HomeMy Public PortalAbout94-040 RESOLUTION NO. 94-040 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON DELINEATING CERTAIN LOCATIONS FOR THE INSTALLATION AND OPERATION OF PIPELINES OR OTHER FACILITIES IN CONNECTION WITH A FRANCHISE GRANTED TO GATX TANK STORAGE TERMINALS CORPORATION THE CITY COUNCIL OF THE CITY OF CARSON HEREBY FINDS, RESOLVES, AND ORDERS AS FOLLOWS: Section 1. The City of Carson granted a pipeline franchise to Continental Oil Corporation by Ordinance No. 76-383 and by Ordinance No. 87-779 amended Ordinance No. 76- 383 whereby the City consented to the assignment and transfer to GATX Terminals Corporation of the pipeline franchise previously granted to Continental Oil Corporation. Section 2 . Said Ordinance provides that the franchisee may not install or operate any facilities in, under, along or across any streets within the City of Carson without prior approval by Resolution of the City Council. Section 3 . The City Council finds that the public interest would be served by limiting the installation and operation of pipelines and appurtenant facilities to those certain streets, highways, roads, alleys and other public places dedicated to public use shown on the map attached hereto as Exhibit "All and described as follows: A 10-inch diameter pipeline commencing at the 110 Harbor Freeway approximately 40 feet north of the center line of Del Amo Boulevard. From its original point, the 10-inch diameter pipeline traverses in an eastward direction for approximately 1, 152 feet. At this point, the 10-inch diameter pipeline turns in a southerly direction in Main Street, approximately 10 feet west of the center line. The 10-inch diameter pipeline continues in Main Street in a southerly direction for approximately 7 , 820 feet, at which point the 10-inch diameter pipeline turns in an eastward direction for approximately 40 feet, at which point the 10-inch diameter pipeline turns in a southerly direction for approximately 334 feet, all in Main Street. At this point, the 10-inch diameter pipeline turns in an easterly direction in 223rd Street approximately 34 feet north of the center line for approximately 300 feet, at which point the 10-inch diameter pipeline turns in a southerly direction for approximately 40 feet. At this point, the 10-inch pipeline turns in an easterly direction in 223rd Street approximately 5 feet south of the centerline for approximately 5 , 504 feet, all in 223rd Street. At this point, the pipeline connects to the existing GATX fl- inch jet fuel pipeline system near the intersection of 223rd Street and Cluff Street. The route of the existing 8-inch jet fuel pipeline system is described in the Resolution No. 90-113 . The total footage of new 10-inch diameter pipeline within the jurisdictional street limits of the City of Carson is 15 . 190 feet, more or less. Section 4 . The City Council further finds that the project involves no potential for any adverse effect, either individually or cumulatively, on wildlife resources and, for purposes of Fish and Game Code Section 711.4, makes a finding of de minimis impact in its effect on fish and wildlife. Within two (2) days after approval of this Resolution, the applicant shall deliver to the Finance Department a cashier's check or money order payable to the Los Angeles County Clerk in the amount of $25. 00 for filing of the Notice of Determination pursuant to the California Environmental Quality Act. The approval for the project granted herein may automatically be considered null and void if the payment is not made by the applicant as provided herein. 2 . If the Department of Fish and Game rejects the Certificate of Fee Exemption and requires payment of fees, the applicant shall deliver to the Finance Department, within two (2) days of notification, a cashier's check or money order payable to the Los Angeles County Clerk in the amount of $1,250 pursuant to Fish and Game Code Section 711. 4. If this fee is imposed, the project approval shall not be operative, vested or final unless and until the fee is paid. Section 5. The installation of pipelines is approved within the limitation stated in Section 3 hereof.
