The Regular Meeting will begin at 6:00 p.m. and the first item on the agenda is an executive session with Special Counsel to discuss a proposed annexation agreement. The Consent Agenda includes the minutes and a resolution is provided authorizing execution of a contract for sewer inspection and cleaning services. The Consent Agenda should be approved by a Roll Call Vote given that it includes a contract for services. Resolution 2012-03-05 Regarding Byers Peak Ranch Annexation is provided for st consideration as a follow up to the discussion at the March 21 meeting. At that time, the Town Board continued consideration of the resolution to this meeting to allow the Annexation Committee further time to continue negotiations. The hearing on this resolution was closed st meeting. The Board could adopt this resolution which would close the at the March 21 current annexation negotiations (which could be restarted upon a new petition from the property owner) or once again continue consideration of the resolution for some period of time to allow further negotiations. Two Ordinances are provided in the packet to either establish a licensing program for Medical Marijuana Centers or prohibit Medical Marijuana Centers. The Board will need to adopt one of these at this meeting prior to expiration of the statewide moratorium on June th 30. Information regarding the Variance and Off Premise Sign is provided in the Planner Briefing. At the prior meeting, the Town Board heard a presentation regarding the Chamber Branding Program and we are seeking further discussion regarding the program. The Town has managed a business directory program at our major intersections for about ten years. An update or overhaul of the program seems timely, note that even the logo is outdated. Of course, there are expenses involved so we’d like to discuss the merits of the program along with where we ought to be headed (the goal of the program is to help the vitality of our local businesses). The ordinance would address this issue. e) Out of town water and sewer service – This has been discussed by the Water and Wastewater Committee regarding providing services and fees for such services. Meeting adjourned at 9:08 p.m. Lu Berger, Town Clerk  /GOQTCPFWO  To: Mayor Smith and Board of Trustees From: Allen Nordin, Director of Public Works Date: June 19, 2012 Subject: Consent Agenda Item: 2012 Sewer Inspection & Cleaning Contract Expenditures The following is an outline of expenditures related to our sanitary sewer collection system maintenance program based on the 2012 budget appropriation of $50,000 for repair and maintenance items and $70,000 for capital improvement projects. With over 96,000 lineal feet (18.2 miles) of sanitary sewer pipe ranging in size from 6 inch to 24 inch, it is necessary to maintain this infrastructure through video documentation and jetter (high pressure water) cleaning. The maintenance program is structured in a way to allow the entire collection system to be inspected over a seven year period, for a total of 7 separate service areas. This is an aggressive schedule but it is necessary to take this approach in order to educate ourselves on the condition of the pipes in the ground in an effort to identify and budget accordingly to make all necessary repairs. In 2010 the maintenance program was initiated in the Ptarmigan area including Fox Run and Wapiti Meadows. Approximately 7,700 LF of Town owned sewer lines were cleaned and video documented. Two areas were identified that needed to be repaired, Ermine Lane and Ferret Lane, where an 8 inch main was obstructed due to a section of ductile iron pipe (DIP) having settled over time and created an off-set at both ends of the joints. The inspection/cleaningcrews were not able to pass their camera or jetter nozzle through these failures. DIP was installed in these two areas where a water line crossing was necessary per town standards. These areas were repaired in mid June 2012 and included patching the asphalt at a cost of approximately $7,700. The proposed 2012 maintenance program is slated to complete the balance of the lines in the original service areas of Fraser that were not slip lined during the 2010-11 Cure-In-Place-Pipe (CIPP) lining program. Those lines were inspected, jetted and video documented pre and post construction of the CIPP project. Other service areas slated for maintenance in 2012 include Cozens approximately 12,000 lineal feet of varying pipe sizes from 8 inch to 12 inch. As we have established a very good working relationship with Anderson Services out of Golden it is anticipated that we will contract with them for this work. The work is anticipated to begin sometime during the last week of June and should take approximately two weeks to complete. Resolution 2012-06-03 Recommendation is for approval of authorizing expenditures for the 2012 Sewer Collection Line Inspections (video and cleaning) program and authorizing the Town Manager to enter into a contract for the work in an amount Not-To-Exceed $18,000. Votes in favor: ___ BOARD TRUSTEES OF THE Votes opposed: ___ TOWN OF FRASER, COLORADO Absent: ___ Abstained: ___ BY: Mayor ATTEST: (S E A L) Town Clerk TOWN OF FRASER RESOLUTION NO. 2012-03-05 A RESOLUTION REGARDING THE ANNEXATION PETITION FOR THE PROPERTY KNOWN AS BYERS PEAK RANCH WHEREAS, an Amended Petition for Annexation of the Byers Peak Property was filed with the Town of Fraser on November 26, 2007; and WHEREAS, a Public Hearing was held on February 6, 2008 for the purpose of determining if the proposed annexation complies with Sections 31-12-104 and 31-12-105 of Colorado Revised Statutes, or such parts thereof as may be required to establish eligibility for annexation; and WHEREAS, the Town Board adopted Resolution 02-01-08 which determined that the property is eligible for annexation and that action on the proposed annexation shall be deferred until the terms of the annexation agreement are negotiated, or until the Board otherwise determines to act upon said proposed annexation WHEREAS, the Town of Fraser and Byers Peak Properties entered into a Pre- Annexation agreement on October 6, 2010 in order to confirm their understanding and agreement as to how annexation negotiations and proceedings would be conducted; and WHEREAS, the Pre-Annexation Agreement provides that the parties will enter into good faith negotiations to develop a mutually acceptable annexation and development agreement; and WHEREAS, the Pre-Annexation Agreement provides that the Town may deny the Petition at any time if it concludes that the parties cannot reach a consensus on an annexation and development agreement, or if the Town decides not to annex the property for any other reason. WHEREAS, the Planning Commission held Public Hearings in regarding the proposed zoning for the property on March 23, 2011, April 27, 2011, and May 25 2011 and recommended Planned Development District Zoning with conditions, many of which might be addressed via an Annexation Agreement and were therefore subject to Town Board negotiations; and WHEREAS, the Town Board established Annexation Committee who met regularly with Staff and the Town Board reviewing proposed terms and conditions and also met with the proponents on October 26, 2011, November 2, 2011, December 6, 2011. Additional meetings were scheduled and then cancelled during 2012 due to a lack of progress toward mutually acceptable terms; and WHEREAS, on February 27, 2012 the Town was provided with a Notice and Joinder of property subject to the 2007 Annexation Petition that had been conveyed in 2009 from Byers Peak Properties to Byers Peak Downhill Properties; and WHEREAS, it is the policy of the Town Board that development should occur within incorporated areas and that it should occur in a manner that is not detrimental to, or at a cost to, other properties within or citizens of the Town; and WHEREAS, the Town of Fraser and petitioner have worked diligently and expended significant resources pursuing mutually agreeable terms and conditions of annexation; and WHEREAS, the most recent annexation agreement language provided to the Town is not meaningfully closer to mutually agreeable terms than drafts provided over one year ago; and WHEREAS, the Town Board held a public hearing on March 21, 2012 as requested by the petitioner to allow an opportunity to clearly communicate its respective position to the Town Board and for the purpose of considering whether to continue or discontinue negotiations for an agreement regarding annexation and development of the subject property, and/or to deny the Annexation Petition in accordance with the provisions of the Pre-Annexation Agreement. