is violated, the permit shall lapse, provided the applicant ',has been given written notice to cease such violation, and has failed to',do so for a period of thirty (30) days. ,I 1 I
