A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARSON GRANTING THE APPEAL OF THE PLANNING
COMMISSION DECISION TO REQUIRE A DEED RESTRICTION
AS A CONDITION OF APPROVAL OF DOR 437-88 AND
PARCEL MAP NO. 19768.
THE CITY COUNCIL OF THE CITY OF CARSON RESOLVES AS FOLLOWS:
Section 1. On September 6, 1988 and on September 20,
1988, the City Council considered an appeal by Allwin Invest-
ment Corporation from the Planning Commission's requirement
of a deed restriction specifying "first class full service
restaurants." The applicant requested that the deed restriction
be deleted from the Conditions of Approval for Tentative Map
No. 19768 and Design Overlay Review No. 437-88.
Section 2. After a public hearing at which all
interested persons appeared and were heard, the Council finds
that Condition No. 51 of Tentative Parcel Map No. 19768 and
Condition No. 24 of Design Overlay Review No. 437-88, imposing
a deed restriction, are not necessary for the public health,
safety and welfare.
Section 3. The appeal of Ailwin Investment Corpora-
tion is granted. Condition No. 51 is removed from Exhibit "B" to
Planning Commission Resolution No. 88-1141 and Condition No. 24
is removed from Exhibit "B" to Planning Commission Resolution
No. 1142.
