REGULAR MEETING
March 25, 2008
The Moab City Council held its Regular Meeting on the above date in
the Council Chambers of Moab City Offices, located at 217 East Center
Street, Moab, Utah. Mayor David L. Sakrison called the Pre -Council
Workshop to order at 5:40 PM.
A Council Discussion Regarding Proposed Ordinance #2008-10 - An
Ordinance Creating Chapter 17.80 of the Moab Municipal Code
Enacting Supplementary Regulations for Large Scale Retail
Developments over 30,000 Square Feet proceeded.
Mayor David L. Sakrison called the Regular City Council Meeting to
order at 7:00 PM and B. D. Howard led in the Pledge of Allegiance.
Also in attendance were Councilmembers Gregg Stucki, Rob Sweeten,
Sarah Bauman Kyle Bailey and Jeffrey Davis; City Manager Donna
Metzler, Deputy Recorder II Danielle Guerrero, City Engineer Daniel
Stenta, Planning Director Jeff Reinhart, City Treasurer Jennie Ross,
Community Development Director David Olsen and Administrative
Analyst/Economic Development Coordinator Kenneth F. Davey.
Twenty (20) members of the audience and media were present.
Councilmember Sweeten moved to approve the Regular Council
Meeting Minutes of February 26, 2008. Councilmember Stucki
seconded the motion. The motion carried 5-0 aye.
Under Community Development Department Update David Olsen
stated that the concrete work being done at the ballpark was because the
bleacher project was about half as much as he had anticipated.
Community Development Director Olsen stated that the 500 west
underpass was cleared out well and that the water would now run
towards the creek. Mr. Olsen stated that a group of citizens would like
to talk about Rick Winkler and the self help program during citizens to
be heard. Mr. Olsen stated that the planning department will be
attending the Utah Chapter of the American Planning Association
conference being held in Moab starting tomorrow and continuing to
Friday.
Under Engineering Department Update, City Engineer Stenta
distributed a written report.
Under Planning Department Update, Planning Director Reinhart stated
that the planning department had created a notice to use on illegally
parked vehicles for sale and that there were nine cars flagged on
Saturday. City Planner Reinhart stated he had been approached by the
police department regarding camping in city limits, and he would like to
address this issue before jeep safari next year.
A Police Department Update was not given.
A Public Works Department Update was not given.
Mayor Sakrison presented Christian Domenick with the Mayor's
Student Citizenship of the Month Award for Helen M. Knight
Intermediate School for March 2008.
Mayor Sakrison left the meeting at 7:20 PM
Under Citizens to be Heard, Chris Baird stated that he thinks there is a
limit to private property rights. Mr. Baird stated that he was
disappointed in the way the large scale retail ordinance was written and

he thinks that half the population will be disappointed with the
ordinance. Mr. Baird reminded the City Council that their role is to
champion the public interest.
Celia Alario stated that she has been covering the progression of the big
box ordinance and that she is a recent arrival to our community is a tax
payer, voter, and business owner. Ms. Alario stated that she is alarmed
at the status of the ordinance, she thinks there is not a majority of
community support in favor of the ordinance and that it would have a
negative economic effect on our community. Ms. Alario concluded that
she would pray for our community.
A Presentation was made by Steve Hawks of Utah State University
regarding Higher Education.
Mayor Pro-tem Bailey opened the Public Hearing for a Community
Development Block Grant (CDBG) Project Replacing a Water
Transmission Line at 7:42 PM.
No Public Comment was given.
Mayor Pro-tem Bailey closed the Public Hearing at 7:45 PM
Councilmember Sweeten moved to approve Proposed Resolution #03-
2008 — A Resolution Amending the Fiscal Year 2007/2008 Budget.
Councilmember Stucki seconded the motion. The motion carried 5-0
aye by a roll -call -vote.
Councilmember Bauman moved to approve Proposed Ordinance #2008-
11 - An Ordinance Amending the City of Moab Municipal Code,
Section 17.90 through the Addition of Language for Historic
Preservation. Councilmember Davis seconded the motion. The motion
carried 4-1 aye with Councilmember Sweeten voting nay.
Councilmember Stucki moved to approve a request by Jon Olschewski
for Approval of an Amplified Music Event at Old City Park on April 12
and May 10, 2008. Councilmember Sweeten seconded the motion. The
motion carried 5-0 aye.
Councilmember Sweeten moved to approve Proposed Resolution #08-
2008 - A Resolution of the Governing Body of the City of Moab
Declaring Certain Property Owned by the City of Moab as Surplus.
Councilmember Stucki seconded the motion. The motion carried 5-0
aye.
Councilmember Sweeten moved to approve Proposed Ordinance #2008-
10 - An Ordinance Creating Chapter 17.80 of the Moab Municipal Code
Enacting Supplementary Regulations for Large Scale Retail
Developments over 30,000 Square Feet. Councilmember Stucki
seconded the motion. The motion carried 3-2 aye with Councilmembers
Bauman and Davis voting nay.
Councilmember Davis moved to approve a Moved -on Structure Permit
for Desert Snow Located at 83 South Main Street to Conduct a Snow
Cone sale from April 26 to September 6, 2008. Councilmember
Sweeten seconded the motion. The motion carried 5-0 aye.
There was no Correspondence to be Read.
Under Administrative Reports, City Manager Metzler distributed a
written report and gave an update on the aquatic center.

Under Report on City/County Cooperation, City Manager Metzler stated REPORT ON CITY/COUNTY
that there would be a joint City/County meeting Friday at 11:30 AM to COOPERATION
discuss roads.
There was no Mayor and Council Report given.
Councilmember Bauman moved to pay the bills against the City of
Moab in the amount of $511,042.64. Councilmember Sweeten
seconded the motion. The motion carried 5-0 aye by a roll -call -vote.
Mayor Pro-tem Bailey adjourned the meeting at 8:23 PM.
