REGULAR MEETING
July 22, 2008
The Moab City Council held its Regular Meeting on the above date in
the Council Chambers of Moab City Offices, located at 217 East Center
Street, Moab, Utah. Mayor David L. Sakrison called the Pre -Council
Workshop to order at 6:30 PM.
Mayor David L. Sakrison called the Regular City Council Meeting to
order at 7:00 PM and Citizen B.D. Howard led in the Pledge of
Allegiance. Also in attendance were Councilmembers Gregg Stucki,
Kyle Bailey, Sarah Bauman, Rob Sweeten and Jeffrey Davis; City
Recorder/Assistant City Manager Rachel Ellison, Planning Director Jeff
Reinhart, City Treasurer Jennie Ross, City Engineer Daniel Stenta,
Police Chief Mike Navarre and Community Development Director
David Olsen. Three (3) members of the audience and media were
present.
Councilmember Sweeten moved to approve the Regular Meeting
minutes of July 8, 2008. Councilmember Bailey seconded the motion.
The motion carried 4-0 aye with Councilmember Bauman abstaining.
A Community Development Department Update was not given.
Under Engineering Department Update, City Engineer Stenta stated that
a few calls were still trickling in on the Storm water drainage fee and
that he and Treasurer Ross had been fielding the calls. City Engineer
Stenta that a note of interest was that the majority of callers thought that
the City had a property tax. City Engineer Stenta then stated that
several appeals would be forthcoming. City Engineer Stenta then stated
that the Mayor had requested that he respond to an inquiry from the
Environmental Protection Agency (EPA) regarding the Lions Back
Development in the Sole Source Aquifer area. City Engineer Stenta
stated that he had contacted the EPA and had explained the processes
the City had gone through so far for the proposed development. City
Engineer Stenta stated that the EPA had a positive response regarding
the City's actions and stated that only projects involving federal funds
required EPA level review and that it was rare that they would stop
residential development. City Engineer Stenta stated that he would keep
the EPA apprised of all developments within this area.
Under Planning Department Update, Planning Director Reinhart stated
that the Planning Commission would be holding a special meeting on
July 31, 2008 at 6:00 PM to place affordable housing amendments in the
R-3 and R-4 zones. Planning Director Reinhart stated that Planning
Staff was also in the process of drafting amendments to remove the RD
and MHRV zones from City code
A Police Department Update was not given.
A Public Works Department Update was not given.
Under Citizens to be Heard,
Mayor Sakrison Proclaimed August 4 to 8, 2008 as Relay for Life
"Paint the Town Purple" Week in the City of Moab.
Councilmember Sweeten moved to approve a Request by Tyler and
KaLeigh Welch for Approval of an Amplified Music Event at Old City
Park on August 23, 2008. Councilmember Bailey seconded the motion.
The motion carried 5-0 aye.

Councilmember Stucki moved to approve a Special Event License for
the Moab Century Tour to Conduct a Bicycle Tour on September 19 and
20, 2008. Councilmember Bauman seconded the motion. The motion
carried 5-0 aye.
Councilmember Stucki moved to approve a Moved -on Structure Permit
for Red Rock Special Olympics/Transitions to Conduct a Fundraising
Event from July 23, 2008 to February 23, 2009 Located at 90 North
Main Street. Councilmember Sweeten seconded the motion. The
motion carried 5-0 aye.
Councilmember Sweeten moved to approve a request for a Waiver of
the Moved -on Structure Permit and Vendor Fee by Red Rock Special
Olympics/Transitions in the amount of $418.75. Councilmember Bailey
seconded the motion. The motion carried 5-0.
Councilmember Sweeten moved to send a Zone Change Application
from R-4 to C-3 for Red Rock Partners Located at Williams Way and
100 West to Public Hearing. Councilmember Stucki seconded the
motion. The motion carried 5-0 aye.
Councilmember Bailey moved to approve Proposed Resolution #19-
2008 — A Resolution Approving the Historic Designation for the John
W. "Doc" Williams Home at 40 West 100 North. Councilmember
Bauman seconded the motion. The motion carried 5-0 aye.
Councilmember Bailey moved to approve Proposed Resolution #23-
2008 — A Resolution of Support for the Application of the International
Property Maintenance Code to a Specific Abandoned Property and
Recognizing Authority of Staff to Procure Services of a Qualified
Contractor for the Removal of Structures. Councilmember Davis
seconded the motion. The motion carried 5-0 aye.
Councilmember Sweeten moved to Send Proposed Ordinance #2008-20
— An Ordinance of the Governing Body of Moab Annexing Property to
the City of Moab — School and Institutional Trust Lands
Administration/Lionsback to Public Hearing. Councilmember Stucki
seconded the motion. The motion carried 5-0 aye.
Councilmember Bailey moved to approve a Local Vendor License for
Red Rock Special Olympics/Transitions. Councilmember Sweeten
seconded the motion. The motion carried 5-0 aye.
Mayor Sakrison opened a public hearing on Proposed Ordinance #2008-
21 — An Ordinance of the Governing Body of Moab Annexing Property
to the City of Moab — North Area Annexation at 7:29 PM.
No public comment was given.
Mayor Sakrison closed the public hearing at 7:30 PM.
There was no Correspondence to be Read.
An Administrative Report was not given.
Under Report on City/County Cooperation, Mayor Sakrison stated that a
joint meeting had been held.
Under Mayor and Council Reports, Councilmember Bailey stated that
Moab Valley Health had put out three proposals for funding.
Councilmember Sweeten stated that several Higher Education
Committee meetings had been held recently.

Councilmember Bauman stated the Affordable Housing Committee was
one step closer to adopting the affordable housing plan.
Councilmember Bailey moved to pay the bills against the City of Moab
in the amount of $131,714.48. Councilmember Bailey seconded the
motion. The motion carried 5-0 aye by a roll -call -vote.
