HomeMy Public PortalAbout84-1800 RESOLUTION NO. 84-180 C� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON ACCEPTING THE WORK PERFORMED BY DE ARMOND CONSTRUCTION FOR VICTORIA STREET MEDIAN IMPROVEMENT - AVALON BOULEVARD TO FIGUEROA STREET, PROJECT NO. 472 WHEREAS, the City Council did on the 6th day of February 1984, adopt Resolution No. 84-029 awarding the contract for Victoria Street median beautification between Avalon Blvd. and Figueroa Street - Project No. 472 to DeArmond Construction; and WHEREAS, said work has been duly performed and completed by said contractor; and WHEREAS, said work has been inspected by the Public Works Director and by him approved as constructed and completed in its entirety, project and authorized revisions therein; and WHEREAS, said Director does now recommend and request the acceptance of the work and the filing of a Notice of Completion thereof; and WHEREAS, the final total contract price for said work is the sum of $321,699.87, which said sum the Director has approved as just and fair; and WHEREAS, the contract documents provide that a total of 10% ($32,169.99) of said total contract price shall be retained until thirty-five (35) days after the recording of the Notice of Completion of said improvement project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CARSON AS FOLLOWS: That the City of Carson does hereby accept the work performed by said contractor and approve the same as being completed in accordance with the plans and specifications for said project and authorized revisions thereof; and the City Administrator is hereby authorized to file a Notice of Completion of said project in the Office of the Los Angeles County Recorder; and BE IT FURTHER RESOLVED that the City Treasurer is authorized and directed to pay to said contractor, De Armond Construction, the sum of $32,169.99 in full and final payment of said work performed by said contractor thirty-five (35) days following the filing of said Notice of Completion, less liquidated damages, if any, any sums required to be withheld pursuant to stop notice claims, if any, and any other sums required to be withheld from said payment; and BE IT FURTHER RESOLVED that upon expiration of said thirty-five (35) days following the filing of said Notice of Completion, without any claim being filed against said project, that all bonds filed by the contractor in said project shall be exonerated and discharged, excepting that the faithful performance bond shall remain in force until the expiration of one year from the date of filing said Notice unless a substitute bond approved by the Director of Public Works and the City Attorney shall have been filed. PASSED, APPROVED and ADOPTED this 16th day of October , 1984.
