Regular Meeting of December 28, 2023 Board Member Smith made a motion to accept the minutes of the December 28, 2023, regular meeting. Administer Oaths Town Clerk Basel swore in Adriana Finnvold, Joe Peterson, and Gary Eliopoulos. Minutes of ARPB Regular Meeting & Public Hearing Held 01-25-2024 @ 8:30 A.M. C. Application for Development Approval 1. An application submitted by Adriana Finnvold, Finnvold Architecture, Inc., as agent for Chester Snavely, owner of the property located at 965 Orchid Lane, Gulf Stream, Florida, legally described as LOT 85, OF PLACE AU SOLEIL, AS RECORDED IN PLAT BOOK 27 PAGE 69 OF THE PUBLIC RECORDS OF PALM BEACH COUNTY FL. a. Level II Architectural/Site Plan Review to permit the construction of a 920 sq. ft. one-story addition of a detached three -car garage structure with storage to match the existing house. Ms. Adriana Finnvold gave a detailed PowerPoint presentation. Mr. Joe Peterson gave a detailed landscape presentation. Board Member Lyons stated he had asked the Assistant Town Attorney to check the setbacks as he was a bit confused with the angle and shape of the property. Assistant Town Attorney Nazzaro stated with the shape of this lot there was a mathematical formula that determined the setbacks. Ms. Finnvold stated they had met with the staff prior to determining the design work on this lot and were secure in the fact that they met all setback requirements. Chairman Murphy asked if there had been any comments from the neighbors to which Town Clerk Basel stated that the next -door neighbors had come in to look at the plans and were satisfied with what they saw. Vice Chairman Dockerty made a motion to approve a Level II Architectural/Site Plan Review to permit the construction of a 920 sq. ft. one-story addition of a detached three -car garage structure with storage to match the existing house and to confirm that the detached building does meet the Gulf Stream setback requirements. Board Member Smith seconded the motion with all voting AYE at roll call. 2. An application submitted by Gary Eliopoulos, GE Architecture, Inc., as agent for Jean Aucoin, owner of the property located at 1465. N. Mr. Gary Eliopoulos gave a detailed PowerPoint presentation and noted that this was a unique project because you have two buildings merged together and showed how both properties touch each other. Mr. Bob Ganger, Town resident, stated he was pleased to hear that Mr. Eliopoulos was doing the work as he felt Gary was a very capable architect and outstanding individual. Mr. Ganger went on to state he was in opposition of adding an elevator to this property and then he gave historical background on the property. He added that if it was done, it needed to be done tastefully to match the current historical residence. Board Member Smith questioned the three-story elevator and wondered if it could be two-story and/or in the confines of the house instead of on the outside. Mr. Eliopoulos stated that the applicant was using the third floor as her office, but it did not necessarily have to go to the third floor. He added that once he goes into the structure, he believed that to be more damaging to the structure than adding an appendage onto the structure, which could always be removed. Mr. Eliopoulos felt that to be more preserving to the structure than going into the footprint of the building. Board Member Lyons wanted to know how much of an impact the elevator would have on Mr. Ganger's property since they are attached to which Mr. Eliopoulos stated it would be sealed up with no visibility so he did not see it having an impact in that sense. Chairman Murphy noted that the massing on it was quite great, and it looked like a column stuck on the side of the home and it seemed alien to the property. Mr. Eliopoulos stated that two stories would probably make a big difference. Board Member Smith agreed that two stories would be an improvement. Discussion was had and none of the Board felt comfortable with moving forward on the elevator as presented. Assistant Town Attorney Nazzaro asked if there were any other issues with the guest house portion of the plans to which there were none. Board Member Smith made a motion to recommend approval of a Demolition Permit to do a partial demolition of the existing bathroom at the guest house. Vice Chairman Dockerty seconded the motion with all voting AYE at roll call. Board Member Smith made a motion to recommend approval of a Level III Architectural/Site Plan Review to permit the partial demolition of the existing bathroom at guest house and convert the gym into a garage. Chairman Dockerty seconded the motion with all voting AYE at roll call. Vice Chairman Dockerty made a motion to recommend deferral of the Special Exception per Section 70-75(c)(1) to permit construction of an elevator within a side setback of a non -conforming single-family residence to the February 22, 2024, meeting. Board Member Smith seconded the motion with all voting AYE at roll call. 3. An application submitted by Gary Eliopoulos, GE Architecture, Inc., as agent for Brian and Jennifer Coulter, owners of the property located at 3400 Polo Drive, Gulf Stream, Florida, legally described as PLAT OF POLO COVE LT 10 & N 50 FT OF LT 11. a. Level III Architectural/Site Plan Review to permit the construction of a new 7,467 sq. ft. Bermuda -style 3 Minutes of ARPB Regular Meeting & Public Hearing Held 01-25-2024 @ 8:30 A.M. two-story, single-family dwelling with two -car garage, and pool. Mr. Gary Eliopoulos gave a detailed PowerPoint presentation noting the changes that had been made since this property was approved by the ARPB a year ago and they were no longer asking for a special exception. Chairman Murphy asked if there had been any comments from the neighbors to which Town Clerk Basel stated there had not been any but noted there were neighbors present in the Town meeting that may want to speak. Discussion was had regarding FEMA and seawalls being raised and the challenges that the Town faced for the future regarding these issues. Board Member Lyons asked if consideration would be given to keeping some of the mature trees on the lot. He added that there were shutters missing on a couple of the windows to which Mr. Eliopoulos stated there was no room for shutters on those particular windows. Mary Walton spoke for her mother, Ellen Walton, Town resident, who felt that her property was going to be the most impacted by this property. She stated that what was happening with seawalls right now was overwhelming and overbearing. Ms. Walton stated the level of the earth being lifted was going to change the whole feeling and asked if the Board would drive by and take a look in comparison with her mother's property at 520 Banyan Road. She added it was going to mess with their viewshed. Town Manager Dunham stated that these new requirements by FEMA were going to have a major impact on Gulf Stream and other communities along the waterways. Mr. William Boardman, Town resident, asked if the swimming pool on this property was in the same place as the last application to which Mr. Eliopoulos stated it was set further back than the original. Mr. Boardman wanted to reiterate that the staff needed to apply the similar/dissimilar rules that the Town adopted to every application and make it protocol. Board Member Roach stated that at some point, every lot in town was going to have to follow the new FEMA regulations and more discussion was had regarding this issue. Board Member Lyons made a motion to recommend approval of a Level III Architectural/Site Plan Review to permit the construction of a new 7,467 sq. ft. Bermuda -style two-story, single-family dwelling with a 2.5 car garage, spa, covered porch, trellis, gazebo, and swimming pool. Vice Chairman Dockerty seconded the motion with all voting AYE at roll call. VII. Items by Staff Assistant Town Attorney Nazzaro stated pursuant to direction from the Commission the ARPB was to begin conversation regarding massing. After discussion, it was decided to possibly put together an Ad -Hoc Committee and pursue getting a consultant/planner/architect to help in this process. Alternate Board Member Coulter agreed that an outside planner needed to be brought in and suggested community involvement and input may be helpful in the community understanding what was happening with elevations and FEMA regulations. Mr. Bill Boardman suggested, as in the past, a landscape architect as well as a regular architect to be a part of the committee.
