MEETING HELD IN THE TOWN HALL IN SAID TOWN OF AULT ON THE 10TH DAY OF AUGUST AT 7:00 P.M. PRESENT: MAYOR Gary D White Trustees: Adam Ferrell Scott Riley Corry Cole Judy Ruff Michael Biwer Tyrell Anderson ABSENT: ALSO PRESENT: Town Clerk Sharon Sullivan Town Attorney Jed Scott Police Chief Tom Nissen PW Supervisor Grant Ruff Sergeant Dakota Germer Records/Licensing Matt Ramos AUDIENCE: Nicole Riley, Andrew Jackson, Cory Magg, Natures Herbs, Lupe Villafana REGULAR MEETING 2022-08 August 10, 2022. MEETING PROCEDURE: Comments from the Public are welcome at two separate times during the course of the meeting: 1) Comments on items not scheduled on the agenda will be heard under public comments. 2) Comments on all scheduled Agenda items will be heard immediately following the presentation by Staff or the Petitioner. Please wait until you are recognized by the mayor and keep comments as brief as possible. The Town Board of Trustees will act on an Agenda item after comments from the Staff and the Public has been heard. The meeting was called to order by Mayor White at 7:00 p.m. I. PLEDGE OF ALLEGIANCE II. ROLL CALL: All members were present, with the exception of Trustee Anderson. III. APPROVAL OF AGENDA: New business #3 and #4 will be tabled. MOTION WAS MADE BY TRUSTEE COLE and seconded by Trustee Ruff to approve the agenda as amended. Motion passed with a unanimous vote. IV. CONSIDERATION OF MINUTE APPROVAL Regular Meeting 2022-06, July 13, 2022: A correction was made to the motion for the AFF request, with the Mayor breaking the tie. A MOTION WAS MADE BY TRUSTEE RUFF and seconded by Trustee Cole to approve the Regular Minutes 2022-06 as amended. Motion passed with a unanimous vote. V. COMMITTEE REPORTS Finance- The audit report will be in September. All funds running in the black. Library -Activities are up 26%, visits are up 132%. The Library Director resigned. There are three interviews for the position. Parks and Cemetery- Trustee Ruff has received two quotes for the splash park at West Park. The dead trees are down at the library. There was minimal impact on Hwy 14. Three meters were relocated. The fire pump is offline and a new one is ordered. Streets- Schneider Paving milled two streets and will do two alley pans and patching. The curb at Continental Supply has been redone. Police- There was a combination of 646 calls for service for the months of July. The Town of Ault had 443, with 159 in Pierce and the remainder in other agencies at 44. There were 144.95 hours spent in Pierce for July. AFF did not follow guidelines agreed to for the Parade. Beautification- No report. Planning Commission- No report. Staff Reports: A conversation on the Board's wishes for enforcement of Home -Based Businesses determined that the staff will pursue compliance for those running a home -based business. VI. APPROVAL OF ACCOUNTS PAYABLE: A MOTION WAS MADE BY TRUSTEE RUFF and seconded by Trustee Biwer to approve the accounts payable July 13 to August 10, 2022. Motion passed with a unanimous vote. VII. REFERRALS REQUESTS AND PRESENTATIONS 1). Consideration of Participation in the On Demand Transit program with Weld County for 2023/2024: After discussion, A MOTION WAS MADE BY TRUSTEE COLE and seconded by Trustee Ruff to show intent of interest to participate in the program, but final figures are needed. Motion passed with a unanimous vote. 2). Renewal of a liquor license for Casa Margaritas Inc: A MOTION WAS MADE BY TRUSTEE COLE and seconded by Trustee Ferrell to approve the liquor license renewal for Casa Margaritas. Motion passed with a unanimous vote. VIII. PUBLIC COMMENTS: The purpose of the Public Comments Section of the Agenda is for members of the public to speak to Town Council on any subject not scheduled on the Regular Agenda. In order to accomplish scheduled agenda items, comments should be limited to a five-minute time period. Town Council shall make no decision or action, except to schedule the matter for Council discussion at a later date. THOSE ADDRESSING COUNCIL ARE REQUESTED TO COME TO THE PODIUM AND TO STATE THEIR NAME TO THE BOARD No public Comments. IX. OLD BUSINESS 1). Second Reading of Ordinance 538 Lifting Ban on MJ and Enacting a New Code: There were no changes made from the first reading. A MOTION WAS MADE BY TRUSTEE COLE and seconded by Trustee Ruff to approve the second reading of Ordinance 538, lifting the ban on retail marijuana, and enacting a new and amended code. Motion passed with four (4) yes votes and one (1) no vote, being Trustee Riley. NEW BUSINESS 1). Resolution 2022-14 approving IGA with WCCR for Coordinated Election: This will approve the ability to conduct a coordinated election with Weld County. A MOTION WAS MADE BY TRUSTEE COLE and seconded by Trustee Ferrell to approve Resolution 2022-14. Motion passed with a unanimous vote. 2). IGA Agreement approval with Weld County for the 2022 coordinated election: After review, A MOTION WAS MADE BY TRUSTEE COLE and seconded by Trustee Ruff to approve the IGA with Weld County for the 2022 Coordinated Election. Motion passed with a unanimous vote. 3). Resolution 2022-12 Approving conditions of a Site Plan for Lot 4 Freedom Acres: This item was tabled. 4). Resolution 2022-13 Approving conditions of a Site Plan for Lot 3 Freedom Acres: This item was tabled. The referral will show the Town is in opposition of this project, as it does not fit with our Comprehensive Plan.
