Dear Mr. Thrasher:
I am writing you to follow up on some previous public records requests.
In addressing an existing home's non - conforming roof and the applicability of the Town Code,
you have previously stated that:
"In regards to the differential between predominant styles and other variants and
that there are shake and shingles, other types of materials, the current code was
adopted after the construction of those homes. And therefore, we would assume
that when they were constructed and the roofs were placed, that it met the current
code, but presently, when you come to an entire reroof or a new structure. the
present dated code would be the determining factor."

Also, in addressing any non - conforming landscaping uses that may be required to be brought
into conformity with regards to 960 Indigo, Gulf Stream, FL, you stated:
"...in the event that there would be proposed landscape alternations to the private
property that would require a permit, the landscaping would be required to be
brought into conformity. That determination would be made through the Level 11
review process and in a public hearing. If nothing happens to the existing
landscape located beyond the ROW line, the landscape non - conforming material
could remain. The requirement for any permit triegers the need for conformity to
the code(s).

Pursuant to the Public Records Act, Chapter 119 of the Florida Statutes, I need to make a public
records request for copies of the following:
L Any specific section of the Town Code that codifies the existing policy - ilia policy you
stated above - to allow a iron- corrforrnftng use until a pertnit triggers file need for the

2. Any specific policy and ilia enabling action by the Town Conrrnisslan that establisher
the existing policy - the policy you stated above - to allow a non- conforming use until a
permit triggers the need for the non- conforming use to be brought into compliance?
In your responses to some previous public information requests, you provided an Architectural
Style Analysis card for 2520 Avenue An Soleil indicating it as "Gulf Stream Bermuda Style," yet
in the Gulf Stream Design Manual, more specifically page CD 70:82, 2520 Avenue Au Soleil is
indicated as "Other /Various Styles."
Pursuant to the Public Records Act, Chapter 119 of the Florida Statutes, I need to make a public
records request for copies of the following:
3. Any and all notes, documents and/or workproduct of Town employees or consultants
that indicates the basis of, when and corder what mechanisnn the Architectural Style
Analysis far 2520 Avenue Art Soleil was changed from "OOrerlVarious" to "Gulf
Stream Bermuda "? and
4. Any and all copies of sections in the Town Code, or Intervening Commission actions,
that allow for the Architectural Style Analysis for 2520 Avenue Are Soleil to be made
without a fortnal charge to page CD 70:82 in the Town Cade.
If you refuse to provide this information, Chapter 119 requires that you advise mein writing and
indicate the applicable exemption to the Public Records Act. Also, please state with particularity
the reasons for your decision, as required by Section I19.07(2)(a). If the exemption you are
claiming only applies to a portion of the records, please delete or redact that portion and provide
photocopies of the remainder of the records, according to Section 119.07(2)(a).
If you can provide an estimate ofthe cost of duplication, l would appreciate it. If acceptable, I
will pay the actual cost of duplication as defined in Section 119.07(I)(a). However, if you
anticipate that in order to satisfy this request, "extensive use" of information technology
resources or extensive clerical or supervisory assistance as defined in Section 119.07(1)(b) will
be required, please provide a written estimate and justification.
If at all possible, I would request that these records be made available by this next Thursday,
February 14th.
