HomeMy Public PortalAboutR 98:054 No. 98-54 Dale of AdopHon FEBRUARY 19,~ 1998 AUTHORIZING AGREEMENT FOR EXTRAORDINARY, UNSPECIFIED SERVICES WHEREAS, there exists a need for Insurance Coverage; and WHERE~S~ l~n~i~aximum a~oun~ of the dont~ac~in ~ ~ ~3,375 for the administration portibnOf[w0rk~r~.Sd~en~a~io~. · nsurance coverage and $21,000 for excess workers compensation 'insurance, and funds are available in an appropriations entitled Insurance and Surety Bond Premiums and have been Certified by the Chief Finance Officer, said certification being attached.; and WHEREAS, N.J.S.A. - 40A:ll-1 et seq. requires that the Resolution authorizing the Award of Contracts for "Extraordinary, Unspecifiable Services,, without competitive Bids and the Contract itself must be available for public inspection; and WHEREAS, this Resolution meets the Statute and Regulations governing the ~award of said contracts; ' . !, ~. ~ ~ ,.. NOW, THEREFORE, BE IT RESOLVED by th~ Council of the Borough of Carteret as follows: 1. The Mayor and Borough Clerk are Hereby Authorized and Directed to execute an agreement with Gartland & Co., Inc and Dynamic Claims Management. 2. This Contract is awarded without competitive bidding as an "Extraordinary, Unspecifiable Service,, in accordance with 40A:11-5 (1) (a) (ii) of The Local Public Contracts Law because Insurance including the Purchase of Insurance Coverage are specifically excluded. 3. Notification of COntract Award shall be printed once in the News Tribune. Adopted this 19th day of February, 1998 and certified as a true copy of the original on February 20, 1998. KATHLEEN M. DeBlasio, CFO Re Contract for: Insurance Coverage-Excess Workers This is to request your approval of a Resolution authorizing a contract to be executed as follows: Administration of Claims: Firm: Dynamic Claims Management Cost: $3,375 Period: 1/1/98-3/31/98 Excess Workers Compensation: Firm: Gartland & Company Cost: $21,000 Period: January 1, 1998 thru December 31, 1998 Purpose: Administration of workmans compensation claims and workmans compensation insurance. This is requested to be awarded without competitive bids as an extraordinary, unspecifiable service (N.J.S.A 40A:11-5 (1) (a) . I do hereby certify as follows: 1. Quotations have been solicited and are stated above: 2. Insurance coverage is specialized and qualitative in nature requiring expertise, extensive training and proven reputation. Insurance contracts have been modified over the years to conform to Borough requirements and policies. 3. This can not be described by written specifications because: It is not reasonably possible to draft specifications to meet the Borough requirements of all the various liability coverage and administration thereof. 4. I have reviewed the rules and regulations of the Division of Local Government Services as contained in the local public contract guidelines (revised) and certify that the proposed contract may be considered as an extraordinary, unspecifiable service in accordance with the requirements thereof.