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO THAT: 1. The Board finds and determines that the Town has been unable to reach an agreement with the owners of the property that is the subject of said Petition for Annexation, despite good faith efforts, and it is unlikely that further negotiations would result in a mutually acceptable agreement at this time. The major issues and concerns on behalf of the Town relating to the annexation and development of said property are summarized in the Memorandum to Byers Peak Properties from the Town Board, dated February 15, 2012, which was made a part of the record of the public hearing. The Board finds that the property owners have failed to satisfactorily address those issues and concerns in a manner that justifies continued efforts by the Town to resolve the same. 2. The Board hereby rejects and denies said Petition for Annexation and terminates all proceedings relating to said Petition, without prejudice, however, to consideration of a future petition for annexation of all or part of the same property included in said Petition. 3. The Pre-Annexation Agreement provides that owner shall reimburse the Town for all outside costs incurred in connection with annexation and related zoning proceedings, including without limitation all expenses of outside consultants. To date, the Town has expensed over $60,000 in legal fees that have not been charged to petitioner given the status of our negotiations. Pursuant to the terms of the Pre-Annexation Agreement, the $10,000 deposit will be applied toward those expenses. Votes in Favor: Votes Opposed: Absent: Abstained: BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO (S E A L) By: Mayor ATTEST: Town Clerk TOWN OF FRASER ORDINANCE NO. 396 Series 2012 AN ORDINANCE AMENDING THE FRASER MUNICIPAL CODE BY ADOPTING LICENSING AND OPERATIONAL REQUIREMENTS FOR MEDICAL MARIJUANA BUSINESSES WITHIN THE TOWN OF FRASER; REPEALING THE EXISTING MORATORIUM REGARDING THE LICENSING OF SUCH BUSINESSES; AND DECLARING AN EMERGENCY. WHEREAS, Article XVIII, Section 14 of the Colorado Constitution creates an affirmative defense for the medical use of marijuana to state criminal statutes prohibiting the cultivation, possession, and use of marijuana; and WHEREAS, the Colorado General Assembly has adopted the Colorado Medical Marijuana Code C.R.S 12-43.3-101 et seq., which provides statutory authority for the operation of businesses for the purpose of manufacturing, possessing, and distributing marijuana for medical purposes without regard to whether the business or its owner, managers, employees, or suppliers are "primary caregivers" pursuant to Article XVIII, Section 14; and WHEREAS, the Colorado Medical Marijuana Code, in Section 12-43.3-106, C.R.S., provides a local option for local governments to prohibit the operation of medical marijuana businesses by vote of the registered electors or by action of the local governing body; and WHEREAS, the Colorado Medical Marijuana Code also provides authority for local governments to adopt local regulations concerning the licensing and operation of medical marijuana businesses if such businesses are not prohibited, which local regulations are in addition to those imposed by the state; and WHEREAS, the Fraser Board of Trustees, by Ordinance 372, submitted a ballot question to the registered electors at a special election held on November 2, 2010, asking whether the Town should prohibit medical marijuana businesses, which ballot question was defeated; and WHEREAS, at the same special election, the registered electors approved a ballot question to impose an additional excise tax on the sale of medical marijuana, medical marijuana paraphernalia, and medical marijuana-infused products, at the rate of five percent of the gross amount paid in connection with such sales; and WHEREAS, the Board of Trustees has previously adopted a temporary moratorium on the licensing of medical marijuana businesses pending the adoption of state and local regulations regarding such businesses, such moratorium having been extended through July 1, 2012 pursuant to Ordinance No. 390; and WHEREAS, the Board of Trustees is now prepared to adopt local regulations regarding the local licensing and operation of medical marijuana businesses, as provided in this Ordinance and in accordance with the Colorado Medical Marijuana Code; and WHEREAS, the Board of Trustees finds and determines that the provisions of this Ordinance and the regulations herein adopted for the licensing and operation of medical marijuana businesses are reasonable and necessary to protect and preserve the health, safety and welfare of the citizens of the Town of Fraser, Colorado. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO, AS FOLLOWS: PART 1: AMENDMENT OF MUNICIPAL CODE. 1.1 The Code of the Town of Fraser, Colorado (herein sometimes referred to as the "Municipal Code"), is hereby amended by adding a new Article to Chapter 6 of said Code, to be numbered "Article 5 - Medical Marijuana Businesses", which shall read as set forth in Exhibit "A" attached hereto and incorporated herein by this reference. 1.2 The Fee Schedule set forth in Appendix A of the Municipal Code is hereby amended by adding the following fee under Chapter 6 of said Appendix A: Municipal Code-Based Fees, Costs and Deposits Code SectionFee/ChargeAmount Chapter 6 6-5-60Application fee for new medical marijuana $5,000.00 plus reimbursement of any business license additional fees or expenses incurred by the Town and/or reimbursement of any Town expenses incurred in excess of this amount. 6-5-60Annual license fee for each medical marijuana $5,000.00 plus reimbursement of any center, optional premises cultivation operation, additional fees or expenses incurred by or medical marijuana-infused products the Town and/or reimbursement of any manufacturer (separate fee for each operation Town expenses incurred in excess of this and/or location) amount. 6-5-60Late renewal fee (C.R.S. 12-43.3-311(2)(a)) $500.00 6-5-60Change of location application fee $700.00 6-5-60Modification of premises application $700.00 6-5-60Change of corporate structure/officers/directors$500.00 - 2 - (for each owner/officer/director added) 6-5-60Manager registration (if not an owner) $500.00 6-5-110Transfer of ownership application fee (new $5,000.00 entity) PART 2: REPEAL OF MORATORIUM. 