HomeMy Public PortalAbout2016.041 (02-16-16)RESOLUTION NO. 2016.041 A RESOLUTION OF THE CITY COUNCIL OF CITY OF LYNWOOD SELECTING THE PREFERRED BUS SHELTER DESIGN; AUTHORIZING STAFF TO PURCHASE BUS SHELTERS THROUGH A 4/5 VOTE OF THE CITY COUNCIL THAT THE ACQUISITION MAY BE MORE ECONOMICALLY AND EFFICIENTLY EFFECTED THROUGH ALTERNATE PROCEDURE UNDER 6- 3 -13(a) (3) OF THE LYNWOOD MUNCIPAL CODE; AND TO ISSUE A NOTICE INVITING BIDS FOR THE INSTALLATION AND NECESSARY REPAIRS TO THE BUS PAD AND /OR SIDEWALK WHEREAS, the City's existing bus shelters are 20 years old and in need of replacement; and WHEREAS, the City Council approved a Bus Stop Improvement Project (CIP No. 68 -013) in the amount of $1,000,000 as part of the City's Capital Improvement Program; and WHEREAS, Los Angeles County Metropolitan Authority (Metro) originally approved $400;000 for the use of Proposition A funds for a Bus Shelter Improvement project; and WHEREAS, staff submitted an increase of funding to Metro to align with the City Council approved budget; and WHEREAS, staff estimates a need to spend an additional $500,000 in Proposition A funds to avoid return of funds to Metro; and WHEREAS, expediting the implementation of the Bus Stop Improvement Project (CIP No. 68 -013) by purchasing the bus shelter will assist the City meet the minimum expenditure of Proposition A funds by the end of June 30, 2016. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS: Section 1. That the City Council finds that acquisition of goods and services through the use of an alternate procedure instead of a formal bid process may be economically and efficiently effected for the acquisition of bus shelters; and thus direct the City Manager or his designee to negotiate with vendors to obtain the best price. Section 2. That the City Council approves this alternate method of acquiring goods and services by way of a vote not less than four -fifths (4/5) of its members pursuant to Section 6- 3.13(a)(3) of the Lynwood Municipal Code. Section 3. That the City Council authorizes the Mayor to execute a Purchase Order Agreement or an Agreement in a form approved by the City Attorney with the vendor recommended by the City Manager. Section 4. That the City Council directs the City Manager to provide a report to the City Council on the result of the negotiations and on the final executed Agreement. Section 5. That the City Council authorizes the Director of Public Works /City Engineer, if appropriate, to install benches and /or shelters to those bus stops lacking amenities at a cost not to exceed 10 percent of the approved budget. Section 6. That the City Council authorizes the flexibility to use Proposition C and /or Proposition A for this project . as best determined by the Director of Public Works /City Engineer contingent upon approval by Metro on the use of the funds and directs the Director of Finance to make such necessary appropriation and to appropriate additional funds not to exceed 10 percent of the approved budget to install benches and /or fully equipped shelters at bus stop locations lacking amenities. Section 7. This resolution shall take effect immediately upon its adoption. Section 8. The City Clerk shall certify as to the adoption of this City Council Resolution.
