All records in any way related to any correspondence of Jones - Foster on behalf of the Town to or from Martin O'Boyle or any record created by Jones - Foster and forwarded to Martin O'Boyle, which was created or received during the period of time from March 1, 2014 through to the moment you receive this request. Records requested include but are not limited to notes, memos, letters, emails, phone logs, phone messages, photos, files, folders, labels, sketches, drawings, layouts, plans, invoices, statements, reports, correspondence, reference material, minutes, audio, video, manuals, drafts and any other record in any way responsive to this request. Please include records from all email accounts in the control of all town officials, appointees and employees and include all records that are responsive to this request. If you contend that any of the records 1 am seeking, or any portion thereof, are exempt from inspection or disclosure please cite the specific exemption as required by Florida Statute & 119.07(1)(e) and state in writing and with particularity the basis for your conclusions as required by Florida Statute &119.07(1)(f). Please take note of Florida Statue &119.07(c) and your affirmative obligation to (1) promptly acknowledge receipt of this public records request and (2) make a good faith effort which "includes making reasonable efforts to determine from other oJTcers or employees within the agency whether such a record exists and, ifso, the location at which the record can be accessed." I am, therefore, requesting that you notify every individual in possession of records that may be responsive to this public records request to preserve all such records on an immediate basis. If some records that are responsive to my request are obtainable sooner than other responsive records, 1 wish to receive those records as soon as they are available and 1 wish to receive the other records as soon as they become available. I request that no responsive records be withheld from me while waiting for other responsive records to be found. If the records are not available as digital records then please email me with instructions for me to pick the records up from you. I would prefer the records in electronic or digital form. If the public records being sought are maintained by your agency in an electronic format please produce the records in the original electronic format in which they were created or received. See Florida Statute §119.01(2)(1). If you anticipate the production of some of these public records will require a search of sufficient duration as to require any deposit payment from me, please notify me of any such required payment prior to conducting any portion of that search which would require such payment. Please first produce any responsive records that are readily available and do not require any deposit payment prior to producing. If you anticipate the production of these public records to exceed $1.00 please notify me in advance of their production with a written estimate of the total cost. Please be sure to itemize any estimates so as to indicate the total number of pages and/or records, as well as to distinguish the cost of labor and materials prior to you expending any resources that would require payment from me. Dear review.content.apply@gmail.com, This letter provides the estimated costs for the production of public records that the Town of Gulf Stream (the "Town") understands you to have requested in your email dated May 14, 2014, that we acknowledged on May 16, 2014. Because you have failed to sufficiently identify all of the public records that you seek, this letter also requests clarification of several items referenced in your request and identifies certain assumptions made by the Town of Gulf Stream about your request that have affected its estimate. First, you seek records "received" during a specified time period but fail to identify the individual or entity receiving the records. For purposes of this estimate, the Town assumes that you seek records "received" by Mr. O'Boyle. The Town further notes that there is no way to know the exact date something is "received" by Mr. O'Boyle. Accordingly, the Town assumes that you seek records which were "sent" to Mr. O'Boyle within the date range you have specified. Second, your request asks for records "forwarded to Martin O'Boyle," but does not specify by whom. The Town understands your request to seek records forwarded to Mr. O'Boyle by Town officials, appointees and employees or the law firm of Jones, Foster, Johnston, & Stubbs ("Jones Foster"). Third, the Town assumes that when you refer to Martin O'Boyle, you are referring to Martin O'Boyle individually and not to any attorneys, agents or others acting on Mr. O'Boyle's behalf or at his direction. Fourth, the Town requests clarification of your request for "[a]ll records in any way related to" "correspondence of Jones -Foster" "or any record created by Jones Foster." The estimate currently provided by the Town is for the production of public records that are (1) correspondence sent by Jones Foster on behalf of the Town to or from Martin O'Boyle from March 1, 2014 to May 14, 2014 and (2) any record created by Jones -Foster and forwarded to Martin O'Boyle from March 1, 2014 to May 14, 2014. The Town cannot identify with any specificity what additional records you may seek and therefore has not provided an estimate as to any such records. The foregoing requests for clarification are made as a courtesy to you to ensure the Town is able to accurately and promptly provide you with either an estimate, if necessary, or production of all of the public records you seek. Depending on the nature of any response received from you, the Town will determine whether to provide you with a further estimate for the extensive use of information technology resources or extensive clerical or supervisory assistance as described in Fla. Stat. § 119.07(4)(d). Absent clarification from you and subject to the foregoing assumptions, to produce the documents that the Town understands you have requested, the Town estimates the need for 48 minutes of administrative support at $27.50, the labor cost of the personnel providing the service, per Fla. Stat. § 119.07(4)(d). Please be advised that this is only an estimate and the actual cost of production may be higher or lower. The Town respectfully requests a deposit of $22.00 for the production of the documents that were sent by the Town or Jones Foster to Mr. O'Boyle during the date range specified. Once the Town has received your deposit, staff will act promptly to produce the requested records and will apply your full deposit to the total production costs. If the costs are less than the deposit, the Town will provide you with a refund of the difference. If the actual production costs exceed the deposit, the Town will send you a letter with an estimate for the additional cost of production and require an additional deposit.
