CITY OF TIFFIN ORDINANCE NO. 2016-391
AN ORDINANCE AMENDING ORDINANCE 2014-363, WHICH AMENDED
THE OFFICIAL ZONING MAP OF THE CITY OF TIFFIN, IOWA, TO
APPROVE A PLANNED AREA DEVELOPMENT DESIGNATION, WITH
UNDERLYING ZONING DISTRICT R-1E, FOR CERTAIN PROPERTY
KNOWN AS PARK RIDGE SUBDIVISION, TIFFIN, JOHNSON COUNTY,
IOWA, AND AS LEGALLY DESCRIBED HEREIN
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose. The purpose of this ordinance is to amend
Ordinance 2014-363, which amended the official zoning map of the City
of Tiffin, Iowa, concerning property locally described as Park Ridge
Subdivision, Tiffin, Johnson County, Iowa. The Planned Area Development
was requested by applicant in order to have certain variances approved.
Applicant has identified the benefits derived from having such design
standard variances approved. The amended variances are:
1. Park Place and Park Terrace Right of Way at 50 feet wide
2. No sidewalks on Park Place or Park Terrace
3. No curb and gutter on Park Place or Park Terrace
4. No storm sewer system on Park Place or Park Terrace
5. Homes shall have individual septic systems
6. No improvements for S Park Road
7. Pavement for Park Place and Park Terrace less than minimum
standards
8. Open space dedication does not meet minimum requirements.
Applicant has paid the required fee.
Section 2. Amendment. The legal description of the designated
Planned Area Development is hereby amended to read as follows:
See the attached Exhibit"A"
The official zoning map of the City of Tiffin shall reflect the amended legal
description of the Planned Area Development. The Planned Area
Development is hereby amended as stated above and as shown on the
map attached as Exhibit "B". Approval of the Amended Planned Area
Development is subject to compliance with the requirements of the Tiffin
Zoning Code - Planned Area Development District and the Developer
executing a Public Access and Fire Apparatus Easement Agreement, and
such other utility easement agreements the City may require, and

subject to Council approval of the preliminary plat, final plat, and
Developer's Agreement, including for future development.
Section 3. Repealer. All ordinances or parts of ordinances in
conflict with the provisions of this Ordinance are hereby repealed.
Section 4. Severability. If any section, provision, or part of this
ordinance shall be adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the ordinance as a whole, or
any section, provision, or part thereof not adjudged invalid or
unconstitutional.
Section S. Effective Date. This ordinance shall be in effect after
its final passage, approval, and posting as provided by law.
On the 41h day of October 2016, at a regular/special meeting of the Tiffin
City Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No.
2016-391, and moved that it be given its first reading. The motion was
seconded by Councilperson Kahler.
Ayes: Ryan, Havens, Upton, Kahler.
Nays: Bartels.
Five members of the Council being present and having voted "Aye",
Mayor Steve Berner declared the motion carried, and Ordinance No.
2016-391, was read the first time, discussed, and placed on record.
On the 181h day of October 2016, at a regular/special meeting of the
Tiffin City Council, Tiffin, Iowa, Councilperson Ryan introduced
Ordinance No. 2016-391, and moved that it be given its second reading.
The motion was seconded by Councilperson Kahler.
Ayes: Kahler, Ryan, Havens, Bartels, Upton
Nays: None.
Five members of the Council being present and having voted "Aye",
Mayor Steve Berner declared the motion carried, and Ordinance No.
2016-391, was read the second time and discussed and placed on
record.
On the 1St day of November 2016, at a regular meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Upton introduced Ordinance No.
2016-391, and moved that it be given its third and last reading. The
motion was seconded by Councilperson Ryan.
Ayes: Bartels, Upton, Kahler, Ryan, Havens
Nays: None.
Five members of the Council being present and having voted "Aye",
Mayor Steve Berner declared the motion carried, and the ordinance was
passed and adopted.

Whereupon the Mayor declared that Ordinance No. 2016-391 be adopted
and signified his approval of same by fixing his signature thereto. Passed
by the Council on the 1St day of November 2016 and approved by the
Mayor on the 2nd day of November 2016.

that an ordinance entitled AN ORDINANCE AMENDING ORDINANCE
2014-363, WHICH AMENDED THE OFFICIAL ZONING MAP OF THE

the Council on the 1St day of November 2016, and signed by the Mayor
on the 2nd day of November 2016, and published on the 3rd day of
November 2016, by posting copies thereof in three public places within
the limits of the City of Tiffin, Iowa. That I posted copies of Ordinance
No. 2016 - 391 in the following places:
