Artificial Turf Discussion: The applica nt is replacing pa rt of the grass on the so uth side of the yard th at is c oncealed fr om the street with a rtificial turf. This is the second application fo r Artificial Turf since the T own Commission passed O rdinance 23-02, which created a new section 70-152. Artificial Turf . which reads as fo llo ws: Sec. 70-152. - A rtificial Turf. A rtificial Turf is permitted with the follo wing restrictions in certain limited locations: (1) General. a. The installation of artificia l turf requires To wn approva l. b. A rtificial turf areas may not be included in o pen space calculatio ns. c. Artificial turf shall be co nsidered impervio us and shall not count to wards landscaped open space. (2) Materials. a. The grass blades of artificial turf shall be ma de of polye thylene. Artificial turf grass blades made of po lypro pylene or nylon are prohibited. b. Artificial turf using rubber crumb as a cushio ning or tha tch material is pro hibited. c. All artificial turf shall be lead free a nd use recycled or organic plant -derived materials and natural infill co mponents, including, but no t limited to , cork, coco nut, corn husk, rice husk, and sand. D ocumentatio n must be provide d that identifies all recycla ble or natural co mponents of the a rtificial turf system. d. A sample of the artificia l turf pro po sed for use shall be provided as part of an application for Town appro val and shall be an acceptable aesthetic substitute fo r natural gra ss. (3) Location s. a. Artificial turf may be installed in limited areas of rear and side yards which a re not v isible from any street or waterway, or as a driveway accent in any yard, example to include strips of artificial turf placed between stone or concrete driveway pa ds. b. No artificial t urf shall be installed in the public right-of-way or closer than three (3) feet to any pr operty line . (4) Miscellaneous . a. Artificial turf installati ons shall have a minimum permeability of 30 inches p er h our per square y ard and minimum tufted weight of 56 ounces per square yard . b. All artificial turf shall have a minimum eight -year manufacturer's warranty that protects against c olor fading and a decrease in pile height . c. All materi als must include test d ocumentation which declares that the artificial turf yarn and backing materials are disp osable under n ormal c onditions, at any U.S. landfill stati on (T otal C ontent Leach Pr otoc ol (TCLP) test). d. Pro per drainage shall be pr ovided for all artificial turf inst allations to prev ent excess runoff or pooling of water as evidenced by a dr ainage plan. e. A rtificial turf shall be visually level, with the grain p ointing in a single direction. f. An appro priate barrier device (e .g., concrete mow strip, bender board, brick pavers, river rock, landscaping) is required to separate artificial turf from soil and live vegetatio n. g. Precautions fo r installation ar ound e xisting trees shall be restricted to ensure tree roo ts are not damaged with the installati on of the base material and th at th e overa ll health of the tree will not be compr omised . Ordinance 23-02 also amended Section 66-141. Projects requiring Level 2 architectural/ site plan review. to include "applicatio ns that seek to use or increase the use of artificial turf." Applicati ons for artificial turf are required to o btain ARPB approva l. A cco rding to the applicatio n for the ho me in 2015, the landscaped open space area (pervi ous) was 9,136 sq. ft. Co nverting 1,100 sq. ft. to artificia l turf reduces that figure to 8,036 sq. ft ., which meets the required 40% landscape area a nd 6,603 sq. ft. Town staff notes that the criteria within the To wn Code restrict the lo cation of artificial t urf to "limited areas of rear and side yards which are no t visible from any street or waterway ." The a pplicatio n do es no t appear to include artificial turf in any areas visible from the street or waterway due to the ex istence of significant landscaping features. The first a pplication to receive approval under the new Sectio n 70-152. A rtificial Turf. was fo r 900 sq. ft. of artificial turf in a side yard on a lot that was 25,000 sq. ft. and faced the intraco astal waterway. This lot is 16,500 sq. ft. Town staff have asked the applicant to pro vide a sample of the proposed a rtificial turf for your review at the meeting. We have not performed a TCLP landfill test because we do not know of an applicable ASTM test or testing method that applies to turf. However, I have attached applicable test results that apply to the individual properties of our turf which should more than satisfy this requirement. I have also attached the below: • 1. Warranty info (minimum 8 years) o See the attached (15 year) residential and (8 year) commercial warranties that are applicable to Aquamax. • Results of TCLP test showing materials are disposable at landfill station s 1 o FieldTurf takes product safety very seriously and I hope that the attached will assist in showing the efforts we go to ensure the safety of all of our products. The document "Safety Proven With Science" is a wealth of information for addressing environmental and health questions. The below covers the fibers we use in manufacturing our turf, as well as our finished installed turf products. CA Prop 65: • Note that all FieldTurf and FieldTurf Landscape styles meet all CA Pr op 65 requirements which in most cases are more stringent than the US Product Safety Commission's (CPSC) requirements . Please let me know if you have any questions . Safety Pro ven With Science: • Page 4 addresses air quality and volatile organic chemicals (VOCs), and it indicates that our turf do es not leach VOCs. Please remember that this 3rd party ASTM testing was done with rubber crumb infill and still provided great test results. Note, we typically do not use rubber infill on FieldTurf Landscape division projects. • Crumb Rubber is addressed throughout this document . However, even though crumb rubber has been proven safe, FieldTurf Landscape products do not require crumb rubber infill and is not commonly used. PFAS (Forev er Chemicals) • Please find the attached testing report showing that our products do not have Per- and Polyfluorinated Substances (PFAS). FieldTurf Heavy Metal ASTM Test Results • 3rd party ASTM testing indicates that our turf meets, or is below, any heavy metal testing requirements. That being said, heavy metals cannot leach into the soil from our turf . ("FieldTurf Landscape") provides the original purchaser ("Purchaser") of FieldTurf Landscape Artificial Grass products ("Product") with a Limited Warranty ("Warra nty") as s et f orth herein. This Warranty shall be in f orce and remain in effect for a period of eight (8) years from the dat e of substantial c ompl eti on of the installati on of the Pr oduct ("Effective Date") . WARRANTY REMEDY LIMITED TO REPLACEMENT PRODUCT FieldTurf Landscape will, at its discretion, repair or replace o nly the affect ed are a of the Pro duct during the period of this Warranty, subject to specific te rms and con ditio ns co ntained herein. This Warranty ex clude s all co st associated with remo val of the defective Pro duct and installation of the replacement Produc t. No cash rebate s will be made. This Warranty co vers first quality Pro ducts o nly, and is not applicable to Pro ducts so ld as se co nds or irregulars. All Warranty claims must be submitted to FieldTurf Landscape as set fo rth in the " Claims Pro cedure " sectio n here in. In the event that the Pro duct in questio n is discontinued, FieldTurf Landscape will replace the de fective Product with a comparable Product of equal value. Damage caused by the application of cleaning agents or che micals, adhesives, animals, or gen eral negligence. 9. Any damage caus ed to the Pr oduct by the subsurface or conditio ns are not covered by this Warra nty. 14. Damage cause by th e use of spiked sh oes, ste el cl eats, or oth er similar footwear f or which the Pr oduct was not i ntended. NO EXPRESSED OR IMPLIED WARRANTIES No third party warranties, expressed or implied, are covered under this Warranty. No individual, whether an installer, employee of FieldTurf Landscap e or FieldTurf Landscape, agent, fabricator, or other may auth orize liability on b ehalf of Fi eldTurf Landscape . FieldTurf Landscape Artificial Grass is designed to withstand certain n ormal 'wear and tear' and as such, this is n ot c onsid ered a manufacturer's defect . Any product upon which walking, running and playing is to take place, n ormal wear and t ear, including matting, should be exp ected. LIMITATIONS ON LIABILITY FieldTurf Landscape's liability u nder this Warranty is limited to the value of the material in questi on. ASSIGNMENT Purchaser may no t transfer, convey or otherwise assign any or all of its rights under this Warranty without prior written c onsent of FieldTurf Landscape . Any su ch transfer or assignment without prior written consent shall be null and v oid and of no fo rc e or effect. CLAIM S PROC EDURE All warranty claims must be made in writing, within thirty (30) days of disco vering the alle ged defect, sho rtage or no n -co nformity giving rise to the claim. Include proof of purchase from a FieldTurf Landscape authorized agent with the warranty claim.
