HomeMy Public PortalAbout88-108RESOLUTION NO. 88-108 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON GRANTING A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY THE CITY COUNCIL OF THE CITY OF CARSON DOES FIND, DECLARE AND RESOLVE AS FOLLOWS: Section I. An application was duly filed by American Transportation Enterprises, Inc., a California corporation, for a Certificate of Public Convenience and Necessity to operate six (6) taxicabs in the City of Carson. Section 2. The City Council held a public hearing on October 4, 1988, at which time the Council considered the evidence, both written and oral, including the applicant's certified financial report, presented to it in connection with this application. Section 3. In accordance with Section 6506 of the Carson Municipal Code, the City Council hereby finds and declares that the public convenience and necessity require the proposed service and the following conditions exist: (1) That the applicant is financial ly,'responsible and that the officers of said applicant are of good moral character. (2) That the persons holding permits or licenses for the operation of motor vehicles for hire are under an experienced and efficient management earning a fair and reasonable return on the capital devoted to such service. (3) That the applicant has complied with the provisions of all City, State and Federal laws applicable to the proposed operations. (4) That the service requested will not result in a greater hazard to the public and will not create traffic congestion or parking problems, due to the small number of taxis currently operating in the City and proposed to be operated by this application. (5) That the vehicles described in the application and proposed to be used are adequate and safe for the purpose intended. (6) That the color scheme, insignia, name, monogram, or other distinguishing characteristics proposed to be used on such vehicle or vehicles is not in conflict with and does not imitate any color scheme, insignia, name, monogram or other distinguishing characteristics used by any person, in such manner as to mislead or tend to mislead, deceive or defraud the public; and that no other color scheme, insignia, name, monogram or other distinguishing characteristic has heretofore been designated for such applicant. (7) That the existing twenty (20) taxicabs operating in the City are inadequate to meet the public need. (8) That all the information contained in the application has been verified as true and sufficient. (9) That there are no taxicab stands proposed for applicant's service. Section 4. The City Council finds that applicant is fit, willing and able to perform such public transportation and to conform to the provisions of the Carson Municipal Code and all rules promulgated by the City Administrator. The City Council further declares that upon compliance by applicant with the provisions of Section 6510 of the Carson Municipal Code, the City Administrator shall issue a Certificate of Public Convenience and Necessity. Such certificate shall be valid for a period of one (1) year and shall specifically designate that six (6) taxicabs are authorized to be operated by Applicant. Section 5. The rates to be charged by applicant are established as follows: (1) Flag Drop: $1.90 for the first 1/5 mile or fractional part thereof. (2) Mileage: $0.20 for each additional 1/7 mile or fractional part thereof. (3) Time: $0.20 for each one (1) minute of waiting time or traffic delay or fractional part thereof.
