PREVENTION" OF THE CODE OF THE BOROUGH OF
CARTERET
WHEREAS, the Borough of Carteret (the "Borough") has enacted a Flood Damage
Prevention Ordinance (the "Ordinance") which among other things, established and
designates an appointee to the position of flood prevention coordinator; and
establishes an appeal board to hear appeals from decision of the Flood Coordinator;
and
WHEREAS, the designated Flood Coordinator is deceased and the Ordinance does
not set forth a replacement mechanism; and
WHEREAS, the Mayor and Council have determined that other modification of the
Ordinance are necessary.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the
- Borough of Carteret that section 132 of the Code of the Borough of Carteret is
amended as follows:
1) Subsection 132-7 is amended by deleting the name "Edward Zanat".
2) Subsection 132-13 is amended by designating the existing language as
subsection "A". and adding a new subsection B which shall read in its
entirety as follows: "B. The Program Coordinator shaI1 be appointed by
the Mayor with the advise and consent of the Council".
3) Subsection 132-15 is amended as follows:
(a) deleting the term "Flood Coordinator" wherever it appears and
replacing it with "Program "Coordinator"
(b) subsections 132-15 A(1),(2) and (3) are amended to delete the
Borough Engineer as a member of the Appeal Board and replace
him with the Zoning Board of Adjustment and Planning Board
Engineers.
(c) Subsections 132-15 A(1),(2) and (3) are further amended to include
after the last work the following sentences: "The Zoning Board and
Planning Board member to serve on the Appeal Board shall be
selected by the respective Boards from among their members. The
Zoning Board and Planning Boards may also select alternates to
serve in the absence of the appointed member".
BE, IT FURTHER, ORDAINED that this Ordinance shall take effect immediately
and shall be forwarded to the secretary of the Carteret Zoning Board of Adjustments
and the Carteret Planning Board.
