REGULAR MEETING
February 26, 2008
The Moab City Council held its Regular Meeting on the above date in
the Council Chambers of Moab City Offices, located at 217 East Center
Street, Moab, Utah. Mayor Pro-tem Kyle Bailey called the Pre -Council
Workshop to order at 6:30 PM.
Mayor Pro-tem Bailey called the Regular City Council Meeting to order
at 7:00 PM and former Moab City Mayor Karla Hancock led in the
Pledge of Allegiance. Also in attendance were Councilmembers Gregg
Stucki, Rob Sweeten, Sarah Bauman and Jeffrey Davis; City Manager
Donna Metzler, City Recorder/Assistant City Manager Rachel Ellison,
City Engineer Daniel Stenta, Planning Director Jeff Reinhart, City
Treasurer Jennie Ross and Police Chief Mike Navarre. Seventeen (17)
members of the audience and media were present.
There were no minutes to approve.
Under Citizens to be Heard, Chris Baird stated that he wanted the
Council to carefully consider the large-scale retail ordinance before
them and consider if the gateway of our community was the best
location. Mr. Baird stated that he thinks the City should demand
reclamation bonds and that our community is divided on this issue. Mr.
Baird stated that he would like to see a compromise ordinance and
urged the council to vote in the best interest of the community.
A Community Development Department Update was not given.
An Engineering Department Update was not given.
Under Planning Department Update, Planning Director Reinhart stated
that staff had been reviewing the preliminary Master Planned
Development for Lion's Back Developers and re -writing conditional
uses. Planning Director Reinhart also stated that the Utah Chapter of
the American Planning Association would be holding a conference in
Moab including a local officials workshop.
A Police Department Update was not given.
A Public Works Department Update was not given.
Carrie Valdez of the Grand County Library made a presentation
regarding 2007 Library Services.
Mayor Pro-tem Bailey presented Madison Jones with the Mayor's
Student Citizenship of the Month Award for Helen M. Knight
Intermediate School for February 2008.
Councilmember Sweeten moved to approve a Moved -on Structure
Permit for City Market #410 Located at 425 South Main Street to
Conduct a Garden Center from March 1 to July 4, 2008.
Councilmember Davis seconded the motion. The motion carried 5-0
aye.
Councilmember Stucki moved to approve a Request for an Amplified
Music Event at Old City Park by the Moab Music Festival on August 31
and September 1, 2008. Councilmember Sweeten seconded the motion.
The motion carried 5-0 aye.
Councilmember Stucki moved to award the Sweeper Bid for the Streets
Department to A.G. Truck in the amount of $164,721.00.

Councilmember Sweeten seconded the motion. The motion carried 5-0
aye by a roll -call -vote.
Councilmember Davis moved to approve a Vehicle Lease Purchase
Agreement by and between the City of Moab and Zions First National
Bank for the purchase of three 2007 Dodge Chargers and one 2008 Ford
Ranger in the amount of $93,266. Councilmember Sweeten seconded
the motion. The motion carried 5-0 aye by a roll -call -vote.
Councilmember Sweeten moved to Send Proposed Resolution #03-2008
— A Resolution Amending the Fiscal Year 2007/2008 Budget to Public
Hearing. Councilmember Bauman seconded the motion. The motion
carried 5-0 aye.
Councilmember Sweeten moved to approve a Preliminary Master
Planned Development (MPD) for Portal RV Resort subject to
annexation of the property proposed for development, that an adequate
site specific soils study shall be completed for the property and
submitted to the City Engineering Department, and that the wetlands
must be conveyed as required by Chapter 17.65.040 to a non-profit
corporation, the City of Moab or other entity as established in the
chapter. Councilmember Davis seconded the motion. The motion
carried 5-0 aye.
Councilmember Davis moved to approve Proposed Ordinance #2008-16
— An Ordinance Amending the City of Moab Official Zoning Map.
Councilmember Stucki seconded the motion. The motion carried 5-0
aye.
Councilmember Sweeten moved to table Approval of Proposed
Resolution #06-2008 - A Resolution of the Governing Body of Moab
City in Favor of House Bi11 808 to Create a United States Department of
Peace and Non -Violence. Councilmember Bauman seconded the
motion. The motion carried 5-0 aye.
Councilmember Bauman moved to table Approval of Proposed
Ordinance #2008-10 — An Ordinance Creating Chapter 17.80 of the
Moab Municipal Code Enacting Supplementary Regulations for Large
Scale Retail Developments over 30,000 Square Feet. The motion died
for lack of a second.

Bailey seconded the motion. The motion failed 2-3 nay with
Councilmembers Bauman and Bailey voting aye.
Councilmember Stucki moved to approve Proposed Ordinance #2008-

Code Enacting Supplementary Regulations for Large Scale Retail
Developments over 30,000 Square Feet. Councilmember Sweeten
seconded the motion. The motion failed 2-3 nay with Councilmembers
Bauman and Bailey voting aye.
Councilmember Sweeten moved to reconsider Approval of Proposed
Ordinance #2008-10 — An Ordinance Creating Chapter 17.80 of the
Moab Municipal Code Enacting Supplementary Regulations for Large
Scale Retail Developments over 30,000 Square Feet. Councilmember
Stucki seconded the motion. The motion carried 4-1 aye with
Councilmembers Davis voting nay.
There was no Correspondence to be Read.
Under Administrative Reports, City Manager Metzler invited the
Council to attend an Affordable Housing Workshop on March 12, 2008.
Under Report on City/County Cooperation, City Manager Metzler stated
that Grand County had cancelled the Joint Meeting on February 29,
2008.
Under Mayor and Council Reports, Councilmember Sweeten stated that
he was working on a higher education proposal and he would like to
schedule a workshop with the City Council.
Councilmember Bauman inquired if staff had received the request from
the Multi -Cultural Center to co-sponsor their Multi -Cultural Fair in
May, 2008.
City Manager Metzler stated that staff would schedule a meeting with
the Multi -Cultural Center to work out the details.
Councilmember Bauman moved to pay the bills against the City of
Moab in the amount of $328,788.07. Councilmember Sweeten
seconded the motion. The motion carried 5-0 aye by a roll -call -vote.
Mayor Sakrison adjourned the meeting at 9:10 PM.
