Zoning District: RS - Core Finished Floor: 8.0 The applicant is seeking to permit construction of a 7,467 sq. ft. two-story, Bermuda -style, single-family dwelling with a 2.5 car garage, spa, covered porch, trellis, gazebo, and swimming pool. To permit the construction of a new 7,467 sq. ft. two- story, Bermuda -style, single-family dwelling with a 2.5 car garage, spa, covered porch, trellis, gazebo, and swimming pool. Effective Lot Area: 24,361 sq. ft. Allowable: 7,472 sq. ft. Height: 29' 8" Eave Height: 21' Issues Considered During Review: Section 66-141: Architectural/site plan review -levels 1, 2, and 3 applicability Section 66-144: Standards regarding Level II and Level III Architectural/Site Plan Review Section 70-4: How to use this Manual Discussion: This property is back before the Town for review with a new owner and modified design. In January 2023 (ARPB) and February 2023 (Town Commission) the Town reviewed and approved an application for a 7,464 sq. ft. two-story, Bermuda -style, single-family dwelling with a 2.5 garage, and swimming pool. That home, also designed by Architect Gary Eliopoulos, was never constructed. This application is similar to what was approved in 2023, with a modified design increasing the rear setback previously approved at 40' per special exception. The rear yard is now larger, meeting the required 50' setback to the home with no special exception required. The design retains the 2.5 -car garage facing the north/ side property line, circular driveway, and motor court in front of the garage, and the second -story portion of the home set back from the first story portions of the home on the north and south side. The second floor living area has slightly increased from what was previously approved, from 2,038 square feet to 2,075 square feet. This is still well below the 50% maximum for second story portions, which for this property would be approximately 2,500 square feet. The Application included solar panels facing the cove. As this is expressly prohibited per Town Code Section 70-218 Roofs. (subsection c. Prohibited "Solar panels facing the street or waterway") Town Staff spoke to the architect who confirmed that the solar panels will be removed and if added back in a permitted location will be on a separate application.