2.1 The temporary moratorium on the licensing of medical marijuana businesses, as most recently extended pursuant to the provisions of Ordinance No. 390, is hereby repealed effective as of the date this Ordinance takes effect. PART 3: PENALTY CLAUSES. The following section of the Code of the Town of Fraser, Colorado, contains penalty clauses applicable to violations of this Ordinance, and such section is herewith set forth in full and hereby enacted: Sec. 1-4-10. General penalty for violation. It shall be unlawful for any person to violate, disobey, omit, neglect, refuse or fail to comply with or resist the enforcement of any provision of this Code; and where no specific penalty is provided therefor, the violation of any provision of thisCode shallbe punished by a fine not exceeding one thousand dollars ($1,000.00), by imprisonment for a term not exceeding one (1) year, or by both such fine and imprisonment. Each day such violation continues shall be considered a separate offense PART 4: REPEAL. In addition to the repeal of the temporary moratorium, as provided in Part 2 hereof, any and all existing ordinances or parts of ordinances of the Town of Fraser covering the same matters as embraced in this Ordinance are hereby repealed and all ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed; provided, however, that such repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this Ordinance. PART 5: SEVERABILITY. If any section, subsection, sentence, clause or phrase of this Ordinance or the said Codes adopted herein is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this Ordinance or said Codes. The Town of Fraser hereby declares that it would have adopted this Ordinance and said Codes, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases thereof be declared invalid or unconstitutional. - 3 - PART 6: DECLARATION OF EMERGENCY; EFFECTIVE DATE. Because of the immediate risk that inappropriate medical marijuana businesses might be permitted upon expiration of the existing state and local moratoriums, the Board of Trustees hereby finds, determines, and declares that an emergency exists, that this Ordinance is necessary for the immediate preservation of public peace, health, safety and welfare, and that it shall be in full force and effect immediately upon adoption. (a) As used in this Article the following words shall have the following meanings, unless the context clearly requires otherwise: (1)MM Code means the Colorado Medical Marijuana Code, C.R.S. 12-43.3-101 et seq. (2)MM Regulations means the Rules Regarding Sale, Manufacturing and Dispensing of Medical Marijuana, 1 CCR 212-1, as adopted by Medical Marijuana Enforcement Division of the Colorado Department of Revenue, and any amendments thereto. (3)Medical Marijuana Business means a medical marijuana center, optional premises cultivation operation, or medical marijuana-infused products manufacturer for which a license is required under the MM Code and this Article. (b) The terms defined in the MM Code and MM Regulations shall have the same meaning when used in this Article, unless context clearly requires otherwise. Sec. 6-5-20.License required. It is unlawful for any person to own or operate a Medical Marijuana Business within the Town of Fraser without first having obtained from the Town and the state a license for each facility to be operated in connection with such business. Sec. 6-5-30. Local Licensing Authority. (a) The Fraser Board of Trustees shall be the local licensing authority for the licensing of Medical Marijuana Businesses pursuant to this Article, unless the Board designates other persons to serve as the local licensing authority. The local licensing authority shall possess all powers given to local licensing authorities by the provisions of the MM Code and MM Regulations. Any decision made by the local licensing authority to grant or deny a license, to revoke or suspend a license, or to renew or not renew a license shall be a final decision and may be appealed to the district court pursuant to Rule 106(a)(4) of the Colorado Rules of Civil Procedure. (b) The Town Clerk shall assist the local licensing authority by receiving all applications; coordinating with other Town officers and departments when relevant; scheduling required public hearings; and providing notice in accordance with this Article and the MM Code. Sec. 6-5-40. Limitations and Requirements Applicable to Medical Marijuana Businesses. State Requirements (a): Medical Marijuana Businesses must at all times comply with the regulations and requirements contained in the MM Code and MM Regulations with regard to applications, licensing and operations of licensed premises. Location (b): Medical Marijuana Businesses shall only be located on property within the Business zoning district. Medical Marijuana Businesses are not permitted within any other zoning district or within any building that contains a residential dwelling or lodging unit. Medical Marijuana Businesses shall not be permitted to operate as "home occupations." Separation Requirements: (c) (1) No Medical Marijuana Business shall be issued a license if, at the time of the initial application for such license, the proposed location is: (i) within one thousand feet of any educational institution or school, either public or private; (ii) within one thousand feet of any existing Medical Marijuana Business, whether such business is located within or outside of the Town; (iii) within two hundred feet of any existing licensed child care facility. (2) The distances set forth in this subsection shall be computed by direct measurement in a straight line from the nearest property line of the land used for the purposes stated above, respectively, to the nearest portion of the building in which the Medical Marijuana Business is located. The locational criteria contained in this subsection shall apply to all proposed changes in the location of an existing license. Advertisements (d): Advertisements, signs, displays or other promotional material depicting medical marijuana uses or symbols shall not be shown or exhibited off the premises. No signage associated with a medical marijuana center shall use the word "marijuana," "cannabis," or any other word or phrase commonly understood to refer to marijuana. No signage may display photographs or other representations of marijuana plants. Indoor Operation; Odors (e): (1) All medical marijuana dispensing, production, cultivation, manufacturing and storage activities shall be conducted indoors. Products, accessories, and associated paraphernalia shall not be visible from a public sidewalk or right of way. (2) The cultivation of marijuana is only permitted when the premises are equipped with a system that removes the odors of the marijuana being cultivated so that the odor is not detectable from the exterior of the business or from within any adjoining premises. Approval of the odor removal system by the Building Official is required prior to any cultivation process beginning. The Building Official’s determination of the adequacy of any proposed odor-removing system shall be - 2 - based on his reasonable determination of the ability of the proposed system to remove odors as required by this subsection, which determination shall be based upon the manufacturer’s or an engineer’s design specifications for the system as they relate to the premises in question. Inspection of Licensed Premises: (f)During all business hours and other times of apparent activity, all licensed premises shall be subject to inspection by the Chief of Police or the Building Official, or the authorized representative of either of them, for the purpose of investigating and determining compliance with the provisions of this Article and any other applicable state or local law or regulation. Such inspection may include, but need not be limited to, the inspection of books, records and inventory. Where any part of the premises consists of a locked area, such area shall be made available for inspection, without delay, upon request. Additional Requirements: (g) Medical Marijuana Businesses shall be subject to the following additional requirements: (1) The business may only be open for the sale or distribution of medical marijuana during the hours of 8:00 a.m. to 7:00 