HomeMy Public PortalAbout90-072RESOLUTION NO. 90-072 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON GRANTING CONSENT AND JURISDICTION TO THE COUNTY OF LOS ANGELES IN THE MATTER OF COUNTY LIGHTING MAINTENANCE DISTRICT 1697 AND COUNTY LIGHTING DISTRICT LLA -1 CITY OF CARSON ZONE PROJECT NOS. 205-98 AND 208-98 WHEREAS, the Board of Supervisors of the County of Los Angeles is about to commence proceedings under Divisions 7 and 15 of the Streets and Highways Code, for the annexation of territory to County Lighting Maintenance District 1697 and County Lighting District LLA -1; and WHEREAS, the proposed annexation will have street lights installed in the City of Carson; and WHEREAS, all of the land included in the proposed annexation lies within the boundary of the City of Carson, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carson, as follows: SECTION I That the public interest, convenience and necessity require the maintenance of a street lighting system located within said territory as shown on the maps of the annexation of County Lighting Maintenance District 1697 and County Lighting District LLA -1 on file in the office of the Department of Public Works. SECTION II That this City Council hereby consents to the annexation of said territory, as shown on the attached maps and/or described in the attached legal description, included within the boundaries of said annexation, and lying within the boundary of the City of Carson. SECTION III That this City Council hereby finds and determines that the land included within the boundary of the proposed annexation lying within the boundary of the City of Carson, will be benefited by the said proposed annexations, and hereby consents to the inclusion of said lands within the proposed annexation and to the assessment thereof. SECTION IV That the consent of this City is hereby given to the commencement of the proceedings for said annexation to County Lighting Maintenance District 1697 and County Lighting District LLA -1 by the Board of Supervisors of the County of Los Angeles, and to the exercise of exclusive jurisdiction of said Board of Supervisors over all proceedings necessary thereto for the purpose of consummating the same, all in accordance with the provisions of Division 7 and 15 of the Streets and Highways Code. SECTION V That the City Clerk of City Council is hereby directed to certify and deliver two copies of this resolution to the Department of Public Works of the County of Los Angeles. Resolution No. 90-072/Page 2 of 4 SECTION VI The City Clerk shall certify to the passage of this resolution by the City Council of the City of Carson, and shall cause the same to be posted in three (3) conspicuous places in the City of Carson, and it shall thereupon take effect. Kawagoe, City Clerk of the City of Carson, California, do hereby certify that the whole number of members of the City Council of said City is five; that the foregoing resolution, being Resolution No. 90-072 was duly and regularly adopted by the City Council of said City at a regular meeting of said Council, duly and regularly held on the 5th day of June, 1990, and that the same was so passed and adopted by the following vote: AYES: COUNCIL MEMBERS: McDonald, Mitoma, Muise, Calas, and DeWitt NOES: COUNCIL MEMBERS: None ABSTAIN: COUNCIL MEMBERS: None ABSENT: COUNCIL MEMBERS: None City Clerk, City of Car son, `California RESOLUTION NO. 90-073 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON AUTHORIZING THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM TO GRANT AN ADDITIONAL DESIGNATED PERIOD OF TWO YEARS SERVICE CREDIT FOR THE CITY OF CARSON PURSUANT TO GOVERNMENT CODE SECTION 20818. THE CITY COUNCIL OF THE CITY OF CARSON HEREBY RESOLVES AS FOLLOWS: Section 1. The city of Carson (City) is a member of the Public Employees' Retirement System. Section 2. The City has been advised by the Contracts Office of the Field and Contracts Services Division of the Public Employees' Retirement System that if the City desires an additional designated period of two years service credit pursuant to Government Section 20818, the City Council should request the designated period based on the contract amendment effective May 16, 1983, which provided two years service credit for eligible local miscellaneous members. Section 3. The City Council certifies that it is electing to utilize the provisions of Government Code Section 20818 because of impending mandatory transfers, demotions, or layoffs that constitute at least one percent of the designated job classification, department or organizational unit. The impending mandatory transfers, demotions or layoffs result from a curtailment and/or change in the manner the City performs services. Section 4. The City Council certifies that it is its present intention that if any early retirements are granted after receipt of service credit pursuant to Government Code Section 20818, any vacancies thus created or at least one vacancy in any position in the designated department or other organizational unit shall remain permanently unfilled. The unfilled vacancies shall result in an overall reduction in the work force of the designated department or organizational unit. Section 5. It is resolved that the City does seek an additional designated period and further resolves to direct the City Clerk to forward a certified copy of this resolution to the Public Employees' Retirement System, indicating the desire of the City Council to add an additional designated period from July 1, 1990 to December 27, 1990.
