The motion was seconded by Mr. Harrow and it was passed by everyone except Mr. Barker-Hook who abstained.  A discussion was held about a complaint received for site work potentially within the Commission’s jurisdiction along the paper road section of Linden Street. During the site inspection, the property owner of 10 Linden Street confirmed they performed site clearing activity within the Commission’s jurisdiction subject to planning for subdividing their property for potential development of a single family home. The property owner confirmed a Notice of Intent applicant is being prepared to be submitted for the Commission’s review. The Commission determined to table any further action subject to the submission of the pending NOI information.  A fines discussion was held for Heritage Properties, Trails at Legacy Farms North (188-1649). The Commission determined to assess a fine of $6,000.00 as outlined in the memorandum dated 26 November 2018. The Commission determined to hold the issuance of the fine in abeyance until the project is complete. 7:48 PM REC Hopkinton, LLC, 0 South Street (R29 7 B) DEP File No. 188-____ Abbreviated Notice of Resource Area Delineation Scott Goddard, Goddard Consulting Mr. Goddard provided an overview of the Abbreviated Notice of Resource Area Delineation application and resource plan dated 12 September 2018. A discussion was held regarding the Lucas Environmental Memo dated 27 November 2018. Mr. Goddard noted he is still completing his site assessment and will respond to the Lucas Environmental Memo in due course. Hopkinton Conservation Commission 04 December 2018 Page 2 of 3 The hearing was continued to 18 December 2018. 7:53 PM Nation, 1, 3, 5 Whisper Way, 0, 0, 0, 129 Wood Street DEP File No. 188-1665 Notice of Intent - continuation Scott Goddard, Mark Arnold, Goddard Consulting; Chris Nation, Craig Nation, applicants Mr. Goddard noted they have received the Lucas Environmental comments dated 29 November 2018 and will respond in due course. A discussion was held about the email dated 04 December 2018 from the Conservation Administrator. Mr. Arnold provided an overview of a plan for the construction of Route 495 in the subject area dating from 1965. He provided a historical overview of the development of the Whisper Way area. A discussion was held about the construction of the Whisper Way roadway and the wetland replication area subject to DEP File Number: 188-535. A discussion was held about the subsequent development of 1 Whisper Way in 1998 and 3 Whisper Way in 1993. A discussion was held about the Lucas Environmental memo dated 29 November 2018. A discussion was held about the Notice of Intent wildlife habitat evaluation. A discussion was held about the viability of wildlife passage subject to the proposed culverts. It was noted that further peer engineering review from BETA Group is pending. The Commission requested that Goddard Consulting provide all their field notes and further documentation subject to their review of the vernal pools under the ANRAD application (188-1647). Mr. Goddard noted the requested information would be provided for the Commission’s review. The hearing was continued to 18 December 2018. 8:30 PM Commission Business – continued  A discussion was held regarding the 23(b)(3) Disclosure of Appearance of Favor or Influence from Lucas Environmental dated 27 November 2018.  The Commissioned reviewed the e-mail message submitted by Ms. Kathleen Towner on 27 November 2018. The Commission determined to request that Eversource clarify if they are still using the noted firefighting foam and the testing regime utilized prior to discharging water from the basin.  A discussion was held regarding the issuance of an Emergency Certification on 03 December 2018 to the Hopkinton DPW for the site activities at 87 Elm Street. Ms. LeBlanc made a motion to ratify the Emergency Certification. The motion was seconded by Ms. Reed and it passed unanimously.  The Commission tabled the review of the 16 October 2018 Minutes.  A discussion was held regarding runoff from private property onto public ways. Mr. Ciriello noted he would like to work with ZAC regarding runoff onto public ways and the requirement of construction entrances for all projects in Town.  A discussion was held regarding the status of the Enforcement and Restoration Order issued to Buonara, 6 Peter Porcaro Road. It was noted that Ms. Buonara told the Commission at the 11 Hopkinton Conservation Commission 04 December 2018 Page 3 of 3 September 2018 public meeting that she would submit the required restoration planting and elevation plans. It was noted that the plans have not been received to date. The Commission determined to notify the property owners that the outstanding plans are required to be submitted no later than 31 January 2019 and that a fines hearing would be scheduled for 12 February 2019 if the outstanding plans were not submitted.