p.m. (2) No on-site consumption of marijuana is allowed. (3) A Fraser business license and sales tax license are required. (4) No mobile structure may be used to dispense medical marijuana. (5) No alcohol sales or consumption shall be permitted on the licensed premises. (6) A licensee shall not permit persons who do not possess a valid registry card or other appropriate credentials to loiter on or about the licensed premises. Sec. 6-5-50. Excise Tax. (a) A tax is imposed upon all retail sales of medical marijuana, medical marijuana paraphernalia, and medical marijuana-infused products made within the town of Fraser by licensed Medical Marijuana Businesses at the rate of five percent (5.0%) of the gross price paid by the purchaser, rounded off to the nearest penny. The tax imposed by this section is in addition to, and not in lieu of, the sales tax owed to the Town in connection with the sale of medical marijuana, medical marijuana paraphernalia, and medical marijuana-infused products. (b) Except for those provisions that by their terms cannot apply, the procedures for the collection and enforcement of the Town's use tax as provided in Section 4-3-50(a) of this Code shall apply to the collection and enforcement of the medical marijuana excise tax imposed by this section. The Town Manager or his or her designee may adopt administrative rules and regulations specifying additional or alternative procedures for - 3 - the collection and enforcement of the medical marijuana excise tax imposed by this section. Sec. 6-5-60. Application Requirements. (a) A person seeking to obtain a license pursuant to this article shall submit an application to the Town Clerk. The form of the application shall be as provided by the Town Clerk. (b) A license issued pursuant to this chapter does not eliminate the need for the licensee to obtain other required licenses and permits related to the operation of the Medical Marijuana Business, including, without limitation, any development approval required by this Code; a sales tax license; and a building, mechanical, plumbing, or electrical permit. (c) An application for a license under this article shall include the following information and any additional information required by the Town Clerk: (1) The applicant's name, address, telephone number, and Social Security number and, if the applicant is a partnership, the names and addresses of all the partners, and if the applicant is a corporation, the names and addresses of all the corporate officers, and if the applicant is a cooperative association, the names and addresses of its directors and officers; (2) A completed set of the applicant's fingerprints; (3) The street address of the proposed Medical Marijuana Business; (4) Proof of ownership; or if the applicant is not the owner of the proposed location of the Medical Marijuana Business, satisfactory proof that the applicant is or will be entitled to possession of the premises under a lease, rental agreement or other written agreement, including authorization to use premises for the specific type of Medical Marijuana Business for which the application is made; (5) An acknowledgement by the applicant that the applicant and its owners, officers, and employees may be subject to prosecution under federal laws relating to the possession and distribution of controlled substances; that the Town of Fraser accepts no legal liability in connection with the approval and subsequent operation of the Medical Marijuana Business; and that the application and documents submitted for other approvals relating to the Medical Marijuana Business operation are subject to disclosure in accordance with the Colorado Open Records Act. (d) In addition to the foregoing, an applicant shall also submit all other information required by the MM Code and MM Regulations for state and local applications. (e)When the application is filed, the applicant shall pay to the Town a non- refundable application fee in such amount as is established from time to time by ordinance or resolution adopted by the Board of Trustees and set forth in the - 4 - appendices to this Code. The purpose of the fee is to cover the administrative costs of processing the application. If the application is approved, the applicant shall also pay an annual license fee, for each licensed Medical Marijuana Business operation, in such amount as is established from time to time by the Board of Trustees and set forth in the appendices to this Code. (f) Each license issued pursuant to this chapter shall be valid for a period of one year from the date of issuance and may be renewed as provided in this section. An application for renewal shall be made to the Town Clerk not less than forty-five (45) days prior to the date of expiration and shall be accompanied by the annual license fee(s) for the renewal term. The license shall be renewed by the Town Clerk unless it appears to the Town Clerk that good cause exists to deny the renewal application, in which case the Town Clerk shall refer the application to the Board of Trustees for review at a public hearing. The Town Clerk shall refer the renewal application for public hearing only if the licensee has had complaints filed against it, the licensee has a history of violations, or there are allegations against the licensee that would constitute good cause for denial of a license as defined in the MM Code. The procedures provided in Sections 6-5-70 to 6-5-90 shall apply to the Board of Trustees' review and determination whether to renew a license. In order to be entitled to such review, the applicant shall pay an additional fee equal to the application fee for a new license. Sec. 6-5-70.Investigation of Applicant. (a) Upon receipt of an application for a license under this article, the Town Clerk shall transmit copies of the application to the Police Department, the Town Manager, the Planning and Building Department, and any other person or agency who the Town Clerk determines should participate in the review of the application. The Town or any of its departments or officials may visit and inspect the plant or property in which the applicant proposes to conduct business and investigate the fitness to conduct such business of any person, or the officers and directors of any corporation, or the partners of any partnership applying for a license. (b) In investigating the fitness of the applicant, the Town may obtain criminal history record information furnished by a criminal justice agency subject to any restrictions imposed by such agency. In the event the Town takes into consideration information concerning the applicant's criminal history record, the Town shall also consider any information provided by the applicant regarding such criminal history record, including, but not limited to, evidence of rehabilitation, character references, and educational achievements, especially those items pertaining to the period of time between the applicant's last criminal conviction and the consideration of the application for a license. (c) Not less than five days prior to the date of the public hearing on a license application or, in the event of an application for which no public hearing is scheduled, not less than five days prior to the decision to approve or deny an application, the Town Clerk shall make known the findings of the investigation in writing to the applicant and other parties of interest. - 5 - Sec. 6-5-80. Public Hearings; Notice; Publication. (a) Upon receipt of an application for a local license, except an application for renewal or for transfer of ownership, the local licensing authority shall schedule a public hearing upon the application to be held not less than thirty days after the date of the application. The local licensing authority shall post