THE CITY OF BEL AIRE, KANSAS
ORDINANCE NO. ;'07
AN ORDINANCE DECLARING WATER LEAKS IN PRIVATE
WATER SERVICE LINES A NUISANCE; ESTABLISHING
REPAIR PROCEDURES; AND ESTABLISHING A
DISCONNECT/RECONNECT FEE.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE I
KANSAS:
Section 1.
Declaration of Nuisance
Water leaks in private water service lines are hereby declared
to be a nuisance which must be repaired according to the terms of
this ordinance. It is unlawful for any water customer and/or
occupant of private property to fail to repair a service line leak
upon proper notice to do so.
Section 2.
Notice
Upon discovery of a leak in a private water service line the
City shall serve a notice to repair the leak within seven (7) days
of the date on the notice. Such notice shall be served upon the
water customer or occupant personally or by registered mail.
Failure to repair the leak within seven (7) days as directed will
result in the disconnection of water service. Service shall not be
reconnected until the leak is repaired and a disconnect/reconnect
fee of $20.00 has been paid.
Section 3.
Hearing Process
Any person wishing to contest the notice of repair has the
right to a hearing by the City Administrator. Such hearing must be
requested in writing and the request must be received at the Bel
Aire City Hall, 4551 N. Auburn, Bel Aire, Kansas, no later than
three working days prior to the seven day deadline for repair.
The decision of the City Administrator may be appealed to the
City Council. The appeal must be in writing and the appeal must be
received at the Bel Aire City Hall, 4551 N. Auburn, Bel Aire,
Kansas, no later than three working days after the hearing by the
City Administrator.
Section 4.
Public Safety or Declared Water Emergency
The City has the right to disconnect water service without
notice if a leak has been discovered and the water is flowing
beyond the private property line in such a way that a hazard to
public safety exists; or a water emergency has been declared by the
Governing Body pursuant to the City's water emergency ordinance.
In addition, a notice of repair shall be given according to the
requirements of this ordinance. Service shall not be reconnected
until the leak is repaired. However, no disconnect/reconnect fee
will be charged for the disconnection.
Section 5.
Effective Date
This Ordinance shall take effect and be in force from and
after its publication in the official city newspaper.
