HomeMy Public PortalAboutResolution - 76-06- 19760303 - Approve election to expa( RESOLUTION NO. 76-6 RESOLUTION OF THE BOARD OF DIRECTORS OF THE MIDPENINSULA REGIONAL PARK DISTRICT ORDERING SAN MATEO COUNTY ANNEXATION SUBJECT TO CONFIRMATION BY VOTERS AND CALLING AN ELECTION WITHIN THE TERRITORY ORDERED TO BE ANNEXED. WHEREAS, on February 4, 1976 the Board of Directors of the Midpeninsula Regional Park District adopted Resolution No. 76-4 undertaking to conduct proceedings for the proposed San Mateo County Annexation in accordance with Part 5 of Division 1, Title 6 of the Government Code of California, and WHEREAS, duly noticed public hearings have been held on said proposal of annexation as provided by law, and WHEREAS, at such hearings the Board of Directors has heard, received and considered such oral and written protests, objections, evidence and other information as has been made, presented or filed, and WHEREAS, the Board of Directors has considered the factors referred to in Government Code Section 56314.1 as well as all other matters which the Board deems material, NOW THEREFORE, the Board of Directors of the Midpenin- sula Regional Park District resolves as follows: SECTION ONE. The Board finds that a majority protest does not exist. SECTION TWO. The Board hereby orders the annexation of said territory, subject to confirmation by the voters upon the question of such annexation within the territory proposed to be annexed. SECTION THREE. The name given to the territory for the purpose of indicating it upon the election ballots is "San Mateo County Annexation." The exterior boun- daries of the territory to be annexed are shown on the map affixed hereto captioned "Proposed Annexation of Territory in San Mateo County to Midpeninsula Regional Park District, 1975," marked Exhibit A and whose exterior boundaries are described on Exhibit B affixed hereto and by reference made a part hereof. SECTION FOUR. The terms and conditions imposed on such annexation are: 1. Th an election within the to.-Vi.tory to be ani.::ed be held. 2. That at least one hearing on the proposed annex- ation be held within San Mateo County, which hearing was held on February 19, 1976 in the Council Chambers of Menlo Park. The vote required for confirmation of the Board's action ordering annexation should be a majority of the votes cast upon the measure. SECTION FIVE. The election shall be held within the territory described in said Exhibits A and B on June 8, 1976, and shall be consolidated with the primary election to be held on that date. SECTION SIX. At the election, there shall be sub- mitted to the'qualified electorate in the territory the following proposition: MIDPENINSULA REGIONAL PARK DISTRICT ANNEXATION MEASURE MEASURE ( ) Shall the order adopted on March 3, 1976 by the Board of Directors of the Midpeninsula Regional Park District ordering the annexation to said district of the territory described in said order and designated therein as "San Mateo County Annexation" be confirmed? On the ballot opposite the question and to its right, the words "Yes" and "No" shall be printed on separate lines with voting boxes. SECTION SEVEN. Ballots for the election shall be provided of the form and to the number provided by law. SECTION EIGHT. The hours of opening and closing the polls shall be the same as provided for a general County election. SECTION NINE. The Midpeninsula Regional Park District District Clerk is directed to obtain supplies necessary for the proper conduct of the election and to have pre- pared and mailed a ballot pamphlet, a sample ballot, and a precinct polling place card as prescribed by law. SECTION TEN. The District Clerk shall transmit a certi- fied copy of this resolution by registered mail to the executive office of the Local Agency Formation Commis- sion within five (5) days after its adoption as prescribed by law. SECTIO;T ELEVEN. The District Clerk shall publish or post a synopsis of the measure to be voted upon to the extent and in the manner provided by law. SECTION TWELVE. The voting precincts, polling places, and election officers shall be established by later resolution. SECTION THIRTEEN. The District Clerk shall publish or post notice of election as required by law. SECTION FOURTEEN. CU11� Palo Alto le EXHIBIT A EXHIBIT B Proposed Annexation of Territory in San Mateo County to Midpeninsula Regional Park District, 1975 Proposed Boundaries The proposed annexation to the Midpeninsula Regional Park District would include the entire incorporated areas of the cities of Woodside, San Carlos, Redwood City, Portola Valley, Atherton and Menlo Park, together with certain adjoining unincorporated lands all as described below. All referenced district, city, and county boundaries are the district boundaries as they existed on August 18, 1975. Beginning at the point in San Francisco Bay common to the boundaries of Santa Clara County, San Mateo County, and Alameda County; thence following the common boun- dary of San Mateo County and Alameda County generally northwesterly to the point at which the common boundary of the City of Redwood City and City of Foster City departs from the common boundary of San Mateo and Alameda counties; thence generally northerly and westerly following the common boundary of the City of Redwood City and the City of Foster City various courses and distances to the western boundary of Section 19. T.4. S., R.3.W., M. D.