and publish public notice thereof not less than ten days prior to the hearing. The local licensing authority shall give public notice by the posting of a sign in a conspicuous place on the medical marijuana center premises for which application has been made and by publication in a newspaper of general circulation in Grand County. (b) Public notice given by posting shall include a sign of suitable material, not less than twenty-two inches wide and twenty-six inches high, composed of letters not less than one inch in height and stating the type of license applied for, the date of the application, the date of the hearing, the name and address of the applicant, and such other information as may be required to fully apprise the public of the nature of the application. The sign shall contain the names and addresses of the officers, directors, or manager of the facility to be licensed. (c) Public notice given by publication shall contain the same information as that required for the posting of signs. (d) If the building in which medical marijuana is to be sold is in existence at the time of the application, the sign shall be posted so as to be conspicuous and plainly visible to the general public. If the building is not constructed at the time of the application, the applicant shall post a sign at the premises upon which the building is to be constructed in such a manner that the notice shall be conspicuous and plainly visible to the general public. (e) The local licensing authority, or a license applicant with local licensing authority approval, may request that the state licensing authority conduct a concurrent review of a new license application prior to the local licensing authority's final approval of the license application. If the local licensing authority permits a concurrent review, it will continue to independently review the applicant's license application. Sec. 6-5-90. Issuanceor Denial of License. (a) Not less than five days prior to the date of the public hearing, the local licensing authority shall make known its findings, based on its investigation, in writing to the applicant and other parties of interest. The local licensing authority has authority to refuse to issue a license provided for in this section for good cause, subject to judicial review. (b) Before entering a decision approving or denying the application for a local license, the local licensing authority may consider, except where this Article specifically provides otherwise, the facts and evidence adduced as a result of its investigation, as well as any other facts pertinent to the type of license for which application has been made, including the number, type, and availability of medical marijuana outlets located - 6 - in or near the premises under consideration, and any other pertinent matters affecting the qualifications of the applicant for the conduct of the type of business proposed. (c) Within thirty days after the public hearing or completion of the application investigation, a local licensing authority shall issue its decision approving or denying an application for local licensure. The decision shall be in writing and shall state the reasons for the decision. The local licensing authority shall send a copy of the decision by certified mail to the applicant at the address shown in the application. (d) The Board of Trustees may impose reasonable conditions upon any license issued pursuant to this Article. (e) After approval of an application, a local licensing authority shall not issue a local license until the building in which the business to be conducted is ready for occupancy with such furniture, fixtures, and equipment in place as are necessary to comply with the applicable provisions of this chapter, and then only after the local licensing authority or its designee has inspected the premises to determine that the applicant has complied with the architect's drawing and the plot plan and detailed sketch for the interior of the building submitted with the application. (f) After approval of an application for local licensure, the local licensing authority shall notify the state licensing authority of such approval. Sec. 6-5-100. Contents and Display of License. (a) The licensee shall post the license in a conspicuous location at the Medical Marijuana Business. A Medical Marijuana Business license shall contain the following information: (1) The name of the licensee; The date of issuance of the license; The street address at which the licensee is authorized to operate the Medical Marijuana Business; (2) Any conditions of approval imposed upon the license by the Board of Trustees; (3) The date of expiration of the license; and (4) The license shall be signed by the applicant and the Town Clerk Sec. 6-5-110. Transfer of Ownership . (a)In determining whether to permit a transfer of ownership, the local licensing authority shall consider only the requirements of this Article, the MM Code and MM Regulations. The local licensing authority may hold a hearing on the application for a transfer of ownership; provided the local licensing authority shall not hold a hearing pursuant to this section until the local licensing authority has posted a notice of hearing in the manner described in Section 6-5-80 on the licensed premises for a period of ten - 7 - Sec. 6-5-120. Suspension or Revocation. (a) The local licensing authority may revoke or elect not to renew any license if it determines that the licensed premises have been inactive, without good cause, for at least one year. (b) In addition to any other sanctions prescribed by this Article, the MM Code or the MM Regulations, the local licensing authority has the power, on its own motion or on complaint, after investigation and opportunity for a public hearing at which the licensee shall be afforded an opportunity to be heard, to suspend or revoke a license issued by the local licensing authority for a violation by the licensee or by any of the agents or employees of the licensee of the provisions of this Article, the MM Code or MM Regulations, or of any of the terms, conditions, or provisions of the license. The local licensing authority has the power to administer oaths and issue subpoenas to require the presence of persons and the production of papers, books, and records necessary to the determination of a hearing that the state or local licensing authority is authorized to conduct. (c) The state or local licensing authority shall provide notice of suspension, revocation, fine, or other sanction, as well as the required notice of the hearing pursuant to subsection (b), by mailing the same in writing to the licensee at the address contained in the license. Except in the case of a summary suspension, a suspension shall not be for a longer period than six months. If a license is suspended or revoked, a part of the fees paid therefore shall not be returned to the licensee. Any license or permit may be summarily suspended by the local licensing authority without notice pending any prosecution, investigation, or public hearing pursuant to the terms of C.R.S. § 24-4-104(4). (d) Whenever a decision of the local licensing authority suspending a license for fourteen days or less becomes final, the licensee may, before the operative date of the suspension, petition for permission to pay a fine in lieu of having the license suspended for all or part of the suspension period. Upon the receipt of the petition, the local licensing authority may, in its sole discretion, stay the proposed suspension and cause any investigation to be made which it deems desirable and may, in its sole discretion, grant the petition if the local licensing authority is satisfied that: (1) The public welfare and morals would not be impaired by permitting the licensee