Present: Mayor, Thomas Anderson; Councilmembers, Sarah Lutz, Wilfred Scherer, Thomas Crosby, William Reiser; Clerk -Treasurer, Donna Roehl; Public Works Director, Ron Duran; Police Chief, Charles Hoover; Planning and Zoning Administrator, JoEllen Hurr; Engineer, Dave Hansing; Attorney, Richard Schieffer 1. MINUTES OF JANUARY 6, 1981 Motion by Reiser, seconded by Scherer to approve minutes of January 6, 1981, as presented. Motion declared carried 2. POLICE DEPARTMENT Bicycle Safety Seminar Motion by Reiser, seconded by Lutz to authorize Michael Rouillard to attend a Bicycle Safety Seminar in Brainerd, February 17,18 and 19, registration fee of $25.00 with additional ex- penses to be paid by the Northwest Chamber of Commerce. Motion declared carried Police Refresher Courses Motion by Crosby, seconded by Reiser to authorize attendance by Jerome TgEond and Michael Rouillard at Police refresher courses for a fee of $25.00 per Officer. Motion declared carried Motion by Crosby, seconded by Reiser to authorize attendance by Jerome Leond at a Police report writing seminar in Bloomington at a fee of $50.00. Motion declared carried Home Burglaries Council discussed with Chief Hoover ways in which home burglaries could be combatted. 3. PUBLIC WORKS DEPARTMENT Jim Rossbach, Hennepin County Vo Tech, CETA Programs Mr. Rossbach presented information on the Youth Community Conservation Program for youths 16-22 years of age who work in a community in groups of 10-12 carrying out projects spec- ified by the community under the direct supervision of a Vo Tech employee. Wages, insurance and fringe benefits are provided for through the CETA program. He stated that they are interested in providing employment for youth in the area and serving communities in the western portion of Hennepin County. He explained that they would carry out a promotion program in the area in an attempt to reach eligible young people. Motion by Scherer, seconded by Crosby to accept the YCC program as outlined by Mr. Rossbach. Motion declared carried Mr. Rossbach also explained the intern program which the city may also become involved in. Council agreed to explore the possibility of employing such a person. Independence Beach Water Discussion was held concerning the problem of iron concentration in the Independence Beach water supply that continues to exist despite the ways in which the Public Works Department has attempted to alleviate the problem. Dave Hansing presented several alternative solutions: 1. An iron filtering plant which would cost approximately $160,000 or $2000 per home. 2. Individual iron removal units that would cost approximately $250-$300 installed in individual homes 3. A product named "iron -out" which is used in a water softner along with the salt. 4. An iron filtering unit that can be rented from a water softening company. Council agreed that no adjustments would be made on water bills at this time but that an investigation should be made to determine if home filters are being used and if so how effective they are. Also arrangement should be made with Culligan to install a unit in a problem home and monitor it for its effectivness. Donna Roehl was asked to notify water customers mith the April billing as to the variouskyj alternatives and the results of the various products or units. 4. AUDITOR, FINANCIAL REPORTING Discussion of financial reports that had been presented by Hansen and Babcock. Motion by Crosby, seconded by Scherer to table the matter pending information as to the feasibility of the city purchasing its own system. Motion declared carried Motion by Reiser, seconded by Crosby to authorize Donna Roehl to attend a computer seminar February 3, 4, and 5, in Alexandria for a registration fee of 440.00, plus travel expenses. Motion declared carried 5. INSURANCE Don Jahnke of Wayzata Insurance Agency explained the cities insurance _program. He discussed the League of Cities program and the fact that the insurance market is comparable to•what the League has to offer. Thomas Crosby stated that he would do some checking as to what coverage is. needed. Donna Roehl suggested asking a representative of the League explain their program. Mr. Jahnke explained blanket coverage of buildings and contents Rnd presented statement of values. Motion by Scherer seconded by Reiser to authorize the signing of the Statement of Values .for the 1981 insurance coverage. Motion declared carried 6. PLANNING AND ZONING Denis Jordan, Subdivision JoEllen Harr reviewed the Planning Commission recommendation of January 13th to deny the, approval of subdivision of Mr. Jordan's 10.46 acre parcel into 2 parcels, based on the fact