RESOLUTION NO. 2001-44
A RESOLUTION OF THE TRUCKEE TOWN COUNCIL PROSCRIBING
PROCEDURES, RULES, AND REGULATIONS FOR THE OBTAINING OF
PROFESSIONAL SERVICES PURSUANT TO TRUCKEE TOWN CODE SECTION 3.12.$00
WHEREAS, Section 3.12.300 of the Truckee Town Code requires that a resolution be adopted proscribing
rules, regulations, and procedures governing the solicitation, selection, and award of proposals or bids for
professional or consulting services;
WHEREAS, the Town Council has determined that the provisions set forth below comply with the
requirements of section 3.12.300;
NOW, THEREFORE be it resolved by the Truckee Town Council that:
Section 1: Procedures for Town Manager Approved Contracts
Section 3.12.300 of the Town Code authorizes the Town Manager to approve professional services contracts
of $20,000 and under. In exercising that authority the Town Manager shall:
A. Determine if the proposed professional services contract is the result of a request for
proposals for the service and that the proposal selected is appropriate. If not, the department requesting the
service shall provide written justification as to why proposals were not solicited for the requested service.
B. Determine that the funds necessary to pay for the requested service are in the approved
Town budget.
C. Cause all expenditures under any approved contract to be accounted for through the Town
purchase order system in accordance with standard Town procedures.
D. Verify that all necessary contract provisions regarding cost, insurance, indemnities, despute
resolution, and other relevant contractual matters are contained in the professional services agreement which
is to be executed, and any required verifications are attached.
Section 2: Council Approved Contracts.
A. Any professional services contract requiring Council approval shall be placed on a regular
or special meeting agenda for review.
B. The item shall be accompanies by a staff report which states that a request for proposals
process was utilized and the results of that process. If an RFP process was not used a justification for not
doing so will be provided as part of the staffreport.
C. The staff report shall also include a specific reference to the means by which the
professional services contract is to be funded. It shall also contain the proposed professional services
contract, with all required verifications and attachments.
D. Following award by the Town Council the expenditure of funds under the professional
services contract shall be accounted for through the purchase order process in accordance with standard
Town procedures.
Section 3. Expedited Contracts
In the event the Town elects to utilized professional services for design-build projects or other means of
expediting the construction of public works projects, this resolution shall be amended to specifically set forth the
rules, regulations, and procedures under which such contracts may be awarded.
The foregoing Resolution was introduced at a Regular Meeting of the Town Council of the Town of
Truckee, held on the 15~h day of November, 2001 by Councilmember Susman, who moved its adoption, which
motion being duly seconded by Councilmember Owens, was upon roll call carded and the Resolution adopted by
the following vote:
AYES: Councilmembers Florian, Owens, Schneider, Schneider and Mayor McCormack
