Jones Clerk-Treasurer GREENCASTLE COMMON COUNCIL SPECIAL SESSION TUESDAY, JULY 7, 1998 5:30 P.M. PUTNAM COUNTY LIBRARY The Greencastle Common Council met in Special Session Tuesday, July 7, 1998, 5:30 p.m. at the Putnam County Library, Mayor Michael called the meeting to order. On the Roll Call, the following were found to be present: Councilor Roach, Councilor Green, Councilor Baynard and Councilor Masten. Councilor Hammer arrived at 6:00 p.m. Also present was City Attorney Trudy Selvia. The purpose of this meeting is to discuss the trash contract. Representatives from Refuse Handling and the Clean City Committee were present. The Clean City Committee worked on bids that included several options including two and three bag limits and a volume based price. Refuse Handling currently has the contract which includes three bags and recyclable at a cost of $6.98 per household or $18,678.48 per month. The proposed contract from Refuse including three bags and recyclable is $6.89 per household or 518,437.64 per month. The new contract includes foil, tin, magazines and catalogues in the recycling. Councilor Masten suggested a one year contract with thorough monitoring of the tonnage to see if a volume based price could serve the City better in the future. Mayor Michael requested a two year contract due to the time consumed to go through the bidding process. Councilor Roach questioned how each household would be billed if we went to a volume based billing. Ken Decker, Clean City Committee representative, stated the billing would remain the same. Councilor Hammer arrives at the meeting. Councilor Roach continued that the current rate is good, the first year of this contract even better, but is concerned that if we go with just a one year contract the rate next year would be higher than the $7.57 Refuse has quoted for a second year on the contract. Councilor Masten stated that he was still interested in the one year contract and willing to take the gamble on the second year due to the fact that another year of experience could result in a lower rate for volume based pricing. Councilor Masten asked if Refuse was willing to go with a 3% increase for the second year. Refuse replied "no ". After discussion, Councilor Masten made the motion to recommend a one year contract with Refuse handling at the prescribed rate of $6.89 per household or $18,437.64 per month, Councilor Green seconded the motion. Vote as follows: Councilor Roach Nay - feels two year contract is best Councilor Hammer Aye ® Councilor Green Aye Councilor Baynard abstained " Councilor Masten Aye Resolution 1998 -20, A Resolution Authorizing Expenditure of Industrial Development Funds (Funding the Greencastle /Putnam County Development Center) was brought before the Council after a veto by Mayor Michael. Attorney Selvia stated that she interprets I.C. 36 -4 -16 to read that if no action is taken by the Council the veto would stand or it would take a two- thirds vote to override the veto. Councilor Masten made the motion to take no action on Resolution 1998 -20 and have a new resolution prepared for the July 14 Council meeting. Motion was seconded by Councilor Green. Mayor Michael asked for discussion. Councilor Roach stated he will go along with letting the veto stand, but the two stipulations placed on Resolution 1998 -20 are very important to the Council and they need some direction. Number one, stipulations were put on the Putnam County Foundation when the Industrial Development monies were turned over to them. The Council did require them to rewrite their bylaws to have a Council member on their board. Number two, the intent of the stipulations are not to take appointments out of the Mayor's hands, but the Council is very concerned about appearances and although there may not be actual conflicts, the appearance of a conflict concerns the Council. Stating that the Council is holding the funds as hostage is probably true, but that is the only power the Council has, the power of the purse strings. Our business, Councilor Roach continued, is to look out for taxpayers money and to spend it appropriately. If we can head off litigation that is what we need to do. Councilor Roach stated that he feels the GPCDC and Director Bill Dory do a goodjob at what they do. Maybe we need more separation. Councilor Masten stated the most important issue is to keep the City out of litigation or other � things that adversely affect the City. We tried to get Council representation on the Executive Committee without having to place stipulations on this document, but were unable to do so. Councilor Masten continued that this Council and future Councils appropriate money and have to act on the recommendations from GPCDC and the intent is for the Council to be involved in the earliest stages of development to better serve the citizens of Greencastle. The Council seems to be the "final hurdle" for these issues. The people's representatives are the last to know. Councilor Hammer stated that one difference between the Putnam County Foundation and the Greencastle/Putnam County Development Center is that there was no council representation on the PCF board at all, we do have representation on the GPCDC. Councilor Roach stated the Council has representation on the Grants and Finance Committees at the PCF. Councilor Masten stated that no two agreements are going to be entirely alike, but feels these are reasonable requests to make. Councilor Roach stated that everyone who sits on the GPCDC or on the Executive Board represents their entities- banks, utility companies, etc. - our constituents are important and also deserve to be represented. Councilor Hammer stated the Mayor sits on the Executive Committee and the GPCDC Board to represent the City. Councilor Roach stated that is no guarantee, the Mayor is not part of the legislative body. Vote was unanimous. F_ L " E Motion to adjourn made by Councilor Hammer, seconded by Councilor Roach.