to operate during the period set for suspension and that the payment of the fine will achieve the desired disciplinary purposes; - 8 - (2) The books and records of the licensee are kept in such a manner that the loss of sales that the licensee would have suffered had the suspension gone into effect can be determined with reasonable accuracy; and (3) The licensee has not had his or her license suspended or revoked, nor had any suspension stayed by payment of a fine, during the two years immediately preceding the date of the motion or complaint that resulted in a final decision to suspend the license or permit. (e) The fine accepted shall be not less than five hundred dollars nor more than one hundred thousand dollars. (f) Payment of a fine shall be in the form of cash, a certified check or cashier's check made payable to the local licensing authority. (g) Upon payment of the fine pursuant to subsection (c), the local licensing authority shall enter its further order permanently staying the imposition of the suspension. Sec. 6-5-130. Penalty . Failure to comply with the provisions of this Article shall constitute a violation of this Code, and in addition to being grounds for denial, suspension or revocation of a license, such violation may be punished as provided in Section 1-4-10 of this Code. - 9 - TOWN OF FRASER ORDINANCE NO. 396 Series 2012 AN ORDINANCE AMENDING THE FRASER MUNICIPAL CODE BY THE ADDITION OF A NEW ARTICLE PROHIBITING THE OPERATION OF MEDICAL MARIJUANA BUSINESSES WITHIN THE TOWN; TO BE EFFECTIVE IMMEDIATELY. WHEREAS, Article XVIII, Section 14 of the Colorado Constitution creates an affirmative defense for the medical use of marijuana to state criminal statutes prohibiting the cultivation, possession, and use of marijuana; and WHEREAS, the Colorado General Assembly has adopted the Colorado Medical Marijuana Code C.R.S 12-43.3-101 et seq., which provides for a regulatory and licensing system for the sale, distribution, cultivation and dispensing of marijuana for medical purposes without regard to whether the business or its owner, managers, employees, or suppliers are "primary caregivers" pursuant to Article XVIII, Section 14; and WHEREAS, the Colorado Medical Marijuana Code, in Section 12-43.3-106, C.R.S., provides a local option for local governments to prohibit the operation of medical marijuana centers, optional premises cultivation operations, and medical marijuana- infused products manufacturers by vote of the registered electors or by action of the local governing body; and WHEREAS, the Fraser Board of Trustees, by Ordinance 372, submitted a local option ballot question to the registered electors at a special election held on November 2, 2010, at which the electors voted not to prohibit the operation of medial marijuana businesses within the Town; however, such vote does not preclude the Board of Trustees from taking action to prohibit such operations; and WHEREAS, the Board of Trustees has previously adopted a temporary moratorium on the licensing of medical marijuana businesses pending the investigation and possible adoption of local regulations regarding such businesses, such moratorium having been extended through July 1, 2012 pursuant to Ordinance No. 390; and WHEREAS, the Board of Trustees has carefully considered the provisions of the Colorado Medical Marijuana Code, Article XVIII, Section 14 of the Colorado Constitution, and the potential adverse impacts of medical marijuana centers, optional premises cultivation operations, and medical marijuana infused products manufacturing operations on the health, safety and welfare of the Town of Fraser and its inhabitants, and has determined, in accordance with its general police powers for the protection of the public’s health, safety and welfare, that such medical marijuana centers, optional premises cultivation operations, and medical marijuana-infused products manufacturer operations should not be located within the Town's corporate limits; and WHEREAS, the Board of Trustees has further considered the protections afforded to patients and primary caregivers by Article XVIII, Section 14 of the Colorado Constitution, and by C.R.S. § 25-1.5-106, that are not required to obtain a license under the Colorado Medical Marijuana Code, and desires to affirm those protections in this Ordinance; and NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO, AS FOLLOWS: PART 1: AMENDMENT OF MUNICIPAL CODE. 1.1 The Code of the Town of Fraser, Colorado (herein sometimes referred to as the "Municipal Code"), is hereby amended by adding a new Article to Chapter 6 of said Code, to be numbered "Article 5 - Medical Marijuana", which shall read as follows: ARTICLE 5 Medical Marijuana Sec. 6-5-10. Definitions. (a) As used in this Article the following words shall have the following meanings, unless the context clearly requires otherwise: (1)MM Code means the Colorado Medical Marijuana Code, C.R.S. 12-43.3-101 et seq. (2)Medical marijuana business means a medical marijuana center, optional premises cultivation operation, or medical marijuana-infused products manufacturer for which a license is required under the MM Code. (b) The terms defined in the MM Code shall have the same meaning when used in this Article, unless context clearly requires otherwise. Sec. 6-5-20. Medical Marijuana Businesses Prohibited. Medical marijuana businesses, including medical marijuana centers, optional premises cultivation operations, and marijuana-infused products manufacturing operations are prohibited within the Town of Fraser. It is unlawful for any person to operate any such Medical marijuana business at any location within the boundaries of the Town. Sec. 6-5-30. Patients and Primary Caregivers - 2 - Nothing in this Article shall be construed to prohibit, regulate or otherwise impair the use, cultivation or possession of medical marijuana by a patient or the cultivation, possession or providing of medical marijuana by a primary caregiver for his or her patients, provided that any such patient or primary caregiver is doing so in accordance with all applicable provisions of Article XVIII, Section 14 of the Colorado Constitution, C.R.S. § 25-1.5-106, the Colorado Medical Marijuana Code, and any other applicable provisions of State law and the Fraser Municipal Code. Sec. 6-5-40. Penalty . Failure to comply with the provisions of this Article shall constitute a violation of this Code, and such violation may be punished as provided in Section 1-4-10 of this Code. PART 2: PENALTY CLAUSES. The following section of the Code of the Town of Fraser, Colorado, contains penalty clauses applicable to violations of this Ordinance, and such section is herewith set forth in full and hereby enacted: Sec. 1-4-10. General penalty for violation. It shall be unlawful for any person to violate, disobey, omit, neglect, refuse or fail to comply with or resist the enforcement of any provision of this Code; and where no specific penalty is provided therefor, the violation of any provision of thisCode shallbe punished by a fine not exceeding one thousand dollars ($1,000.00), by imprisonment for a term not exceeding one (1) year, or by both such fine and imprisonment. Each day such violation continues shall be considered a separate offense PART 3: REPEAL. Any and all existing ordinances or parts of ordinances of the Town of Fraser covering the same matters as embraced in this Ordinance are hereby repealed and all ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed; provided, however, that such repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this Ordinance. PART 4: SEVERABILITY. If any section, subsection, sentence, clause or phrase of this Ordinance or the said Codes adopted herein is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this