Section j. The several scans above mentioned and assessed against the said parcels of property, and the o~mers thereof, and interest thereon at the rate of six per cent (6~0) per annum, together with reasonable attorneys' fees and costs of collection, if incurred, are hereby declared to 'be and are made alien upon the respective parcels of property against s~lzich the saiize are assessed, and a personal liability and charge against the real anc'~ true owners of such property, whether such owners be correctly named n.erein or not, and the said liens shall be and constitute the first enforceable lien and claim against the praperty on ti~rhich such assessments are levied, and s'rzall be a first and paramount lien thereon, superiar to all otlzer liens and clairis, e<tcept ~ta;te, County, School District arzd '~'o~an ad valorem t~~>es. Provided, however, that aa~y o~mer shall have the ri~;Yit to pay the entire assessment, or any installment thereat, berore matur- ity by payment of principal and accrued interest, and provided further that if default shall be made in the paylnent of any installment of principal or interest promptly as the same matures, then the entire amount of the assess- ment upon which such default is made, shall, at the option of the Town of Richland, Texas, or its assigns, be and beccune irmnediately due anci payable, and shall be collectible, together with reasonable attorneys' fees and costs of collection,. if incurred. Section 6. After the acceptance of said improvements by the t;oard of Aldermen on all or ashy portion of said streets, the assessor and Collector of Ta<~es of said Town shall give such notice as may be required by law of said tax being due and within what time parable, and shall begin to collect the same. Section 7. Tull power to correct mistakes, errors, invalidities or irregulari- ties in the assessments is reserved to and vested in the Town. Section 8. E'11.1 assessments levied are a personal liability and charged against the real and true owners of the premises described, not~,rithstanding such owners may not be named, or may be incorrectly named. Section g. The assessment levied are made and levied under and by virtue of the terms, pozrers acid provisions of the Acts of the Legislature of 1875, Page 11.;, G. L. It is expressly agreed and understood that to secure the payment of said obligation according to the payments herein provided, Parties of the First Part expressly grant to Party of the Second Part, or its assigns, an express mechanics, materialman9s, laboror~s and contractorts lien on the above described real estate and the improve- ments now upon or to be placed upon said land, and it is agreed and understood that said obligation may be assigned by such holder to other parties.
