RESOLUTION NO. 84-193
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARSON MODIFYING CONDITION NUMBER
35 OF TRACT NO. 33947
The City Council of the City of Carson Hereby Finds, Resolves and
Orders as Follows:
Section 1: The City Council does hereby find and determine that
an application was duly filed by Dan Butcher, with respect to real property
described in Exhibit "A" attached hereto, requesting modification of
Condition Number 35 of Tract Map No. 33947 to change the development standard
for the tract wall and to delete the requirement for a building permit, and
that a public hearing was duly held on November 5, 1984, at 6:30 p.m.in
Council Chambers, City Hall, 701 E. Carson Street, Carson,_ California, and
that a notice of the time, date, place and purpose of the aforesaid hearing
was duly given.
Section 2. Evidence, both written and oral, was duly presented
to and coni e� by the City Council at the aforesaid public hearing.
Section 3. On October 23, 1984, the Planning Commission recom-
mended to tibe -City that the modification request be approved.',
Section 4. The City Council finds that:
1) .There is a change in circumstances which makes the cond'tion
no longer appropriate, in that the wall was built to a comparable standard
and is adequate to serve the purpose of the condition.
2) The modification does not impose any additional burden on the
present fee owner, and will in effect pose a lesser burden since the wall
will not need to be broken into or rebuilt.
3) The modification does not alter any right, title, or interest
in the real property reflected on the recorded map.
4) The map as modified, which will permit the residential develop-
ment of the subject property, is consistent with the General Plan which
designates said property for low-density residential uses.
5) The design and improvement of the subdivision, as modified for
residential uses, is consistent with the General Plan which designates the
subject property for low-density residential uses.
6) The site is physically suitable for residential development
as it is a relatively flat, irregular-shaped, 5.5 acre parcel of landlthat
is zoned RS (Residential, Single-family).
7) The design of the subdivision as modified and its improve.
and development will not have a significant effect on the environment as
indicated in the Initial Study and Legative Declaration prepared for the
project.
8) The 5.5 acre site is physically suitable for the proposed
density of the development which is'',4.7 lots per acre.
9) The subdivision as modified will provide additiona
stock necessary to meet the housing',needs of the region without
or impairing public services or fiscal and environmental resourc

10) The design of the subdivision as modified and its improvements
and development will not cause serious public health problems, as the re-
quired fire fighting facilities and required sewage system will be adequate
to meet the needs of the proposed subdivision.
11) There are no easements acquired by the public at largelfor
access through or use of property within the proposed subdivision.
12) The discharge of waste from the subdivision, as modified, into
the existing sewer system will not result in the violation of the ex sting
requirements prescribed by the Regional Water Quality Control Board, as the
existing sewer system has adequate capacity to handle any increase discharge
of waste from the proposed subdivision.
13) The design of the subdivision as modified provides, tolthe
maximum extent feasible, for future passive or natural heating or codling
opportunities.

Section S. Based on the aforementioned findings, the City Council
approves the modification of Condition No. 35 of Tract No. 33947 with
to the property described in Section 1 hereof.