Ordinance or said Codes. The Town of Fraser hereby declares that it would have adopted this Ordinance and said Codes, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases thereof be declared invalid or unconstitutional. - 3 - PART 5: DECLARATION OF EMERGENCY; EFFECTIVE DATE. Because of the immediate risk that inappropriate medical marijuana businesses might be permitted upon expiration of the existing state and local moratoriums, the Board of Trustees hereby finds, determines, and declares that an emergency exists, that this Ordinance is necessary for the immediate preservation of public peace, health, safety and welfare, and that it shall be in full force and effect immediately upon adoption. Paragraph (2): The applicants believe that the varience would be in full compliance with all District rights of use. We are in the process of scheduling a Board of Adjustment public hearing. Per the Fraser Municipal Code, a copy of the variance application shall be furnished to the Board of Trustees for an opinion, which opinion shall be returned to the Board of Adjustment. The applicant is the owner of subject property which is located at 821 Quail Drive in the R2 zoning district (Victoria Village, Block M, Lot 1). Eisenhower Drive has always been a "challenging" location to attract walk in customers because it is off the main drag, and the buildings are oriented in such a way that this area is not obvious as a business district. As a reminder financials are a snap-shot of the organization on the last day of the period (last day of the month). Since we do not operate our purchasing on a Purchase Order basis, nor do we “book” revenues earned but not received yet, the financials do not take into consideration those liabilities nor assets. But looking over the financials is a great way to get a quick feel for how we are doing year to date and to budget. At the bottom of the financials there is a notation of the percentage of the year that has elapsed, you can scan down the right column of the financials and compare the percentage of the year which has elapsed to the percent of budget expensed year to date. When you find a high or low percentage then you dig a bit deeper to see the expense type – say its professional memberships, this line item always gets expensed at the start of the year so it will always seem high early, but generally never changes after the second or third month of the year (in general). In the same vein, Town Sales Tax will always be low compared to budget (if it’s not you will find me dancing in the streets), because we are always two months behind in receipts. Feel free to call me with any variances you wish explained! Also transmitted this week is your April Sales Tax Report. On a “collections” basis the Town is UP $4877.00 dollars year-to-date!! And that is awesome news, and a situation that may point to more than just this year’s tourists buying groceries instead of eating out. Granted Winter Park experienced a drop of nearly 3.8% in lodging revenue in the first four months of the year as compared to last year, and a drop of nearly 6% in restaurant and bar revenue in the same period. The small percentage up for Fraser (1%) does not equate to the larger drop Winter Park is experiencing, so some more digging and brain storming is necessary to spot any trends which might be showing up? I’ve been wrapping up lots of projects which have been holding space on my desk recently, but my time has now become focused on the budget process. Of course the Joint Facility budget will need to be finalized first and sent to the JFOC for their blessing, which allows us and the other two entities to incorporate treatment costs and CRR amounts into our Waste Water Fund budgets. But the real fun is in the Town’s Funds…..and by fun I mean creativity! ByThomas Frey As a futurist, people often ask me how many of my predictions have come true. I find this to be a rather uncomfortable question. It’s uncomfortable, not because my track record hasn’t been up to par (actually, a high percentage have come true), but because accuracy of predictions is a poor way of measuring the value of a futurist. In a world filled with MBAs and number crunchers, there is a constant push to reduce our analog world to digital analytics so we can accurately measure our return on investment. But not everything is measurable in this way. As an example, for several years I have been tracking when my best insights occur, and they happen with far greater frequency when I’m riding bike. Therefore, it’s easy to conclude that if I spent 8-10 hours a day riding bike, I could somehow unlock the secrets of the universe. However, the world is far more complicated than the simple surface details we can measure. What’s the value of a new idea, a new strategy, or adding awareness to a previous blindspot? Too often, our ability to focus on one all-consuming detail blinds us to the oncoming train that is about to destroy an entire industry. For this reason I’ve put together a list of the Eight Critical Points of Value that a futurist brings to the table. The Power of an Epiphany The future is never a destination, it is always a journey. An idea that holds great value today, may be of little value two weeks from now. Many of our best ideas appear in the form of an epiphany. An epiphany is an ‘AHA’ moment; a sudden insight or revelation into the world around us. An off-the-charts idea would be considered a Category 5 epiphany if we were measuring insights with an earthquake scale. Creating an environment that cultivates great epiphanies can be hugely valuable. Every new business that gets launched happens as a result of an epiphany. Every new product idea happens as a result of an epiphany. It’s in our best interest to create new epiphanies and often. Critical Points of Value Thinking about the future is like a muscle that rarely gets used. Over time, our brains will atrophy and we lose our ability to think productively about what the future may bring. At the same time, the world is shifting faster than ever. Our “need to know” about the future is no longer a luxury; it’s a functional imperative. With this in mind, here are some of the values a futurist has to offer: 1.) Altered Thinking – The future is constantly being formed in the minds of people around us. Each person’s understanding of what the future holds will influence the decisions they make today. As we alter someone’s vision of the future, we alter the way they make decisions today. Our goal is to help individuals and organizations make better, more informed decisions about the future. 2.) Unique Perspective – The future is unknowable, and this is a good thing. Our involvement in the game of life is based on our notion that we as individuals can make a difference. If we somehow remove the mystery of what results our actions will have, we also dismantle our individual drives and motivations for moving forward. That said, the future can be forecast in degrees of probability. By improving our understanding of what the future holds, we dramatically improve the probability with which we can predict the future. 3.) Evidence of Change – Empirically speaking, forecasting the future is not done by staring at tealeaves of reading tarot cards (that is the realm of psychics). Futurists use data from the past and present, as well as other concepts and methodologies to understand how the present will evolve into probable futures. We also borrow freely from other fields, such as forecasting, chaos theory, complexity science, organization development, systems analysis, and sociology. 