that no prior formal application for subdivision can be found in the city files. Attorney, Jim Tiller, representing Mr. Jordan, presented information that the 2 parcels had been sold in. 1979 and that Mr. Jordan had thought that he had a legal division. He also had thought that the subdivision complied with the ordinances that existed at that time. He explained that there is 2+ acres of Dundas soil that would support an innovative septic system on the parcel on which the house is built and that the rear parcel has suff- icient soil for such a system, also. JoEllen Hurr reported that the existing system is not a mound system as had been required when the house was built. Dave Hansing explained that Pat Kennedy of Hennepin Soil and Water Conservation has caut- ioned against use of Dundas soils for septic systems. Wilfred Scherer explained the need for an easement along Chippewa Rd. for future widening of the road and the fact that no easement is shown to serve the rear parcel. Mr. Tiller asked that the matter be tabled untilhe has .time to research the easement question. Motion by Crosby, seconded by Reiser to table the Denis Jordan subdivision pending deter- mination of an easement to serve the rear parcel. Motion declared carried Zoning Map and Zoning Code Text Changes JoEllen Hurr explained relettering corrections needed on the zoning map and the floowing amendments needed in the zoning ordinance: Section 654.101, providing for no mobile home parks in flood districts. Page 67 of Comprehensive plan should read "City Council" not "County Board." Motion by Lutz, seconded by Scherer to authorize relettering of districts as explained and preparation of Zoning Code amendmments as suggested. Motion declared carried Accessory Building Size JoEllen Hurr reviewed the Planning Commission recommendations for accessory building size and number on various sized parcels. She also asked if building permits should be required on farm buildings with the permit fee waived so that buildings would not be .constructed with improper setbacks. Motion by Lutz, seconded by Scherer to authorize preparation of ordinance amendments to regulate accessory building sizes according to Planning Commission recommendations. . Motion declared carried Animal barn setback Requirements Council agreed with Planning Commissionrecommendation to retain the 150 ft..setback requirement for accessory buildings that is now required in the Zoning Ordinance. Woodlake Sanitary Landfill JoEllen Harr announced that anyone interested should let her know .whether or not they intended to tour the Woodlake and EdenPrairie landfill sites by bus on Saturday, January 24th at 10:00 A.M. 7. WILLIAM FENHOLT, TAX FORFEIT LOTS RE,SoL u-1;or.) - Motion by Reiser, seconded by Scherer to enter into a purchase agreement with William Fenholt for purchase of Lots 23 and 24 Block 2, Independence Beach, order preparation of Quit Claim Deed and set a six month deadline for pick-up of deed after City secures its deed from the State -of Minnesota. Motion declared carried 8. CONSENT AGENDA Board of Review Meeting Motion by Lutz, seconded by Scherer to set Board of Review meeting for June 2, 1981 at .6.30P.M. Motion declared carried Rolling Green Country Club Cigarette License Motion by Lutz, seconded by Scherer to grant a 1981 Cigarette license to Rolling Green Country Club, Motion declared -carried 9. BILLS Motion by Reiser, secondec by Crosby to pay the bills: Order. Checks # 9270-9276 in the amount of $2324.20 and Payroll Checks # 6074-6985 in the amount of $5584.41. Motion declared carried 10. DOCKSIDE JoE11en Hurr asked what the ordinances for action to be Thomas Crosby reported that lines of November 18; Land property. Motion by Crosby, seconded by Scherer to act as follows: WHEREAS; John Spaeth has previously requested guidelines regarding setbacks, density and other matters for a proposal to develop the Dockside property for multiple dwell- ings; and • ' WHEREAS, The City Council, the Planning Commission and Staff have held numerous meetings to consider Mr. Spaeth's request; and WHEREAS, The City Council had issued specific guidelines regarding setbacks, density and other matters relating to the proposed development on November 18, 1980; NOW THEREFORE BE IT RESOLVED by the Council of the City of Medina that they will take action on the Dockside application, based on the information submitted on February 17, 1981 unless the applicant submits the following on or before February 12, 1981: A site plan which meets the guidelines established by the City Council on November 18, 1980 and specifically describes the land area actually available for development.
