June 2nd, 1935 The regular meeting of Council was held to-day at 4 P. ...•, and was attended by Mayor Lewis* who presided, and. Councilmen Righton, Demere, Blumenthal, Logan, and. Town Attorney McIntyre. The minutes of the meetings of May 5th and 29th were read and approved. Councilman Logan moved that the several amendments to the Town's charter under the Act of General Assembly approved. August 1st, 1929 be,adopted, this was seconded by Councilman Blumenthal, and the motion carried. Amendment to CHARTER To revise, alter and amend the several Acts relating to and incorpor- ating,the Mayor and. Councilmen of the Town of Tybee, now known under the Act of General Assembly, approved Atgust 1st, 1929, as Savannah Beach, Tybee Island, and for other purposes. SECTION.A. Be it enacted by the General Assembly of the State of Geor- gia, and it is hereby enacted by the authority of the sane that from and after the passage of this Act, there is established a police dis- trict for protection to Savannah Beach, at Tybee Island, which embraces the lands in the territory comprising Tybee Island, Chatham County, Geor- gia. SECTION 2. Be it further enacted by the authority aforesaid that the Mayor and. Councilmen of Savannah Beach, Tybee Island, shall have and exercise police powers and police jurisdiction over and in said police district. SECTION 3. Be it further enacted by the authority aforesaid that all laws and ordinances in force in Savannah Beach, Tybee Island, or that may be hereafter enacted by the Mayor and Councilmen of Savannah Beach, Tybee Island, in referencercto offenses,against the public health, against public peace and tranquility, and against public morals, as well as all ordinances for the preservation of peace and good order and safety of property shall be in force within the territory comprising the said po- lice district in the same manner and to the same extent as they are in force within the corporate limits of said municipality, and for all other purposes to prevent the commission of any and all offenses and suppress- ing the same in order to apprehend violators of said laws. Police juris- diction is hereby expressly given to Savannah Beach, Tybee Island over the same entire territory embraced in said police district. To this end the said Savannah Beach, Tybee Island, shall have the power to enforce said Isms and ordinances by the police department of said municipality just as it may deem proper and necessary for the full protection of the municipality. Provided nevertheless that no obligation shall rest upon the municipal authorities to establish any police system within said District, but the said Savannah Beach, Tybee "'s/and, is hereby given po wer and right to do so, which right the said Savannah Beach, Tybee Island, may exercise in full, partial or not at all, as in its judgment the best interest of Savannah Beach, Tybee Island, may require; and if this power be exercised then offenders arrested undet such power shall be tried be- fore the Police Court of said municipality and upon conviction thereupon be sentenced in accordance with the ordinances of said municipality governing such offense. SECTION 4. Be it further ordained by the authority aforesaid that Sav- annah Beach, Tybee Island, shall have the right to create the office of inspector of plumbing in and for said municipality and such inspector Shall be a resident of Chatham County, Georgia, and shall be appointed by the Mayor, with the approval of the Councilmen, and he shall be paid such salary or compensation as from time to time may be fixed and deter- mined by the Mayor and Councilmen of said municipality. Said inspector shall be subject to be discharged at any time by the Mayor for causes deemed sufficient by the Jayor. No one shall be eligible to said posi- tion as inspector of plumbing, who is not a practical plumber, as the same is defined and proclaimed by the ordinances existing in the Mayor and. Aldermen of the City of Savannah at the time of appointment. Such inspector so appointed shall, before entering upon the discharge of his duties, take and subscribe an oath, to faithfully and impartially dis- charge the duties of his office, such oath to be taken and filed with the elerk of Council. No person, who has any interest, directly or indirectly, in any plumbing business located within the corporate li- mits of said municipality, shall be qualified to hold such office. Such inspector, at the time of his appointment, and as a condition pre- cedent to entering into the duties thereof, shall give bond with a sure- ty company acceptable to the Mayor of said municipality, as surety, in the sum of $1,000.00, conditioned for the faithful performance of his duties as such inspector. The duties of the office of inspector of plumbing shall be those pre- scribed from time to time by ordinances adopted by Savannah Beach, Ty- bee Island. SECTION 5. Be it further enacted by the authority aforesaid that the authority is hereby vested in Savannah Beach, Tybee Island to make, charge or fix fees for all work or inspection done by the inspector of plumbing and in the discharge of his duties as such, of