11.(7.1 The Council of the City of Medina met in regular session on Tuesday, January 20,
1987 at 7:30 P.M.
Present: Mayor, Thomas Anderson; Councilmembers, Wilfred Scherer, Stephen Schmit;
Clerk -Treasurer, Donna Roehl; Public Works Director, James Dillman
Absent: Councilmembers, Robert Mitchell and Anne Theis
1. MINUTES OF JANUARY 6, 1987
Moved by Scherer, seconded by Schmit to approve the minutes of Januaary 6, 1987, as
presented.

CONSENT AGENDA *
* 2. MEDINA MANOR -TAMARACK DR. STREET IMPROVEMENT
Moved by Scherer, seconded by Schmit to grant final approval to the Medina Manor -Tamarack
Street Improvement project, with final payment to Bufffalo Bituminous in the amount
of $ 18,286.53 with final project total of $133,404.

* 3. BRUCE NEUMANN, VARIANCE
Moved by Scherer, seconded by Schmit to adopt Resolution 87-6, denying setback variance
request of Bruce Neumann at 45 Hamel Rd.

* 4. ELM CREEK ESTATES
Moved by Scherer, seconded by Schmit to release $4000 of the Jim Lutz Letter of Credit
with a new balance of $145,835.76.

5. ART PEABODY, MELODY MEADOWS, ESCROW FUNDS
Art Peabody appeared to discuss the release of $11,700 posted for completion of Melody
Lane in Melody Meadows subdidvision.
Ron Batty stated that he had prepared a new development agreement of the southerly
property which included construction of a southerly road. He stated that he did
not believe that a 1974 document gave the city a 60 ft. easement for road purposes,
but it did specify that when a third house was built the easement would be given.
Art Peabody stated that he did not authorize that a new development agreement should
be drafted and that he believed the city could not hold his funds posted for one road,
to guarantee completion of another.
Ron Batty asked if Mr. Peabody would agree to sign a contract for the southerly road.
Mr.Peabody stated that he would agree to be a party to the agreement along with Meyers,
Peterson, Kyllonen, etc.
Stephen Schmit asked if a portion of the funds should be released with retention of
a portion of them when the southerly road is established.
Art Peabody stated that the Council could require the road completed before a building
permit was issued
Ron Batty stated that the city could combine the two lots so the road would not be
necessary. He stated that an easement needs to be drafted with all parties signing,
including Eugene and Joanne Stumpf.
He stated that a Development Agreement needed to be drated for construction of the
southerly road.
Mr. Peabody stated that he wanted control over the road building.
Moved by Anderson, seconded by Scherer to release the Peabody Escrow Funds in the
amount of $11,700 minus the cities administration costs, provide Art Peabody with
an itemized bill and if an easement and construction of the southerly road is not
secured the city is allowed to change the subdivision by combination of two lots
so that none of the lots access the southerly road, with resolution of the matter to
be completed within three months from this date.
Motion declared carried
Art Peabody asked if the centerline of the road could be moved as far south as possible
so as to allow as much area, as possible for the Eugene Stumpf garden.
6. NORTH/SOUTH ROAD
Wilfred Scherer explained that the Medina would need to designate a route from Hwy. 55
to the cities southerly boundary before Hennepin County would consider including a
north/south road in their long range plans.
Moved by scherer, seconded by Schmit to hold an informational public meeting on February
3, 1987 at 8:00 P.M. with news articles to be placed in all of the local newspapers.

7. ELM CREEK/PIONEER CREEK WATERSHED DISTRICT PLANS
Moved by Anderson, seconded by Schmit to hold a public informational meeting on February
3, 1987 to discuss the Elm Creek and Pioneer Creek Watershed plans with representatives
of the Commissions and to request that the city engineer review the flood elevation
statistics to determine if they are accurate.

8. MINNEGASCO HOUSEDOCTOR PROGRAM
Moved by Schmit, seconded by Scherer to appoint Tom Baer and Bruce Luxford to the West
Hennepin Human Services/Minnegasco HOusedoctor Commission.
Motion declared carried
9. BILLS
Moved by Scherer, seconded by Schmit to pay the bills: Order Checks #5456-5467 in the
amount of $21,370.81 and Payroll Checks # 9595-9612 in the amount of $12,337.05.
