Dear Ms. Panzica,
Thank you very much for meeting with us yesterday.
The following memorializes our conversation regarding how you propose to comply with the Brewster Zoning Bylaw for
the Kitchen Cafe given the town's enforcement letter of July 20, 2022:
• Operate as a full -service restaurant, which essentially involves how prepared food is served and paid for. In a
full -service restaurant (as defined in the Brewster Zoning Bylaw), staff would take the order, deliver the food to
the table when prepared, and the customer would pay for the food at the end of the service. As discussed, we
understand that you may need some time to fully transition to this model (including ordering pay system
equipment). Please proceed as quickly as practicable and update us about how this transition is going;
• Cease operation of the 'food truck' on -site. The truck (which we understand to be registered) should be closed
and so signed, disconnected from any power or other utilities, and moved as far away from the building on -site
as is practicable. If possible, the better option would be to remove the truck from the site entirely;
• Abide by all special permit conditions for the food 'trailer,' including not operating any earlier than 11AM.
We understand that your long-term goal may be to permit through the Planning Board and other departments a 'limited
service' restaurant with appurtenances and other site changes like the onsite food truck. However, unless and until you
apply for and obtain such approvals, you are essentially required to maintain the status quo of the restaurant as it
existed at the time you purchased the property (though together with the special permit you obtained for the food
trailer). To that end, so long as you operate in accordance with the above bullets, the building department will consider
the property in compliance with town zoning including with respect to enforcement requests received relative to these
issues.