an amount or amounts to be from time to time determined by Savannah Beach,,Tybee Is- land and proclaimed by ordinances* Such fees shall be collected from the owner of the property upon which the work is done or the inspection made, within five days after the doing of any work or the making of any inspection in connection with the office of inspector of plumbing, and in the event such charge or fee is not paid, that then the said Savannah Beach, Tybee Island, shall have the right to issue execution therefor and enforce the same in the manner prescribed for the enforcement of ex- ecutions issued under any authority given said municipality; provided however that if upon inspection it is determined that work is necessary to remedy the existing situation, that no work be done or material be furnished or contracted for until the owner of said property be noti- fied and given five days to remedy the situation as discovered by such inspector. SECTION 6. Be it further enacted by the authority aforesaid that Sav- annah Beach, Tybee island, shall have the right from time to time to esabiish by suitable ordinances fire limits within the corporate li- mits of said municipality as such may exist at the time of the enact- ment of such ordinances and within which fire limits no building or structure shall be erected, or shall continue, in violation of any pro- vision of such ordinances defining the type of construction or the kind of material to be used in an effort to reduce the hazard of fire within the corporate limits of such nomicipality, and the said municipality 95 shall have the further right and power to condemn and cause to be re- moved, at the cost of the property owned upon whose land said offend- ing building or structure is located. The said municipality shall first* however, give to said owner five days written notice to remove such building or structure and upon a failure to comply with said no- tice* to proceed to remove at the cost of said owner and thereafter, to proceed to collect the coat therefore by execution, to be issued and enforced* in the manner prescribed for the enforcement of execu- tions issued under any authority given said municipality. SECTION 7. Be it further enacted by the authority aforesaid that, in addition to the authority given in Section 6 hOreof, said municipality has the authority to ordain by ordinances that any owner violating the provisions of any fire ordinance, or permitting structures offensive to ordinances to remain after the five day period hereinbefore provided for notice, or any person occupying said premises after said period of no- tice, may be tried before the Po/ice Cpurt of said municipality and up- on conviction be punished to pay a fine of not more than $100.00 or be sentenced for not more than 30 days; either or both, or any part of either or both, in the discretion of the Judge presiding in said. Police Court. For the purpose of the authority herein given, each day, except- ing Sundays and legal holidays, ensuing after the expiration of the five day period of notice without compliance with such notice, shall be deemed a separate offense and be punished as such. A Board consisting of the Chief of PoIice, The Clerk of Council and the Building Inspector, for the time being, of said municipality is hereby created to enforce the provisions of Sections 6 and 7 hereof, a majori- ty of vote of said Board being binding, with the right of appeal to Council from any decision of said. Board under rules to be prescribed by Ordinance. SECTION 8, Be it further enacted by the authority aforesaid that said municipality is hereby authorized to set aside any portion or portions, of the public domain, existing within said municipality between 14th and 18th Streets, as now generally known as the Strand, or other por- tion of the public domain, but expressly excluding Streets, lanes or roads, as designated spaces for the parking of automobiles or other vehicles and to prescribe rules and regulations for the use of the same and to prescribe and charge fees for the occupation and use thereof and to ordain by ordinance that any owner of such automobile or vehicle or any person in charge thereof violating any rule or regulation prescrib- ing the use or occupation of any such parking space shall, upon convic- tion before Police Court of said municipality shall be punishable by a fine not to exceed $100.00 or a sentence of imprisonment not to exceed 30 days, either or both, or any part of either or both, in the discre- tion of the Judge presiding in said Court. SECTION 9. Be it further enacted by the authority aforesaid that said municipality is hereby authorized by appropriate-ordinances to require bath house proprietors within the corporate limits of the municipality in addition to the life guard and the boat which he is now required by law to furnish, to have and furnish at his particular section of the bathing beach suitable ropes reaching from post to post ao as to fur- nish an added means of safety and protection for bathers and that any person violating the provisions of the ordinances passed pursuant to the authority here granted shall