Regarding the electrical /landscape lighting work at 2586 Avenue Au Soleil, and per the subject of my original Feb. 5, 2013 Public Records Request, Mr. O'Hare had observed the electrician for 2586 Avenue Au Soleil trenching across that lawn and installing electrical conduit and lighting where none had previously existed. In my letter, I asked if Mr. O'Hare could install landscape lights in the Town's ROW along his property, as the owner of 2586 Avenue Au Soleil had just installed on the ROW adjacent to that property. In Mr. Thrasher's Feb. 7, 2013 response (copy attached), he stated that the Town had asked the owner at 2586 Avenue Au Soleil to remove the lighting recently placed farther into the Town's ROW; and at the owner's request, the Town agreed to allow the owner to place the lighting within the existing planted area since "there was no further infringement into the Town's ROW." Mr. O'Hare then observed that the lights had been relocated adjacent to the existing plantings already within the ROW. Mr. O'Hare then checked the Delray Beach permit records and found that no electrical permits for such work had ever been issued. I then made another public records request on Mr. O'Hare's behalf on Feb. 8, 2013 requesting documents pertaining to the Town's handling of the electrical work at 2586 Avenue Au Soleil - apparently done without a permit. In your most recent letter of May 27, 2013, you responded that "no permit was required for this [work because] there was an existing circuit in place." This is confusing. As such, Mr. O'Hare would like further clarification. Pursuant to the Public Records Act, Chapter 119 of the Florida Statutes, I am herewith making a public records request for copies of the following items: Letter to Rita Taylor Public Records Request May 28, 2013 Page 2 of 2 Any and all electrical permits for 2586 Avenue Au Soled as it relates to the landscape lighting as referenced above, and as the Town allowed and/or directed to be relocated. If you refuse to provide this information, Chapter 119 requires that you advise me in writing and indicate the applicable exemption to the Public Records Act. Also, please state with particularity the reasons for your decision, as required by Section I I9.07(2)(a). If the exemption you are claiming only applies to a portion of the records, please delete or redact that portion and provide photocopies of the remainder of the records, according to Section 119.07(2)(a). If you can provide an estimate of the cost of duplication, I would appreciate it. If acceptable, I will pay the actual cost of duplication as defined in Section 119.07(1)(a). However, if you anticipate that in order to satisfy this request, "extensive use" of information technology resources or extensive clerical or supervisory assistance as defined in Section I I9.07(1)(b) will be required, please provide a written estimate and justification. I would ask that you provide all the above requested records no later than this WEDNESDAY. JUNE 5.2013.