4.) Connecting the Dots – Futurists come from a wide range of backgrounds and perspectives. What we have in common is well-researched big picture thinking, strong pattern recognition, and innate curiosity. Ideas that are routine in one industry can be revolutionary when they migrate to another industry, especially when they challenge the prevailing assumptions that have infiltrated rank and file thinking. Start of Part II Here are more of the values a futurist has to offer: 5.) Find Your Future Competitive Advantage – French novelist Marcel Proust once said, “The real act of discovery consists not in finding new lands but in seeing with new eyes.” The most successful companies don’t just out-compete their rivals, they redefine the terms of competition by embracing one-of-a-kind ideas in a world heavily steeped in “me-too” thinking. 6.) Take Control of Change before the Changes Take Control of You – Are you changing as fast as the world is? Change is inevitable, but how you deal with this change can vary greatly. In a world that never stops changing, great leaders can never stop learning. How do you push yourself as an individual to keep growing and evolving? Does your company do the same? 7.) The Future is Where Our Children Live - Our desire to leave a legacy is a uniquely human attribute However, our legacy becomes meaningless if we don’t have new generations of people to pass it on to. To many this may sound like an obvious statement, but to those in the business world, there is a constant battle being waged over the needs of the present vs. the needs of the future. It’s very easy to place short-term profitability ahead of long-term problems. 8.) Every Avalanche begins with the Movement of a Single Snowflake. Our ability to tap into and leverage the power of the future is directly tied to the number of times we think about it. The more we think about the future, the more we expand our understanding of it. And the more we understand the future, the easier it becomes for us to interact with it. The Reaction Paradigm Most companies operate within a paradigm of reaction. When bad (or good) things happen, they continue to forge ahead. They may or may not adjust their way of doing business. This unswerving reaction paradigm occurs, frankly, because it takes all they can muster to keep the doors open, make payroll and turn a profit. It’s a tough world out there, and one widely held belief is that we’re all just trying to chip away at the world to make a buck. In this line of thinking, when things happen, you just do your best to hang on and hopefully do better next time around. These are companies that are always preparing themselves for the next disaster. Other companies plan for the future. They understand that markets shift, technology evolves and unexpected waves of mayhem occur. These companies often do better than the previous ones because they have the resources and foresight to weather this type of storm. Their leadership has given some thought to the murky future ahead of time, and allocates resources to various strategies for adapting to the ebb and flow of these natural occurrences. In the end it becomes easy to see that the greatest companies are those that take control of their own future. As a futurist it is my job to help these forward thinking companies weather through or simply avoid these stormy trends and achieve a more profitable, vibrant and successful future. If they can, they probably will. So then what? The researchers at Gallup have identified a hierarchy of connections between companies and their customers — from confidence to integrity to pride to passion. To test for passion, Gallup asks a simple question: “Can you imagine a world without this product?” One of the make-or-break challenges for change is to become irreplaceable in the eyes of your customers. The future cannot be our only priority otherwise we lose our ability to function in the present, and here is where it gets confusing. Near-term futures invariably take precedent over long-term futures, but our ability to prioritize importance is directly tied to the context of our own future thinking. Our thinking about the future cannot be made against a simple black and white, right vs. wrong backdrop. Every microcosm is a part of a larger microcosm, and I tend to agree with Futurist Mary O’Hara- Devereaux when she says, “Beware of conventional wisdom because it is usually wrong.” Thomas Frey is the executive director and senior futurist at the DaVinci Institute and currently Google’s top-rated futurist speaker. At the Institute, he has developed original research studies, enabling him to speak on unusual topics, translating trends into unique opportunities. Tom continually pushes the envelope of understanding, creating fascinating images of the world to come. His talks on futurist topics have captivated people ranging from high level of government officials to executives in Fortune 500 companies including NASA, IBM, AT&T, Hewlett-Packard, Unilever, GE, Blackmont Capital, Lucent Technologies, First Data, Boeing, Ford Motor Company, Qwest, Allied Signal, Hunter Douglas, Direct TV, Capital One, National Association of Federal Credit Unions, STAMATS, Bell Canada, American Chemical Society, Times of India, Leaders in Dubai, and many more. Having some well operating issues in the Rendezvous system. Working on addressing them. PW trucked in 840 ton of class 6 road base and placed and graded it on the Byers Peak ranch road last week. This completes maintenance on the entire roadway through the ranch. SANITARY SEWER~ See the supplemental memorandum regarding the 2012 Sewer Inspection and Cleaning contract that is on the Consent Agenda along with the associated Resolution. Through our inspection program we have identified areas that are still clay pipe and that will need to be slip lined, hopefully this year. Two spot repairs in upper Ptarmigan were completed last week. The asphalt street was also patched following completion of the work. STREETS~ . 2012 Streets and Drainage Improvements Projects- Bid opening was on June 7 There were five bid packet opened. The Notice of Award will be issued to ATH Specialties of Grand Lake for the Mill Avenue Flow Control Structures project; The combined totals for the two projects came in at $79,065.85. This amount is below the engineers estimate for the Drainage Swale project alone. Working with our chip and seal contractor to finalize quantities for this work. Street sweeping operations continue GARDENER~ We have contracted with SSR Vegetation (Billy SUMERLIN) for noxious weed management in the public right-of-ways in the Rendezvous subdivision. The hanging flower baskets for the business enhancement program are now available at the PW shop. They need to see Cathleen Brown for distribution. OTHER~ Hazardous tree removal along the Fraser River Trail near the Rendezvous th Subdivision will begin on Wednesday June 20 and should be completed by the nd end of the day on Friday, June 22. Rendezvous has graciously allowed Fraser to store the logs and slash on a portion of their property. The logs will be removed for firewood and the limbs will be burned during the winter months. There were also 21 citations issued during the month with 15 of those written in Winter Park and 6 in Fraser. The major incidents within the two Towns during May are as follows: Criminal Mischief - 6, Misdemeanor Driving Violations -4, Harassment/Disorderly Conduct - 3, Sex Assault - 1, Assault - 1, and Unattended Death (Suicide) - 1. In May, I completed the IACPs Leadership in Police Organizations Course. Based on the West Point Leadership Model, this course teaches the most current best practices in leadership and supervision. This three-week course of study focused on leadership at the individual, group and organization level. All supervisory personnel at the police department have now completed this course; a rarity within the State of Colorado.