upon conviction before the police court of said municipality be punished by a fine not to exceed $100 or sentenced to imprisonment not to exceed thirty days, either or both, or a part of 96 either or bath, in the discretion of the judge presiding in said Court. SECTION -10. Be it further enacted by the authority-aforesaid that all laws in conflict with this Act be and the same are hereby repealed. The Central of Georgia Railroad having agreed to sell the ticket office, pergo/a and benches under the offer made to them by the Town, Councilman Logan moved that the Mayor be empowered and directed to make the purchase after the Town Attorney had passed on the titles, etc., conveying the property to the Town, Councilman Righton seconded, and the motion passed. Discussion was had relative to the appearance on the beach of some male adults clad only in bathing trunks and it was the opinion of Council that this practice be discontinued at once and the Chief of Po- lice so notified to carry out these instructions. Councilman Blumenthal moved that the Savannah Electtic Company be approached with a view of their taking over the $22,000 electric plant bond issue providing the Town will pay them their old bill of $5,732.13, and also that a committee of 3, including the Mayor be ap- pointed to call on the Electric Company, Councilman Demere seconded, and the motion passed. Mayor Lewis appointed the following Committees Mayor Lewis and Councilmen Cann and. Blumenthal. Bills amounting to $8,012.95 were presented and were referred to the Finance Committee for approval with power to pay. A letter was read from the Savannah Ship Chandlery and Supply Oo. requesting that they be permitted to quote on any fire equipment pur- chased by the Town. A petition was read from Mr. A. F. o].ms requesting that he be refunded taxes paid by him on improvements for the year 1932. The Town Attorney was of the opinion that this could not be done, but Council- man Demere moved that as Kr. Solms had paid $50 on his license that this be refunded him, Councilman Logan seconded, and the motion passed. A petition of Mr. A. B. Lovett requesting that the pro-rated taxes for 1932 charged to him be cancelled, Councilman Demere move& that this be done, deconded by Councilman Logan, and passed. The Clerk was instructed to arrange this matter with Mr. Lovett. A petition of Mrs. Mary C. Goette requesting that a light be placed near her property on Chatham Ave., but Council was of the o- pinion that as it would be necessary to contract with the Savannah Electric Co. on a 12 months period to have this light installed, the Town was not financially able at this time to do so. Complaint having been made by Mr. Ross Holland against his not being permitted to use the parking area and after considerable discussion the matter was referred to Town Attorney F. P. McIntyre, Reoordir O. E. Broght, and. Councilmen J. F. Cann and R. M. Demere for--their opinion as to the powers of the Town as defined in Sec- tion 8 of the Act of General Assembly, approved August let, 1929. Councilman Demere moved tha adoption of an Ordinance requir- ing bath house operators to provide posts and ropes for the safety 1 of their patrons, seconded by Councilman Righton, and passed. ORDINANCE'. AN ORDINANCE to be entiteled " An ordinance to require bath house operators, within the corporate limits od the muni- cipality of Savanna Beach, Tybee Beach, Georgia, in addition to the life guard and boat which are now required by law to be furnhished by bath house proprietors, to have and furnish at the particular section of the bathing beach of sadi pro - prieltor suitable ropes from post to postso as to furnish an added means of safety and protection for bathers; to provide penalties for violation of this Ordinance, add for other purposes ". SECTION 1 -- BE IT ORDAINED by the Mayor and Council- men of the Town of Savannah Beach, Tybee Island, Ga., in coun- cil assembled, that from and after the passage of this ordinance, all bath— houses operators within the coporate limits of Savannah Beach, Tybee Island, Ga., in addition to the life guard and boat, which bath house proprietors are now required by law to furnish, shall have and furnish at the particular section of the bathing beach of said bath house proprietor suitable ropes from post to post so as to furnish added means of safety and protection to bathers. SECTION 2 -- BE IT FURTHER ORDAINED by the authority aforesaid, that any bath house propthtor violating the the provisions of this ordinance shall, upon conviction tefore the Police Court of said municipality, be punished by a fine not to exceed 100.00 or saatenced to imprisonment not to,exceed thirty days, either or both, or any part of either or both in the discretion of the Juelge presiding in said Court. SECTION 3 -- BE IT FURTHER ORDAIN`rD that this ordinance is enacted under authority and pursuant to Section 9 of the Acts of the General Assembly of Georgia, approved August ta6th, 1931. SECTION 4 -- BE TIT FURTHER ORDAINED by the authority aforesaid thattall ordinances or parts of ordinances in conflict herewith, be and the same are hereby repealed.
