HomeMy Public PortalAbout2015.212 (11-24-15)RESOLUTION NO. 2015.212 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, APPROVING THE AMENDMENT OF THE AGREEMENT BETWEEN THE CITY AND CONTRACTOR COMPLIANCE AND MONITORING, INC. (CCMI) TO PROVIDE A THIRD PARTY LABOR COMPLIANCE PROGRAM FOR AN ADDITIONAL AMOUNT OF $5,000 WHEREAS, in 2012, the City entered into a Grant Contract with the State of California Department of Parks and Recreation to receive $5 million in grant funds under the Proposition 84 2006 Bond Act to construct the Yvonne Burke - John D. Ham Park Community Center (Community Center); and WHEREAS, all Proposition -84 grantees must provide a Labor Compliance Program (LCP) before requesting a grant payment for construction costs; and WHEREAS, the purpose of the LCP is to ensure that construction contractors comply with the prevailing wage and other applicable labor laws, and that payroll records follow generally accepted accounting practices; and WHEREAS, on October 21, 2015, the City Council adopted Resolution 2014.185 approving and adopting LCP for Proposition 84 funded projects; and WHEREAS, the City's LCP calls for Contractor Compliance and Monitoring, Inc. to implement the City's LCP; and WHEREAS, on August 4, 2015, the City Council approved an Agreement with Contractor Compliance and Monitoring, Inc. (CCMI) in' the amount of $17,400; and WHEREAS, since CCMI's pricing model was based on construction cost, CCMI required an amendment to their compensation. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER AND RESOLVE AS FOLLOWS: Section 1. That the City Council approve to amend the Agreement with Contractor Compliance Monitoring, Inc. (CCMI) for an additional amount of $5,000 to provide a Third Party Labor Compliance Program. Section 2. That all other provisions of CCMI's proposal as incorporated in the Agreement dated August 4, 2015 shall remain the same and the City Manager is authorized to approve changes in the contract price to conform to the Preliminary Fee Proposal /Cost and Price Summary provision of CCMI's proposal. Section 3. That the City Council authorize the Mayor to execute the Amendment to the Agreement in a form. approved by the City Attorney attached hereto as Exhibit A. Section 4. That the City Council authorizes the carry-over of the purchase order for CCMI to the following fiscal year. Section 5. That this Resolution shall take effect immediately upon its adoption. Section 6. That the City Clerk shall certify as to the adoption of this City Council Resolution. PASSED, APPROVED and ADOPTED this 24th day of November, 2015. WHEREAS, the City of Lynwood and Contractor Compliance and Monitoring Inc. (CCMI), have entered into an Agreement, dated August 4, 2015, which Agreement sets forth the terms and conditions for providing labor monitoring compliance for the Yvonne Burke -John D. Ham Park Community Center (Project); and WHEREAS, the August 4, 2015 Agreement includes the proposal from CCMI, incorporating a Preliminary Fee Proposal /Cost and Price Summary; and WHEREAS, an additional fee payment to CCMI in the amount of $5,000 for which the fee is based on is necessary based on actual cost of the construction and actual scope of the Project; and WHEREAS, the Consultant is willing to continue service to the City without interruption. NOW, THEREFORE in consideration of mutual covenants and agreements hereinafter contained, the parties hereto do hereby agree as follows: 1. That Consultant will be compensated an additional $5,000 for services to provide labor compliance work. 2. All other terms and conditions of said Agreement dated August 4, 2015, shall remain unchanged and the City Manager is authorized to approve changes in contract price to conform to the Preliminary Fee Proposal /Cost and Price Summary provision of CCMI's proposal.
