HomeMy Public PortalAbout86-030A Resolution No. 86-030 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON APPROVING AN APPLICATION FOR SITE PLAN AND DESIGN APPROVAL OF DESIGN k OVERLAYREVIEW NO. 326-85. The City Council of the City of Carson hereby Finds, Resolves and Orders as follows: Section 1. The City Council does hereby find and determine that an application was duly filed by Dia - Ramos Enterprise, for Site Plan and Design approval for the construction of five (5) single-family rental units. The property is located at 20908 Jamison Avenue in the RS (Residential Single -Family) zoned district. Section 2. On January 28, 1986, the Planning Commission, following a duly noticed public hearing at which evidence, both written and oral, was duly presented to and considered by said Commission, denied the application for approval of Design Overlay Review No, 326-85 as set forth in Planning Commission Resolution No. 86-874. Section 3. Pursuant to Section 9173,4 of the Carson Municipal Code, a notice of appeal of the Planning Commission's decision was filed by the applicant. On April 9, 1986 the City Council held a duly noticed public hearing to consider the appeal of the applicant. Evidence, both written and oral, was duly presented to and considered by the Council at said hearing, Section 4, The City Council finds, pursuant to section 9125.5 of the Carson Municipal Code that: (1) The subject property is in the RS zoned district. The applicant proposes to develop the site as a five unit rental property, which is a permitted use subject to approval of a development plan and site and design approval. (2) The creation of multiple detached units on a sewered parcel of 10,000 square feet or greater in area with a minimum of 5,000 square feet of land for each unit is subject to the criteria expressed in Section 9125.5 and Section 9172.23 of the Carson Municipal Code. (3) The proposed land use does meet the criteria expressed in Section 9125.5 and Section 9172,23,.due to the reduction of the number of detached units to four (4) with the elimination of one (1) unit from the proposal, the pro- vision of four guest parking spaces, and the redesign of the project. Resolution No. 86-030 Page 2 (4) The proposed land use as revised by a new site plan and design is not incompatible with the existing and future land use in the vicinity. The buildings pro- posed to be built will leave sufficient room for parking and landscaping, The surrounding uses are predominantly single-family residences. The addition of the proposed four rental units to this area will not increase traffic to unacceptable levels and will not impair the convenience and safety of traffic circulation for pedestrians and vehicles. Each of the units will have at least one (1) guest parking space. (5) The architecture and design,of the proposed dwelling units are compatible with existing and anticipated development in the vicinity. The buildings proposed to be built will not change the character of the existing resi- dential area. The plans submitted by the applicant do provide for adequate driveway and pedestrian access, The design provides adequate visitor parking, trash enclosure. area, and other amenities. (6) Conditions are also concurrently imposed to lesson the impact of-four.un.its being constructed by requiring intensive landscaping and appropriate architectural'. and site design. The driveway will be moved to the southerly property line, while a separate pedestrian walkway will be provided along the northerly property line. Section 5. Based on the aforementioned findings, the Council hereby approves the appeal, annuls the decision of .the Planning Commission and approves the application for a development plan in Design Overlay Review No, 326-86 with respect to the property described in Exhibit "A"' attached hereto, and subject to the conditions given in 'Exhibit "B". COUNTY :.ONDITIONS OF APPROVAL Resolution No. 86-030/Page 5 of 6 EXHIBIT"B" 1. That the applicant shall provide the following street improvements: a. One driveway: size W=261- X=4 - Case #3. Driveway to be located at the South end of lot. b. Relocate one power pole: existing power pole to be 5' feet from top'of "X" of new driveway. c. Install one hi -pressure sodium street light on marbelite pole, street light layout to be approved by the Los Angeles County Lighting Section. d. Wherever on site drainage is to enter the public right-of-way, an approved parkway drain shall be provided. e. Width of the site private driveway will meet the requirements of the Los Angeles County Fire Department. f. Only one water meter will be permitted within the public right-of-way. g. Close existing driveway and replace with full height curb. Fill in parkway area. h. Install parkway tree wells and root barriers. 2. Prior to issuance of a building permit, the following must be on file with the Department of Public Works: a. Certification of Worker's Compensation. b. Construction permit. For work to be performed within the public right-of-way. c. Three sets of plot and grading plans approved by the Public Works department. d. An approved street light lay out; Los Angeles County Lighting Section. e. Cash deposit for the sum of $2,400.00 for: Driveway I @ $600/ea. $ 600.00 Street Light I @ $1,500/ea 1,500.00 Parkway Drain 1 @ $300/ea. 300.00 TOTAL: $2,400.00 3. That a pedestrial walk of four to five feet in width, separated from the driveway, be provided and that it be curbed if adjacent to the driveway. 4. That on site lighting, equivalent to local street lighting be provided and the applicant shall Operate and maintain the lights and a guarantee be given for such work. BUILDING AND SAFETY 5. That the construction shall meet all requirements of the Building Code. b: That grading plans to include compaction and soil tests, be approved by the Building and Safety Department. 7. That a soils report be submitted prior to the approval of the grading permit. 8. That the five units comply with Section 308.0 of the Building Code as the building site is within 1000 feet of a closed landfill site. 9. That a sewer connection fee be paid to the Sanitation District prior to obtaining a permit. LOS ANGELES COUNTY FIRE DEPARTMENT 10. That water mains, fire hydrants and fire flows be provided as required by the County Forester and Fire Warden. 11. That Fire Department access shall be provided to all the units, and the driveway shall be marked as a "FIRE LANE". 12. That sanitary sewers shall be used as the method of sewage disposal. Resolution No. 86-030/Page 6 of 6 13. That the applicant shall substantially conform to the plot plans and elevations labeled "C-1", and "D-1". 14. That the exterior lights along the driveway on the south side of the property shall be placed and set so as not to shine onto any adjacent properties or public right-of-way, so that no nuisance or hazard to traffic or to the living environment be created. 15. That each unit shall be provided with a two (2) car garage, 18' x 20' minimum interior dimensions; and one (1) guest parking space, 9' x 201, per unit, shall be provided. Each garage and guest parking space shall be included as an integral part of each dwelling unit. 16. That a perimeter hedge be provided along the side and rear property lines in order to reduce the impact of five (5) dwelling units rising amidst ai Single-family neighborhood. 17. That landscape and irrigation plans be submitted for approval to the Department of Community Development prior to the issuance of any building permit. 18. That the two trash enclosure areas at the east and west end of the property be within an enclosed area 44 feet by 6 feet and that the owner enter into an agreement with each of the tenants for regulating the use of the trash enclosures. 19. That the common driveway shall not be used for parking and that signs be placed indicating. that there shall be "No Parking" along the driveway. 20. That the applicant shall submit a revised plot plan and elevations to include changes recommended in Condition Nos. 3, 4, 11, 15, 16, 17, 18, 19 and 21, prior to the issuance of any Building Permit. 21. That all required permits shall be obtained for abandoning the existing driveway access approach and rebuilding the sidewalk and curb and the construction of a new driveway access approach along the south property line on Jamison Avenue. 22. That the applicant shall comply with all City, County, State and Federal regulations which directly relate to the applicant's request. 23. That the applicant shall file an affidavit of acceptance with the Community Development Department within sixty (60) -days of the receipt of the Resolution. 24. It is further made a condition of this approval that if any condition hereof is violated or if any law, statute, or ordinance is violated, the permit shall lapse, provided the applicant has been given written notice to cease such violation and has failed to do so for a period of thirty (30) days.
